This paper introduces the concept of 'product stewardship' as a new policy approach towards solid waste management. The German Packaging Ordinance is analysed as a prototype of this new approach. Particular attention is paid to the economics of the Packaging Ordinance, to the practical implementation problems and to the likely impact of the planned EU Directive. Finally, what can be learned from the German experiences for the future design of waste management policies involving product stewardship is discussed.  相似文献

Regulations to implement Directive 85/337/EEC have been in operation in the UK for over 10 years. Implementation of the amended Directive (97/11/EC) in March 1999 marked the start of a new phase in environmental impact assessment (EIA), and so a review of the impact of the original Directive upon EIA activity is timely. This paper examines the implementation of the Directive in the UK through an empirical analysis of the publication of environmental statements (ESs) between July 1988 and April 1998. ES submissions are analysed under Annexes I and II of the Directive and under the main UK regulations, and then development control decision outcomes are considered. The implications of selected legislation and policy initiatives for ES submissions are then investigated in detail for four types of project. The Directive has been a major force in stimulating the development and growth of EIA in the UK, although the interaction of policies and legislation (environmental and otherwise) can exert an important influence upon trends in ES submissions.  相似文献

This paper sets out the legislative background to the recycling of waste materials in the UK. Relevant items in this background include: the provision of recycling credits under the 1990 Environmental Protection Act; the draft EC Packaging Waste Directive; and the German DSD scheme. We next set out the elements of a cost‐benefit analysis of waste paper recycling, including the environmental impacts of recycling. The method is then applied to a recycling scheme in central Scotland. We find that whilst on private, financial grounds the scheme is unattractive, it passes the cost‐benefit test in the base‐line case; this justifies government support for this recycling scheme, given the data used.  相似文献

The influence of European environmental policy is transforming more than just the way that environmental protection is organised and implemented in the UK. The nature of environmental politics is also changing dramatically. The paper examines the implementation of the Bathing Waters Directive in the South West of England to illustrate how Europeanisation opens up new scope and spaces for political action. The legal standards laid down in directives such as the Bathing Waters Directive provide an authoritative yardstick which environmental pressure groups can use to exert pressure at the local as well as the national level. In turn, Europe becomes increasingly viewed in the UK as the moral arbiter of what counts as 'pollution'.  相似文献

This paper outlines a methodology for the systematic assessment of policy instruments for environmental management and illustrates its application using solid waste management in Hong Kong. The methodology consists of three steps: (i) developing a set of evaluation criteria (and deciding whether certain criteria are to be given greater weight than others), (ii) selecting the relevant combination of potential policy instruments, and (iii) ranking each set of policy instruments on the basis of the evaluation criteria. One advantage of this approach is that the tradeoffs among the various evaluation criteria are made explicit when one policy instrument is chosen over the alternatives, thus making the assessment process more open and potentially less contentious. Unfortunately, in Hong Kong, the assessment of solid waste management options, like that for most other environmental problems, has beenad hoc, piecemeal, and has allowed for very little consultation at early stages from those outside of the principal government agency involved. Largely as a consequence, outside groups (including those from other parts of government) often strongly object to the selected policy and seek to block its implementation.  相似文献

The 1994 European Directive on Packaging and Packaging Waste allowed a diversity of conceptions of waste management to be developed and tested in various countries. Such a diversity may raise drawbacks related to the achievement of the single market and the European law of competition. The paper describes the main differences in waste management regimes in five countries: France, Germany, the Netherlands, Italy and Greece. This comparative approach allows us, first, to identify four main variables in order to characterize policy regimes, explaining the degree of orientation of waste regimes to cost-effectiveness. Second, we will show that implementation has resulted, in each country, in learning, correction and self-regulation, thus reducing the initial divergences between national regimes. Hence, efficient harmonization of waste management regimes may be achieved unexpectedly in a soft way without passing stringent European directives. Moreover, if policy-makers were to adopt explicitly the option of experimenting with competing organizational and policy concepts, as an approach to European harmonization, it would reveal, by 2004, the cost-effectiveness of alternative solutions at a time when European policy has to be reconsidered. In the process of implementing EU policy, Member States sometimes introduce new policy instruments in cases where this is not obligatory. To better understand this phenomenon, this paper reviews three cases in which new instruments emerged and develops a methodology to trace back the influence of EU Directives on instrument choice. The method is illustrated by a narrative of the emergence of new management planning instruments during the implementation of the EU Habitats Directive in three EU Member States: Finland, Hungary and the Netherlands. Three key features of a policy instrument are defined, namely, its authoritative force, action content and governance design. These are used to measure the contribution of the Habitats Directive compared to other potential explanatory causes for the emergence of the new policy instrument. In all three reviewed countries a nested causal relationship between the Habitats Directive and the introduction of the new policy instrument is identified. Based on the relative contribution of the Habitats Directive to the emergence of the new instrument a distinction is made whether the Directive acted as a cause, catalyst or if conjunction occurred.  相似文献

Claims of employment and productivity gains from environmental taxation are examined in the context of recent policy developments which have extended the traditional role of economic instruments in environmental regulation. Although the general existence of such spin-offs cannot be established, the debate has clarified guidelines for designing and implementing specific environmentally based taxes to help deliver sustainable development. Recent UK tax proposals have started to draw on the flexibility of fiscal instruments to tackle environmental problems. Innovations include earmarking taxes to fund allied spatial and sectoral programmes, recycling revenues to provide fiscally neutral improvements in tax efficiency and using taxation to help promote eco-efficiency.  相似文献

The EEC Shellfish Directive is a policy designed to protect and, where necessary, improve the quality of designated shellfish waters. Its implementation within the UK, however, has had no effect upon water quality for two reasons. First, the policy has important defects, having ambiguities concerning public health provisions and lacking designation criteria. Second, UK government has sought to achieve formal compliance, while at the same time ensuring that its full financial impact on public expenditure has been contained. Consequently, only those fisheries which already comply with water quality standards have been designated. Within Wales, one fishery has been designated, while other, commercially more important, but grossly contaminated shellfisheries have not.  相似文献

Abstract

In recent years there has been increasing interest in the use of so‐called ‘economic instruments’ in environmental policy. Economic instruments influence the behaviour of economic agents by providing financial incentives for environmentally improved behaviour, or disincentives for damaging behaviour. This paper explores the use of economic instruments in the field of sustainable community planning and development. It does so in the wider context of how environmental economic policy is made. The focus of this paper is to examine the role of policy instruments in community planning, and to review the different types of instruments that are available to policy‐makers. Numerous examples of the various instruments at the community level are described. It is widely believed that policy making should occur at the lowest or most local level possible while maintaining effectiveness. A system of government that does not give adequate legal power to local governments, and does not allow local governments considerable flexibility in the use of funds, cannot be expected to achieve all community objectives. Central governments must give local governments permission to take measures towards sustainable community planning, even though that requires giving them power to address broader issues. At the same time, when issues that should be addressed at national and international levels are not addressed, local governments may be able to take action individually. Given the general reluctance (and perhaps inability) of governments at all levels today to consider non‐economic and, particularly, non‐market policy instruments, it is pragmatic as well as timely to improve our understanding of economic instruments for sustainable community development.  相似文献

Economic instruments, such as effluent fees and tradable discharge permits (TDP), have often been suggested by economists as efficient or cost-effective means to control pollution. In recent years such instruments have received increasing attention due to their growing political acceptability. Still, their use in practice has been tentative. The interest in possible application of such instruments has led to a set of studies regarding their practical potential. These studies indicate that economic instruments require substantial government involvement, entailing high administration cost; require restrictions so as to prevent significant deterioration in receptor areas; and have ambivalent effects on innovation adoption. Consequently, the efficiency gains from such instruments may be smaller than potential gains identified in earlier studies. In addition, the distributional impacts of such instruments and their possible adverse effect on market contestability reduce their attractiveness in some cases. These findings raise the question: what is the desired role of economic instruments in addressing environmental concerns? In recent years the demand for environmental services has increased dramatically. Current legislation and studies indicate that desired environmental expenditures are likely to increase. At the same time environmental programs face increasing competition from other programs for a declining pool of general revenues. One outcome of these processes has been the search for alternative sources of funds for environmental programs. Furthermore, as the competition for general revenue funds increases, the allocation of such funds for environmental programs becomes less predictable. This may endanger many long-term environmental programs that require stable funding. This article suggests that economic instruments may prove one source of dedicated funds for many environmental goals. Consequently, studies of environmental-program financing as well as studies of economic instruments may well explore the possible role of economic instruments as financing tools. Some examples of the potential of such tools for estuary cleanup programs are discussed.  相似文献

This paper examines the possibilities of developing agri-environmental policy measures in Israel, focusing on market-oriented instruments. A conceptual framework for developing agri-environmental policy measures is presented, first in very broad lines (mandatory regulations, economic instruments and advisory measures) and subsequently focusing on economic instruments, and specifically, on market-oriented ones. Two criteria of choice between the measures are suggested: their contribution to improving the effectiveness of the policy; and the feasibility of their implementation. This is the framework used for analyzing agri-environmental measures in Israel. Israel currently implements a mix of mandatory regulations, economic instruments and advisory measures to promote the agri-environment. The use of additional economic instruments may improve the effectiveness of the policy. When comparing the effectiveness of various economic measures, we found that the feasibility of implementation of market-oriented instruments is greater, due to the Israeli public’s preference for strengthening market orientation in the agricultural sector. Four market-oriented instruments were practiced in a pilot project conducted in an Israeli rural area. We found that in this case study, the institutional feasibility and acceptance by stakeholders were the major parameters influencing the implementation of the market-oriented instruments, whereas the instruments’ contribution to enhancing the ecological or economic effectiveness were hardly considered by the stakeholders as arguments in favor of their use.  相似文献

Despite a general decrease in Dutch environmental emission trends, it remains difficult to comply with European Union (EU) environmental policy targets. Furthermore, environmental issues have become increasingly complex and entangled with society. Therefore, Dutch environmental policy follows a pragmatic line by adopting a flexible approach for compliance, rather than aiming at further reduction at the source of emission. This may be politically useful in order to adequately reach EU targets, but restoration of environmental conditions may be delayed. However, due to the complexity of today’s environmental issues, the restoration of environmental conditions might not be the only standard for a proper policy approach. Consequently this raises the question how the Dutch pragmatic approach to compliance qualifies in a broader policy assessment. In order to answer this question, we adapt a policy assessment framework, developed by Hemerijck and Hazeu (Bestuurskunde 13(2), 2004), based on the dimensions of legitimacy and policy logic. We apply this framework for three environmental policy assessments: flexible instruments in climate policy, fine-tuning of national and local measures to meet air quality standards, and derogation for the Nitrate Directive. We conclude with general assessment notes on the appliance of flexible instruments in environmental policy, showing that a broad and comprehensive perspective can help to understand the arguments to put such policy instruments into place and to identify trade-offs between assessment criteria.  相似文献

The UK is reportedly an international leader in the application of environmental policy appraisal (EPA). From the late 1980s until 2004, UK central government sought to produce ex ante assessments of the potential environmental impacts of different policy options. Critics maintain that EPA had a very limited impact on policy-making activities in Whitehall departments. However, the empirical basis for these claims is surprisingly thin. This paper seeks to better understand what facilitated or retarded EPA by looking at its use in Whitehall, with the aim being to draw lessons for the UK's new and more integrated appraisal regime, as well as similar systems in the European Union. The paper finds that the implementation of EPA was both weak and highly sectorised, and that there is an underlying resistance to policy appraisal per se in Whitehall. These weaknesses urgently need to be addressed otherwise new systems of integrated appraisal will not deliver what is expected of them.  相似文献

The development of regulations to implement Environmental Impact Assessment (EIA) in England and Wales occurred initially as a response to European Community Directive obligations. Since then, a proliferation of regulations has resulted from the need to meet those obligations which were not covered successfully by the first tranche of legislation; the desire to extend the range of project types requiring EIA beyond those specified in the Directive; and the need to respond to changes brought about by privatization.As a result, current regulations relating to EIA are extremely complex and are in a constant state of flux. This inevitably causes problems for those responsible for their implementation. Ten years after the 1985 Environmental Impact Assessment Directive was notified to the Member States, it has undergone a review and the European Commissionhas reached a common position on the proposedamendments.The implementation date for Member States to meet the requirements of the amended Directive is 31 December 1997 (ENDS, 1996). However, the 1985 Directive has yet to be fully implemented in the UK.  相似文献

This paper focuses on impediments to environmentally sound management practices and how these might be overcome, with an emphasis on the role of environmental management systems, supply chains and civil society. It argues that: Farmers are under increased pressure to cut costs and improve production but with little opportunity to increase prices. Commonly short-term economic interest has damaging environmental implications. Current government policy, in Australia and in many other jurisdictions, relies heavily on voluntary arrangements, education and information, as the main policy instruments through which to persuade farmers to adopt better environmental farm management - e.g. the recent push to encourage the use of voluntary environmental management systems. However, there is good evidence to suggest that these can only make a valuable contribution when combined with a range of other policy instruments, including positive and negative incentives, intervention by third parties and in some cases, an underpinning of regulation. Arguably, what is needed is a strategy that builds on the strengths of voluntary environmental management arrangements while compensating for their weaknesses by combining them with other, complementary policy instruments. If so, we must engage with a range of questions that have not so far figured substantially in the policy debate. Although the principal focus has been on the role of government in bringing about on-farm change in management practices, supply chain pressure (at least in respect of agricultural chemicals and practices which threaten food safety) and civil society action are also potentially powerful mechanisms for bringing about change. Government can and should play a role in harnessing such forces in the interests of improved environmental on-farm practices.  相似文献

The obvious paradox within China's environmental politics is the big gap between the central government's policy and its implementation outcomes at local levels. Despite concerns about implementation at the local level, much about the role of central governments in China's local environmental politics is still poorly understood. This article examines how the incentive structure set by the central authorities affects the policy implementation gap at the local level. Drawing on fieldwork and document analysis, this article argues that the incentives set by the central government regarding environmental policy implementation at local levels are perversely structured, meaning that the central government provides much more incentive for local governments' non-implementation or poor implementation of its environmental policies than it provides for full implementation. The central government's failure to encourage—politically, financially, as well as morally—local government officials to appropriately implement environmental policies can partly explain the production of the policy implementation gap at the local level. This implementation gap cannot be overcome by efforts at the local level unless the central government takes significant measures to address the perverse incentive structure embedded in the overall structure of China's local environmental politics.  相似文献
