随着国家政策导向提出实现生物多样性整体性、系统性保护的要求,新时期背景下的生物多样性保护除了注重实现生物多样性在自然生态系统、生物物种、遗传资源(基因)三方面的协同性整体性保护以外,还强调了实现自然生态系统平衡、维护国家安全等总体性目标。在此背景下,本文建议,生物多样性保护法律体系也应当在推动立法实践、提升国家安全治理能力、整合现有立法资源等方面发挥其应有价值。从系统性的角度出发,明确法律体系贯彻生物多样性整体性保护理念、执行国家战略部署以及平衡多元化利益的应有定位,并在此基础上从整体性目标的树立、网格联动性的体系构建、合理配置现行法律制度等方面探寻系统性法律体系的构建路径,将有效发挥我国生物多样性保护法律体系在服务社会需求、回应国家政策导向等方面的制度支撑价值。  相似文献

环保社会组织作为政府与公民之间的桥梁成为生物多样性保护多元参与机制的重要一环,生物多样性的内在特性与时代法治特征也推动着环保社会组织的参与。但当前环保社会组织参与生物多样性保护面临着规范体系不健全、规范运行机制不稳固、参与保护效果稳定性不足的困境,主要源于公私主体意识对立、自然资源法律体制机制未完善、环保社会组织持续能力建设有待加强三个因素,其根源在于我国对于生物多样性保护与利用的认识程度以及反映到规范政策与法律运行的适应程度。应将基于自然的解决方案作为生物多样性保护指导思路,综合包容多样利益方,优化生物多样性保护整体规制运行。具体来说,通过优化整合生物多样性保护规范体制中环保社会组织规范结构、参与运行机制、持续性功能发展机制,逐步规范环保社会组织在生物多样性规范机制中的位置与路径,从而实质推进我国生物多样性保护多元参与体制的构建与完善。  相似文献

生物多样性保护法律的有效执行,应立足于具体规制工具的设计。生物多样性保护立法涉及三个主要法律领域——物种保育法、自然保护地法和生物安全法,从法律规范层面分析,这三个法律领域对规制工具的偏好与选择呈现出"硬者极硬,刑罚优先,软者无力"的整体格局。本文以生物多样性保护原理对现行规制工具进行检验,物种保育法和自然保护地法应以规制领域的去极端化为导向进行规制工具更新,一方面要软化甚至去除极硬规制,与此同时应建立完善行政合同、行政指导、行政奖励等柔性规制工具,赋予其可操作性,使之柔而有力。  相似文献

Roadless and Low-Traffic Areas as Conservation Targets in Europe   总被引:1,自引:0,他引:1  
With increasing road encroachment, habitat fragmentation by transport infrastructures has been a serious threat for European biodiversity. Areas with no roads or little traffic (“roadless and low-traffic areas”) represent relatively undisturbed natural habitats and functioning ecosystems. They provide many benefits for biodiversity and human societies (e.g., landscape connectivity, barrier against pests and invasions, ecosystem services). Roadless and low-traffic areas, with a lower level of anthropogenic disturbances, are of special relevance in Europe because of their rarity and, in the context of climate change, because of their contribution to higher resilience and buffering capacity within landscape ecosystems. An analysis of European legal instruments illustrates that, although most laws aimed at protecting targets which are inherent to fragmentation, like connectivity, ecosystem processes or integrity, roadless areas are widely neglected as a legal target. A case study in Germany underlines this finding. Although the Natura 2000 network covers a significant proportion of the country (16%), Natura 2000 sites are highly fragmented and most low-traffic areas (75%) lie unprotected outside this network. This proportion is even higher for the old Federal States (western Germany), where only 20% of the low-traffic areas are protected. We propose that the few remaining roadless and low-traffic areas in Europe should be an important focus of conservation efforts; they should be urgently inventoried, included more explicitly in the law and accounted for in transport and urban planning. Considering them as complementary conservation targets would represent a concrete step towards the strengthening and adaptation of the Natura 2000 network to climate change.  相似文献

Human actions towards land, freshwater and oceans have already caused biodiversity to decline. This study aims to investigate attitudes towards the conservation of biological biodiversity among different groups in a Swedish city, Kristianstad. An inquiry including statements measuring attitudes towards the conservation of habitats, animals and plants, to the biological diversity within selected local areas, to global and national areas, and to societal issues, was replied to by 271 persons. Deciduous forests, birds and wild flowers were given highest priority. An area categorized as wetland including lakeshore meadows with a rich bird life was prioritized as most important for conservation while a forest area was chosen as best for recreation. The experts gave lower priority to arable land, urban parks, domestic animals, agricultural and garden plants and to conifer forests compared to the other groups. Knowledge about what people in general value as important could facilitate the future planning of nature areas in the city of Kristianstad.  相似文献

This paper investigates the relationship between economic growth, biodiversity loss and efforts to conserve biodiversity using a combination of panel and cross section data. If economic growth is a cause of biodiversity loss through habitat transformation and other means, then we would expect an inverse relationship. But if higher levels of income are associated with increasing real demand for biodiversity conservation, then investment to protect remaining diversity should grow and the rate of biodiversity loss should slow with growth. Initially, economic growth and biodiversity loss are examined within the framework of the environmental Kuznets hypothesis. Biodiversity is represented by predicted species richness, generated for tropical terrestrial biodiversity using a species-area relationship. The environmental Kuznets hypothesis is investigated with reference to comparison of fixed and random effects models to allow the relationship to vary for each country. It is concluded that an environmental Kuznets curve between income and rates of loss of habitat and species does not exist in this case. The role of conservation effort in addressing environmental problems is examined through state protection of land and the regulation of trade in endangered species, two important means of biodiversity conservation. This analysis shows that the extent of government environmental policy increases with economic development. We argue that, although the data are problematic, the implications of these models is that conservation effort can only ever result in a partial deceleration of biodiversity decline partly because protected areas serve multiple functions and are not necessarily designated to protect biodiversity. Nevertheless institutional and policy response components of the income biodiversity relationship are important but are not well captured through cross-country regression analysis.  相似文献

Biosphere Reserves attempt to align existing biodiversity conservation with sustainable resource use, specifically for improving socio-economic circumstances of resident communities. Typically, the Biosphere Reserve model is applied to an established landscape mosaic of existing land uses; these are often socio-ecological systems where strict environmental protection and community livelihoods are in conflict, and environmental degradation frequently accompanies “use”. This raises challenges for successful implementation of the model, as the reality of the existing land-use mosaic undermines the theoretical aspirations of the Biosphere concept. This study focuses on the Kruger to Canyons Biosphere Reserve (K2C), South Africa; a socio-ecological landscape where formal conservation is juxtaposed against extensive impoverished rural communities. We focus on land-cover changes of the existing land-use mosaic (1993–2006), specifically selected land-cover classes identified as important for biodiversity conservation and local-level resource utilization. We discuss the implications of transformation for conservation, sustainable resource-use, and K2C’s functioning as a “Biosphere Reserve”. Spatially, changes radiated outward from the settlement expanse, with little regard for the theoretical land-use zonation of the Biosphere Reserve. Settlement growth tracked transport routes, transforming cohesive areas of communal-use rangelands. Given the interdependencies between the settlement population and local environmental resources, the Impacted Vegetation class expanded accordingly, fragmenting the Intact Vegetation class, and merging rangelands. This has serious implications for sustainability of communal harvesting areas, and further transformation of intact habitat. The distribution and magnitude of Intact Vegetation losses raise concerns around connectivity and edge effects, with long-term consequences for ecological integrity of remnant habitat, and K2C’s existing network of protected areas.  相似文献

The Western Governors' Association (WGA) includes both the public lands states with their issues and the plains states, which are 98% privately owned. WGA deals with most legislation affecting biodiversity, whether the effect is direct or tangential. It will probably not be possible, or desirable, for one entity to be in charge of biodiversity conservation. The Endangered Species Act, public lands laws, agricultural laws, water law, environmental laws, and funding legislation all affect biodiversity conservation and the responsibility for it. None of them on their own are enough, and most can cause harmful unintended consequences for biodiversity. The experience of western states in developing consensus principles for reauthorization of the Endangered Species Act provides an example of common-sense ways to improve management of biodiversity, notwithstanding the complexity and large stakes involved. The WGA's proposed changes call for increasing the role of states, streamlining the act, and increasing certainty for landowners and water users. To achieve sustainable conservation for biodiversity, the better question is not “Who is/should be in charge?”, it is “How do we get this done?” To answer this, we need goals, guidance, and bottom lines from federal laws, and management and oversight at the state level, but they all need to support local on-the-ground partnerships. Sustainable conservation requires the active participation of those who live there. WGA's experience in coordinating the Great Plains Partnership as well as its work with watershed efforts shed light on what to expect. Multilevel partnerships are not easy and require a different way of doing business. The ad hoc, sitespecific processes that result do not lend themselves to being legislated, fit into organizational boxes, or scored on a budget sheet. Before planning conservation strategies, decision-makers should recognize the cultural and social aspects of the people in and around any ecosystem. This might assist effective management. The needs and problems of the habitat often fail to be taken into consideration before planning forest management. Educating and encouraging the participation of local communities, especially tribal women in conservational activities could play an important role.An attempt was made to educate the tribal women of Jambughoda Wildlife Sanctuary, Panchmahal District (Western India) about conservation of the local deciduous biodiversity. The paper narrates actions taken in the field for conserving this biodiversity, involving tribal women and children as partners of the protected areas. It might serve as an exemplary case for implementation elsewhere in the world.  相似文献

国家重点生态功能区对维护国家和区域生态安全至关重要,产业准入负面清单制度是促进区域国土空间布局优化、引导产业绿色发展的重要举措。本文分别选取了水源涵养、水土保持、防风固沙、生物多样性维护不同类型国家重点生态功能区的案例区,深入开展产业准入负面清单制定的现状分析与问题识别。结果表明:现有产业准入负面清单以限制类为主且多为现有发展产业,禁止类产业较少且多为规划发展产业,在实施过程中仍存在与主体功能定位不符、区域协调性不足、实施困难大、缺乏动态跟踪管理等四方面问题。在此基础上,结合国家有关政策要求和不同区域主导功能定位,提出水源涵养、水土保持、防风固沙、生物多样性维护四类重点生态功能区的通用性和差异性产业准入负面清单优化政策建议,为国家重点生态功能区保护与管理提供决策参考。  相似文献

Sub‐Saharan Africa continues to face the daunting challenge of alleviating poverty due to slow economic growth. In southern Africa, most countries are adopting policies that promote the integration of biodiversity conservation and rural development to contribute to rural poverty alleviation. Numerous approaches have been undertaken in this endeavour, including Transfrontier Parks (TFPs) and Transfrontier Conservation Areas (TFCAs). This paper discusses some of the limitations of the TFPs. In conclusion I posit that unlike TFPs, which are state controlled and managed, TFCAs, which promote multi‐land use and multi‐stakeholder participation are attainable and have a higher probability of sustaining biodiversity conservation and contributing to the alleviation of rural poverty, if: (i) areas of high biodiversity conservation within communal areas can be identified, zoned and leveraged to biodiversity conservation and managed in partnership between the communities and the private sector; (ii) local communities can secure legal rights to their customary land being devoted to biodiversity conservation and use such pieces of land as collateral in negotiating partnerships with the private sector in developing conservation‐based enterprises; (iii) functional community natural resource governance institutions can be established and empowered to represent their constituencies in securing fair equity from profits made from sustainable use of the conserved biodiversity assets and tourism businesses; (iv) concerted effort can be invested in developing and implementing family planning and fertility reduction strategies that would slow down human population growth to levels that can be sustained by the available natural resources; and (v) if sustainable financing mechanisms can be developed, and the governance of protected areas occurring in the TFCAs can be broadened to include other stakeholders.  相似文献

This article discusses the ecological and cultural criteria underlying the management practices for protected areas in France. It examines the evolution of French conservation from its roots in the 19th century, when it focused on the protection of scenic landscapes, to current times when the focus is on the protection of biodiversity. However, biodiversity is often socially defined and may not represent an ecologically sound objective for conservation. In particular, we question the current approach to protecting a specific type of biodiversity that is at the basis of traditional landscape but does not value systems that are left to develop naturally (i.e., without significant human intervention). We present several examples of current attempts in France and Europe to managing traditional ecosystems and then discuss the values that exist in systems that develop naturally. We feel the latter systems often have much to offer in terms of biodiversity as well as providing important sites for the study of dynamic ecological communities in an ever-changing world.  相似文献
