We address the weaknesses inherent in the social risk assessments undertaken for business, especially in the extractive industries. In contrast to the conventional approach that considers consequence to the company rather than to impacted communities, conformance with the United Nations Guiding Principles on Business and Human Rights requires that consequence to affected communities has precedence. In order for social risks to be properly assessed, we consider that: companies need to know and understand the human rights impacts of their activities; contemporary approaches to project impact and risk assessment need to be adapted to consider human rights; and environmental impact assessment (EIA) and social impact assessment (SIA) methods need to be adapted to give greater attention to impacts on human rights. Using an example from the mining, oil and gas sector, we provide a method that differentiates social risks from business risks, and we position impact assessment as an instrument that actively facilitates the improved identification, analysis and management of social risks. Practical adaptations to SIA activities and risk assessment processes are provided. Taking human rights impacts into account and using the dimensions of gravity, extent, vulnerability and remediability, we nominate criteria to assess the significance of negative social impacts.  相似文献

Using Guangzhou (Canton) as an example, this article examines major political economy problems regarding environmental impact assessment (EIA) in China: (1) difficulties for regulatory agencies to impose EIA procedures and requirements on projects that are sponsored or supported by other government agencies; (2) a lack of strong political constituencies that support environmental protection efforts; and (3) conflicts of interest created by regulatory agencies that attempt to finance their operations through providing services to the regulated for fees.  相似文献

This study applies a process of detailed assessment to summarize the potential impact of a proposed construction or other activity on the environment before implementation of an investment plan. The aim of the study was to develop a general methodology for analysis and evaluation of environmental issues connected with planned activities and proposed projects (especially buildings and engineering constructions, required implementation of environmental impact assessment process) using a risk analysis method, thus enabling the best option among the proposed activities to be chosen. The methodology was developed for conditions in Slovakia but could be arranged for any other country considering national conditions, requirements, standards and legislative. Application of the developed methodology in environmental impact assessment could create preconditions for more effective implementation of the EIA process. This paper provides a framework for the risk analysis component of the scoping phase within the EIA process. The process outlined in this paper will assist with determination of an estimation of risks to environmental and health of proposed activities.  相似文献

In the last twenty years, both the increase in academic production and the expansion of professional involvement in Environmental Impact Assessment (EIA) and Social Impact Assessment (SIA) have evidenced growing scientific and business interest in risk and impact analysis. However, this growth has not brought with it parallel progress in addressing the main shortcomings of EIA/SIA, i.e. insufficient integration of environmental and social factors into development project analyses and, in cases where the social aspects are considered, technical-methodological failings in their analysis and assessment. It is clear that these weaknesses carry with them substantial threats to the sustainability (social, environmental and economic) of projects which impact on the environment, and consequently to the local contexts where they are carried out and to the delicate balance of the global ecosystem. This paper argues that, in a sociological context of complexity and dynamism, four conceptual elements should underpin approaches to socio-environmental risk and impact assessment in development projects: a theoretical base in actor–network theory; an ethical grounding in values which are internationally recognized (though not always fulfilled in practice); a (new) epistemological-scientific base; and a methodological foundation in social participation.  相似文献

Most of the projects subject to environmental impact assessment (EIA) are closely related to climate change, as they contribute to or are affected by it. The growing certainty about climate change and its impacts makes its consideration an essential part of the EIA process, as well as in strategic environmental assessment (SEA).This paper examines how climate change (CC) has been taken into account in EIA in Spain through the analysis of 1713 environmental records of decision (RODs) of projects submitted for EIA. In 2013 Spain approved one of the most advanced laws in terms of CC consideration in environmental assessment, although it had not yet accumulated extensive practice on the issue. This contrasts with the situation of countries like Canada or the USA, which have a significant body of experience without specific legal requirements.Only 14% of the RODs analysed included references to CC, and in more than half of the cases it was a mere citation. Thermal power plants, which are subject to specific GHG regulations, show the highest consideration, while transport infrastructures, which are important contributors to CC, show a very low consideration. Almost all the references are related to their contribution to CC, while consideration of the effects of CC is minimal.The increasingly common incorporation of CC into SEA, should not imply its exclusion from EIA, because both processes have different aims and uses. Including the obligation to consider CC in the EIA regulations is highly desirable, but probably not enough without other measures, such as practical guidance, training and motivational programmes for practitioners and evaluators. But even these actions cannot ensure effective and adequate assessments of CC. Probably more resources should be spent on creating greater awareness in all the agents involved in EIA.  相似文献

Integration of environmental assessment tools has long been promoted as best practice with the potential to bring environmental benefits. In this research, we set out to evaluate the effectiveness of integration of environmental impact assessment (EIA) and mine closure planning using a simple effectiveness criteria framework, applied to current regulatory provisions and practices in Western Australia. The effectiveness criteria for the integration of EIA and mine closure planning, compiled from existing reviews of integration and effectiveness concepts in the impact assessment literature, considers procedural, transactive, substantive effectiveness and overall process legitimacy. Data analysis consisted of a literature review, examination of regulatory and guidance material and interviews with 12 experienced EIA and/or mine closure practitioners with an industry or regulatory focus. The results provide strong, positive examples of procedural, transactive and substantive effectiveness due to the integrated framework. These include behavioural changes, improved knowledge and learning and better provision for closure at an early stage of mine planning. A trajectory of improvement was noted by everybody interviewed. However, a key driver for effectiveness is the enthusiasm of key facilitations, and tension exists due to the different motivations of the two lead regulatory agencies which poses a challenge for the integrated framework. While it can reasonably be argued that the effectiveness of early mine closure planning cannot yet be realised, due to a paucity of completely closed mines in Australia this study nevertheless demonstrates clear benefits and opportunities result from early stage integration of EIA with mine closure planning.  相似文献

The effectiveness of Environmental Impact Assessment (EIA) in the transport field is increasingly being contested. Apart from technical issues (e.g., impacts measurements), the literature highlights process-related barriers as key obstacles to effective EIA implementation in transport projects (e.g., lack of collaborative work, transparency, etc.). Nevertheless, most academic efforts to date have focused on technical improvements, paying limited attention to the relevance of process-related barriers. To address this shortcoming, the paper aims to explore and compare how EIA is experienced and perceived by professionals in three South-European countries (Italy, Portugal, and Spain), providing additional insights into EIA process-related barriers in transport projects. The findings were obtained through an online survey of 294 professionals, representing two main stakeholder groups: environmental consultants and transport planners. The results reveal four main types of process problems shared in all three countries: (i) EIA timing, (ii) assessment of alternatives, (iii) monitoring system, and (iv) public participation. The highest divergences are seen in Spain, where 42% of identified process-related barriers are shared with the rest of countries, while Italian and Portuguese respondents agree in the perception of 68% of process-related barriers. The main differences between the barriers identified by transport planners and environmental consultants are related to their assessment of the need for more collaborative work between key actors. It is finally discussed the added value of this research to progress towards the homogenization of EIA processes across countries.  相似文献

Environmental Impact Assessment (EIA) incorporates environmental aspects into decision-making, but sometimes it is not effective in rejecting projects with dubious justification, significant impacts and little social utility, especially when they have political support. EIA is expected to achieve sustainable development, but without calling development into question; however, it should be able to ask the question of whether development is really necessary. Although EIA is political, as a part of the decision-making process, politicization must be limited to prevent it from becoming a mere instrument for giving an “environmental veneer” to development. Some measures thar can help avoid unjustified projects are: adopting administrative justice approach to EIA; minimising politicization of EIA agencies; improving transparency in decision-making and proportionality of EIA procedures; carrying out pre-feasibility studies; increasing the scope of SEA; allowing more than one SEA or EIA procedure for the same development throughout the planning process; strengthening the justification of the project in EIA documents; or making the scoping phase mandatory at least for major projects.  相似文献

Social Impact Assessment (SIA) has traditionally been practiced as a predictive study for the regulatory approval of major projects, however, in recent years the drivers and domain of focus for SIA have shifted. This paper details the emergence of Social Impact Management Plans (SIMPs) and undertakes an analysis of innovations in corporate and public policy that have put in place ongoing processes – assessment, management and monitoring – to better identify the nature and scope of the social impacts that might occur during implementation and to proactively respond to change across the lifecycle of developments. Four leading practice examples are analyzed. The International Finance Corporation (IFC) Performance Standards require the preparation of Environmental and Social Management Plans for all projects financed by the IFC identified as having significant environmental and social risks. Anglo American, a major resources company, has introduced a Socio-Economic Assessment Toolbox, which requires mine sites to undertake regular assessments and link these assessments with their internal management systems, monitoring activities and a Social Management Plan. In South Africa, Social and Labour Plans are submitted with an application for a mining or production right. In Queensland, Australia, Social Impact Management Plans were developed as part of an Environmental Impact Statement, which included assessment of social impacts. Collectively these initiatives, and others, are a practical realization of theoretical conceptions of SIA that include management and monitoring as core components of SIA. The paper concludes with an analysis of the implications for the practice of impact assessment including a summary of key criteria for the design and implementation of effective SIMPs.  相似文献

Knowledge and detecting impacts of human activities on the coastal ecosystem is an essential management requirement and also very important for future and proper planning of coastal areas. Moreover, documentation of these impacts can help in increasing public awareness about side effects of unsustainable practices. Analysis of multidate remote sensing data can be used as an effective tool in environmental impact assessment (EIA). Being synoptic and frequent in coverage, multidate data from Landsat and other satellites provide a reference record and bird’s eye viewing to the environmental situation of the coastal ecosystem and the associated habitats. Furthermore, integration of satellite data with field observations and background information can help in decision if a certain activity has caused deterioration to a specific habitat or not. The present paper is an attempt to utilize remote sensing data for assessment impacts of some human activities on the major sensitive habitats of the NW Egyptian Red Sea coastal zone, definitely between Ras Gemsha and Safaga. Through multidate change analysis of Landsat data (TM & ETM+ sensors), it was possible to depict some of the human infringements in the area and to provide, in some cases, exclusive evidences for the damaging effect of some developmental activities.  相似文献

Citizen participation should ideally occur as early as possible in a project, especially throughout the course of the Environmental Impact Assessment (EIA) study. In Chile, participation occurs after the EIA study has been completed and presented to authorities for evaluation. However, voluntary early participation has become an extended practice in large mining projects for financial and conflict-reduction reasons. The purpose of this study was to explore a variety of these early participation processes happening in large mining projects from 2001 to 2010 and analyze how well these practices measured up to standards and objectives defined in the EIA and participation literature. Beyond the legal implications of such practice, we sought to understand the role of this voluntary procedure within the EIA process and citizen engagement in projects. We found a wide range of objectives, approaches and results, primarily driven to facilitate approval and implementation of the ten projects analyzed. The underlying objective of voluntary participation processes analyzed (whether it seeks to inform, to note or to engage), determined the information presented, participants included, area of influence considered, time devoted to the process and influence of the information collected on EIA and project mitigation measures. Few of the principles for best practice in the literature were present in the ten projects examined. Moreover, given the voluntary and unregulated nature of these processes, purposes and outcomes were often mixed-up with the Indigenous Consultation required under ILO provision 169, or Corporate Social Responsibility programs. This finally revealed that contrary to expectations, an unregulated and early voluntary participation is not having a clear impact in the definition of projects mitigation measures, participants are at risk of being unsatisfied with the resulting agreements and moreover, it does not assure projects implementation or the avoidance of socio-environmental conflict.  相似文献

Pressures are mounting for the simplification of environmental impact assessment (EIA). This phenomenon is drawing increasing scholarly attention, but studies have not gone far beyond speculating what could happen as a result of recently implemented or proposed regulatory changes. This paper takes a more longitudinal look at simplified EIAs. The main objective was to analyze the perceived outcomes of a number of simplified EIA processes, using Brazil as the empirical context. More specifically, this paper aimed at understanding: 1) how simplified EIAs have been conceptualized and implemented in southeastern Brazil; and 2) how developers and civil servants in that region perceive the outcomes of simplified EIAs. This study adopted a sequential mixed method research approach. Data was collected through literature reviews, 261 telephone-based interviews and 10 face-to-face interviews. Degrees of EIA simplification can vary significantly within and across jurisdictions. In any case, simplification is often framed as a win-win solution to EIA ineffectiveness, through which regulatory and procedural changes are made to ease the process, while, at the same time, maintaining or providing better environmental protection. This approach is more frequently applied to potentially low-impact processes. Chi-square tests of the data collected through telephone interviews in the Brazilian state of Minas Gerais indicated that developers tend to perceive EIA processes as difficult and slow regardless of how simplified it is. Most civil servants, who were directly involved in the implementation of simplified EIAs in state environmental agencies, argued that simplified EIAs are driven mostly by environmental agencies, as these institutions have long been unable to cope with an ever-increasing load of license applications. Policy outcomes of simplified EIAs in the territory are not sufficiently monitored by state agencies. Civil servants revealed concerns about the potential long term effects of EIA simplification on the ground, as they have had limited resources for audits and inspections.  相似文献

This research is an attempt to verify the notion postulated by Robert Bartlett and Lynton Caldwell that the full benefits of environmental impact assessment (EIA) would take decades to be realized. While EIA is intended to directly influence decision-making regarding new development proposals, the process is also expected to lead to organisational learning and transformation over time. Our aim was to examine the influence of EIA on a single Western Australian proponent with sustained experience in the process to understand how EIA is used within the organisation and to seek evidence of transformation of the organisation's purpose and mission. The research reviewed literature in order to identify key influences of EIA on organisations, along with semi-structured staff interviews and document analysis for the case study organisation. Ascertaining causality that involvement in EIA processes influences or effects organisational learning and transformation is a challenge in the face of other societal events. Document analysis and interviewee data indicates that the action-forcing nature of EIA did influence proponent behavior through the creation of internal processes seeking to ensure robust design of new projects that would satisfy environmental protection expectations, without the need to trigger formal EIA. Evidence of EIA values and thinking were apparent within internal documentation, including the evolving mission statement. Our research indicates that participation in the EIA process can positively influence organisational learning and transformation by guiding internal change for decision-making.  相似文献

Environmental impact assessment (EIA) processes are grounded on the assumption that producing information about environmental impacts will yield better environmental decisions. Despite the ubiquity of EIA as a policy tool, there is scant evidence of its environmental, social, or economic impacts. Focusing on Environmental Impact Statements (EIS) prepared for water and energy-related projects under the US National Environmental Policy Act, this analysis addresses two questions: (1) What is the balance of environmental impacts associated with infrastructure decisions?; and (2) How does the content of stakeholder feedback received during the review phase differ from draft EIS content, and does this correspond to any changes in the final EIS? We demonstrate the use of automated text mining approaches to identify the distribution of impacts, measure the content of public comments, and observe whether values reflected in comments are associated with a shift in emphases between the draft and final EIS. EISs are shown to convey evenly distributed focus across multiple impact areas. However, we observe no substantive change in focal emphasis between draft and final issuances. This calls into question assumptions about the role that public participation plays in bringing new information to light or changing the course of action.  相似文献

The concept of vulnerability has been used to describe the susceptibility of physical, biotic, and social systems to harm or hazard. In this sense, it is a tool that reduces the uncertainties of Environmental Impact Assessment (EIA) since it does not depend exclusively on the value assessments of the evaluator, but rather is based on the environmental state indicators of the site where the projects or activities are being carried out. The concept of vulnerability thus reduces the possibility that evaluators will subjectively interpret results, and be influenced by outside interests and pressures during projects. However, up until now, EIA has been hindered by a lack of effective methods. This research study analyzes the concept of vulnerability, defines Vulnerability Importance and proposes its inclusion in qualitative EIA methodology. The method used to quantify Vulnerability Importance is based on a set of environmental factors and indicators that provide a comprehensive overview of the environmental state. The results obtained in Colombia highlight the usefulness and objectivity of this method since there is a direct relation between this value and the environmental state of the departments analyzed.  相似文献

Environmental impact assessments (EIAs) effectiveness and accessibility by the public is determined by local environmental enforcement and regulation. Massive energy infrastructure projects like China's Belt and Road initiative (BRI) could accentuate social and economic costs, as regulation is deferred to host countries with varying levels of domestic enforcement. To fill major gaps in the public evaluation of EIA practices and results, our objective here is to present an open-source approach for evaluating localized air pollution health impacts for BRI-financed coal-fired power plants. This analysis focuses on one specific problem, additional attributable mortality from stroke, ischemic heart disease, and chronic obstructive pulmonary disease for adults ages 25–84 from fine particulate matter (PM2.5), known to be major risk factor for premature deaths globally. As a concrete example, we examine the case of the Port Qasim power plant located near Karachi, Sindh Province, Pakistan. We present results for two main scenarios: a base case, assuming fully operational pollution control technologies, in particular electrostatic precipitators (ESP); and an alternative case without ESPs. All material and methods for replicating this analysis for the case study and for other projects are available in our institutional open repository. Environmental risk refers to the possibility of environmental pollution events caused by natural causes or human activities. Environmental risks are transmitted through environmental media and can have destructive effects on human society and the natural environment. Understanding the current status and characteristics of environmental risks can effectively prevent and control environmental risks, which is essential for establishing the safety of ecological systems. Although many scholars have studied the environmental risk characteristics of different enterprises or regional scales and proposed corresponding control methods. However, the study of environmental risk characteristics in the national scale is still insufficient, which affects the accuracy of large-scale environmental impact assessment (EIA) and is not conducive to the formulation of the large-scale environmental management system. This paper attempts to use spatial statistical methods and geographically weighted regression (GWR) models to study the temporal and spatial evolution trends of environmental events in China and the spatial correlation characteristics of influencing factors and environmental events in different regions. The research results show that the focus of China's environmental risk is continuously shifting. At present, environmental pollution incidents are concentrated in the western region, and their spatial correlation with influencing factors varies from region to region. Spatial statistical analysis can help us understand the spatial characteristics of risk and identify the interrelationships of environmental risks in different areas. Therefore, spatial statistical analysis can provide a scientific basis for macro decision-making of large regional EIA and environmental risk management. In the future, it is recommended that the focus of environmental events in different regions should be different to reduce the risk of environmental events in China.  相似文献

The use of economic valuation methods to assess environmental impacts of projects and policies has grown considerably in recent years. However, environmental valuation appears to have developed independently of regulations and practice of environmental impact assessment (EIA), despite its potential benefits to the EIA process. Environmental valuation may be useful in judging significance of impacts, determining mitigation level, comparing alternatives and generally enabling a more objective analysis of tradeoffs. In China, laws and regulations require the use of environmental valuation in EIA, but current practice lags far behind. This paper assesses the problems and prospects of introducing environmental valuation into the EIA process in China. We conduct four case studies of environmental economic impact assessment (EEIA), three of which are based on environmental impact statements of construction projects (a power plant, a wastewater treatment plant and a road construction project) and one for a regional pollution problem (wastewater irrigation). The paper demonstrates the potential usefulness of environmental valuation but also discusses several challenges to the introduction and wider use of EEIA, many of which are likely to be of relevance far beyond the Chinese context. The paper closes with suggesting some initial core elements of an EEIA guideline.  相似文献

Project-level impact assessment was originally conceived as a snapshot taken in advance of project implementation, contrasting current conditions with a likely future scenario involving a variety of predicted impacts. Current best practice guidance has encouraged a shift towards longitudinal assessments from the pre-project stage through the implementation and operating phases. Experience and study show, however, that assessment of infrastructure-intensive projects rarely endures past the project's construction phase. Negative consequences for environmental, social and health outcomes have been documented. Such consequences clarify the pressing need for longitudinal assessment in each of these domains, with human rights impact assessment (HRIA) as an umbrella over, and critical augmentation of, environmental, social and health assessments. Project impacts on human rights are more closely linked to political, economic and other factors beyond immediate effects of a company's policy and action throughout the project lifecycle. Delineating these processes requires an adequate framework, with strategies for collecting longitudinal data, protocols that provide core information for impact assessment and guidance for adaptive mitigation strategies as project-related effects change over time. This article presents general principles for the design and implementation of sustained, longitudinal HRIA, based on experience assessing and responding to human rights impact in a uranium mining project in Malawi. The case study demonstrates the value of longitudinal assessment both for limiting corporate risk and improving human welfare.  相似文献
