中国省级土壤污染防治立法实践及建议

《土壤污染防治法》的出台填补了中国土壤污染防治方面的法律空白。自《土壤污染防治法》出台后,部分省份开始积极探索省级法规的出台。在对天津市、山西省、山东省、广东省出台的相关条例或办法进行梳理的基础上发现,各地立法在细化内容、提高可操作性、突出地方特色等方面进行了尝试,但也存在与现有管理制度不衔接、部分条款落实难度大、部分制度仍缺乏可操作性等不足,提出应加强立法前期工作、明确问题导向和依托经验、加快配套政策制定等建议,为其他省份土壤污染防治立法提供参考。

Countermeasures and suggestions on the formulation of provincial regulations on the prevention and control of soil pollution in China

The promulgation of"Law on the prevention and control of soil pollution"has filled the legal gap in soil pollution prevention and control in China.Since the introduction of this law,some provinces have been preparing the introduction of local matched regulations.The regulations of Tianjin,Shanxi,Shandong and Guangdong refined content,improved operability,and outstanded regional characteristics.At the same time,there were some deficiencies such as lack of connection with the existing management system,difficulty in implementing some requirements,and lack of operability for some policies.It was suggested to make enough preparation for legislation,rely on problems and experiences,and accelerate the development of supporting policies.The analyses and viewpoints would provide meaningful references for other provinces on the legislation of prevention and control of soil pollution.
