关于环境行政处罚的强制执行

《中华人民共和国行政处罚法》规定当事人逾期不履行行政处罚，行政机关可以依法实施强制执行。行政处罚的强制执行分为行政强制执行和司法强制执行，两者在执行的条件、程序等方面存在着许多不同。由于环境保护行政主管部门实施行政处罚强制执行必须拥有行政强制执行权，而行政复议和行政诉讼期间环境行政处罚实际上的停止执行会带来一些负面效应，因此建议适应赋予环境保护行政主管部门一定的行政强制执行权。

Enforcement of Environmentally Administrative Punishment

Administrative Punishment Act of People's Republic of China stipulated that administration could enforce the litigants to perform the regulation if admlnlstrative punishment was not performed beyond the time limit. The enforcement of administrative punishment was divided into two sections,administrative enforcement and judicial enforcement. The condition and procedure of them were different. Because environmental administration must possess enforcement right when implementing enforcement of administrative punishment, in the time of reconsideration and litigation, stopping implementing enforement of environmental administrative punishment would bring negative influence. So, administration must be given a certain enforcement right.
