Research on the Preliminary Procedures of Environmental Administrative Public Interest Litigation

The pre-litigation procedure and the litigation procedure are independent of each other and closely linked,which play a role of supervision and filtering in public interest litigation cases.However,public interest litigation in China is still in the early stage of development,and many shortcomings in the practice of preliminary procedures for administrative public interest litigation are gradually exposed:the source of clues in the case is too single,the performance standards of administrative agencies are not clear,and the relevant provisions suggested by procurators are not perfect.This article took the pre-litigation procedure in the administrative public interest litigation system as the research object,through combing the relevant legal provisions and combining with its practice,discussed the existing problems in the pre-litigation procedure of environmental administrative public interest litigation,and put forward targeted suggestions to improve it.Faced with the deficiencies gradually revealed in the prelitigation procedures of environmental administrative public interest litigation,we need to further improve the relevant provisions recommended by the procurator,encourage public participation,set up flexible performance periods,and clarify the performance standards of administrative agencies,so as to maximize the role of pre-litigation procedures in environmental ecological protection.
