| 摘 要： | 公众参与环境影响评价制度正是基于传统环境程序法对环境问题复杂性和风险性的应对不足而兴起的。我国2002年颁布的《中华人民共和国环境影响评价法》虽然对公众参与的规定较之此前有了实质性的进展,但在公众参与环境影响评价的制度建设方面尚存在着立法及具体操作层面上的诸多缺陷。这些将大大弱化了公众参与环境影响评价的实效,也制约着环境影响评价制度中公众参与机制的形成。据此,研究我国环境评价中公众参与的程度,能够直接的反应我国环境影响评价的发展程度。
