| 摘 要： | 人文主义是一种文艺复兴后产生的古老思潮,简而言之,不过是强调人是世界的中心的主张,是对中世纪以神为中心的世界观的否定,它是第一次法典编纂运动的思想基础之一。人文主义认为人是世界的唯一中心,强调征服自然;在历史的发展中,人文主义逐渐被新人文主义所取代。新人文主义认识到人与环境的依赖关系以及与其他生灵的伙伴关系,强调人与自然的和谐,尊重下一代人的权利、动物的权利等。文章从人文主义历史内涵的演进及其新发展入手,分析和解读了法国环境法中的新人文主义精神,认为以生态人文主义为代表的新人文主义作为我国环境法的基本理念是历史发展的必要选择。

| Abstract: | In the social development, humanism was gradually replaced by new humanism as harmonious relationships of human and nature was established in the new humanism.From the aspect of evolvement and development of historical connotation of humanism, new humanism in French environment law was analyzed and interpreted.It was found that new humanism which represented with ecological humanism as basic theory of environment law in China is the necessary selection of historical development. |
