| 摘 要： | 基层环保行政部门在处理因环境污染引起的纠纷时，常常因处理决定有方式不同，导致环保部门可能成为被当事人提起诉讼的被告。环保部门是否应成为被告，应结合就其对污染纠纷所作出的具体处理决定来分析。

| Abstract: | For the different way of the result of handling,it would cause environment protecting unit become the defendant as the party go to law when the basic unit of environment protecting handles the dispute caused by environmental pollution.It should combine with the specific result of handling for the dispute of environmental pollution to analyze whether the unit should be the defendant. |
