| 摘 要： | 在我国实施“依法治国”的基本方略有其理论与实践基础。新中国的法治发展历程表明：重“人治”轻“法治”：将法律作为政治的附属物；重国家轻个人，重义务轻权利；重实体轻程序，必将导致法治的失败。因此，要实现“依法治国”的基本方略，必须要高度重视法治建设，重视市场经济和民主政治的发展，重视政治的民主化，重视法律的控权作用，重视程序在法治建设中的作用，重视保障公民权利。
