| 摘 要： | 我国刑法典首次对环境犯罪作了系统、具体的规定。污染环境类犯罪的犯罪构成，其主体多为单位，主观方面表现为过失；其客体是一种复杂客体，不仅涉及到财产权、环境权，还涉及到人身权，客观方面则往往把一定的危害后果作为犯罪构成的必要条件，在因果关系的认定上适用“推定原则”。

| Abstract: | Environmental Crime was firstly stipulated in Penal Code of our country systematically.For the construction of Crime of Environmental Pollution,its subject was mainly organizations,subjective fact represented fault,its object was a kind of complex object,concerned in property right,environmental right and human right,and objective fact considered the criminal result as the necessary condition for criminal construction. |
