The Clean Air Act (CAA) Amendments of 1990 was signed into law by President Bush on November 15, 1990. These amendments potentially will have a major impact on virtually every industrial and many commercial facilities throughout the country. The regulations developed to implement this legislation will encompass new approaches to nonattainment, air toxics, accidental releases, acid rain, permits and enforcement. Because of the impact of this legislation the regulations will be implemented over a ten-year period. This paper is an overview of the amendments and recommended proactive strategies for industry.  相似文献

Abstract

This report discusses the responsibilities of government for the legislation of pesticides, and describes the impact of various statutes on the use of pesticides in agriculture. Governmental responsibilities for management of the economy, education, and enactment of laws and regulations are discussed, and the history of U.S. legislation of pesticides and related substances is presented. Recent proposed Internal Revenue Service regulations, published on June 5, 1971 and implementing Section 103 (c) of the Internal Revenue Service Code, provide additional methods for financing pollution control equipment in unlimited amounts through the use of tax-exempt industrial development revenue bonds. Interest income on the bonds is exempt to the recipient from federal income tax under existing statutes and court decisions, except that such exemption is not generally available with respect to any bonds for any period during which the bond is held by a person who is a substantial user of a project financed with the proceeds of the bonds or a related person within the meaning of Section 103 (c) (7) of the Code. These proposed regulations implement the 1968 amendments to the Internal Revenue Code which authorize the issuance of tax-exempt bonds by local governmental agencies for pollution control improvements. The Legislature of Florida has recently enacted the Florida Industrial Development Financing Act, which creates the local governmental agencies contemplated by the federal legislation and significantly enlarges the power of local governmental agencies to issue industrial development bonds for pollution control.  相似文献

The 1990 Clean Air Act Amendments added a new Title V to the Act which establishes an operating permit program for numerous sources of air pollution. Certain sources are currently required to obtain a construction or “new source review” permit; the 1990 Amendments will require many more sources to apply for a permit which will give them permission to operate. CAA Title V was modeled on the National Pollutant Discharge Elimination System (NPDES) permit provisions of the Clean Water Act, but there are important differences between the two statutes.

Although many states already have their own operating permit programs, by late 1993 every state must establish a program that meets the requirements of Title V and EPA’s implementing regulations. EPA recently proposed these regulations, and by the statutory deadline of November 15, 1991 hopes to issue final regulations establishing the minimum elements of state operating permit programs. These regulations will significantly affect implementation of air pollution measures for years to come because a Title V operating permit will have to assure compliance with all applicable CAA requirements. In addition, permitted sources will be required to pay fees to cover the costs of the permit program.  相似文献

The impact of gaseous exhaust emissions is determined for the following categories of mobile sources which are currently not covered by national emission regulations: 1) farm equipment, 2) merchant vessels, 3) locomotives, 4) lawn and garden implements, 5) snowmobiles, 6) outboard motors, 7) transport refrigeration units, and 8) helicopters. Mass emission rates of each category are tabulated and compared to other emissions from both mobile and stationary sources in selected Air Quality Control Regions. Also, projections are made as to the expected increase of emissions from each source category through 1990. The results show that in the near future some categories of mobile sources will be contributing substantial amounts of pollutants, on a mass basis, in regions with critical air pollution problems. As stricter emission standards on regulated sources continue to be implemented, the relative significance of these unregulated sources will increase. The major conclusion is that broad generalizations as to the amounts of air pollution contributed by these unregulated mobile sources nationwide may be grossly misleading. The only effective way to assess their impact is on a region-by-region basis. To this end, generalized computer programs are developed which permit the estimation of each category’s present and future mass emission rates in any Air Quality Control Region in the country  相似文献

The Chinese government at the highest levels continues to stress the importance of environmental protection. The environmental consequences of rapid industrialisation and a burgeoning population are now unavoidable to citizens and government ministers alike. Among the major challenges for environmental protection and health and safety regulations in China are improving the transparency of government bodies and statistics, encouraging horizontal and vertical coordination on regulation and projects between and within ministries, ensuring economic viability of both municipal and commercial sector environmental protection projects, and enforcing ever-strengthening regulations. Government officials at all levels will no doubt feel pressure to advance new legislation while maintaining a high level of GDP growth, which invariably will place a priority on development and not on environmental, health and safety issues. Given the increasingly precarious economic conditions and ongoing reform of state-owned enterprises, it may be difficult for the Chinese government to follow through on high-minded efforts. This paper discusses the changing regulatory framework, likely enforcement inequities and implications for multinationals seeking to comply.  相似文献

Remediation strategies using soil amendments should consider the time dependence of metal availability to identify amendments that can sustainably reduce available pollutant concentrations over time. Drying-wetting cycles were applied on amendments, soils and soil + amendment mixtures, to mimic ageing at field level and investigate its effect on extractable Cd, Cu, Ni, Pb and Zn concentrations from three contaminated soils. The amendments investigated were municipal waste organic compost and biochars. The amendments, soils and mixtures were characterised by their physicochemical properties at different ageing times. The amendments were also characterised in terms of sorption capacity for Cd and Cu. The sorption capacity and the physicochemical properties of the amendments remained constant over the period examined. When mixed with the soils, amendments, especially the compost, immediately reduced the extractable metals in the soils with low pH and acid neutralisation capacity, due to the increase in pH and buffering capacity of the mixtures. The amendments had a relatively minor impact on the metal availability concentrations for the soil with substantially high acid neutralisation capacity. The most important changes in extractable metal concentrations were observed at the beginning of the experiments, ageing having a minor effect on metal concentrations when compared with the initial effect of amendments.

Environmental legislation is developing rapidly. In addition, considerable attention is being given to the environmental impact of new technological developments. Governments as well as citizens, often through organized groups are placing unprecedented pressures on many industries and even on other parts of the government. Popular feeling has been extremely strong on such matters and resistance so far has not been strong. This is likely to change substantially and the future may see a rapid increase in the number of environmental suits especially if the continued existence of certain industries is threatened. Expert evidence will be needed to support government legislation and to support actions to preserve the environment. Such measures will have inevitable economic implications and will evoke predictable responses. Reconciling these viewpoints will provide a challenge for the community which will probably depend to a larger extent on interpretation in courts of -law. The ability of various experts to give advice through the legal process will be essential if the most effective compromises are to be found. It is the purpose of this paper to discuss the gathering and use of such scientific evidence in environmental lawsuits.  相似文献

The recognition of potential long-term effects of substances, has led to the development of regulations and legislation which emphasis the need for assessing the risks posed by both new and existing substances for man and the environment. The evaluation of fate and exposure models is put into perspective in relation to the developments over the last five years in the framework of the EU regulations and national legislation within the European Community. The validation of environmental exposure models (multi-media models) is described in the context of quality assurance of models available to a user group, which is different from the quality assurance aspects for a developers group.  相似文献

The European emissions of BC and OC in fine particles are calculated for the years 1990, 1995 and 2000 applying the RAINS model that, beyond fuel-sector distinction, explicitly includes various combustion technologies and the penetration of abatement options. The emission factors used are developed considering specific European conditions. The main sources of carbonaceous aerosols in Europe are emissions from traffic and residential combustion of solid fuels. Between 1990 and 2000, the BC and OC emissions are estimated to decline from 0.89 to 0.68 Tg and from 1.4 to 1.0 Tg, respectively. Most of the reduction occurred in the early 1990s in Eastern Europe owing to structural changes that resulted in energy efficiency improvements in industry and lower consumption of solid fuels in residential–commercial sector; the latter having strong impact on BC and OC emissions. Furthermore, the growth in transport volumes, and expected increase in emissions, was offset by introduction of stricter legislation for road transport from 1995. Focusing on the most important sectors, transport and residential combustion, the variation in measured carbonaceous emission shares and its impact on total emissions was evaluated. This analysis indicates a range of about −25% to +20% for BC and −7% and +15% for OC, compared to the central case.  相似文献

Losses of phosphorus (P) from soil and slurry during episodic rainfall events can contribute to eutrophication of surface water. However, chemical amendments have the potential to decrease P and suspended solids (SS) losses from land application of slurry. Current legislation attempts to avoid losses to a water body by prohibiting slurry spreading when heavy rainfall is forecast within 48 h. Therefore, in some climatic regions, slurry spreading opportunities may be limited. The current study examined the impact of three time intervals (TIs; 12, 24 and 48 h) between pig slurry application and simulated rainfall with an intensity of 11.0?±?0.59 mm h?1. Intact grassed soil samples, 1 m long, 0.225 m wide and 0.05 m deep, were placed in runoff boxes and pig slurry or amended pig slurry was applied to the soil surface. The amendments examined were: (1) commercial-grade liquid alum (8 % Al2O3) applied at a rate of 0.88:1 [Al/ total phosphorus (TP)], (2) commercial-grade liquid ferric chloride (38 % FeCl3) applied at a rate of 0.89:1 [Fe/TP] and (3) commercial-grade liquid poly-aluminium chloride (10 % Al2O3) applied at a rate of 0.72:1 [Al/TP]. Results showed that an increased TI between slurry application and rainfall led to decreased P and SS losses in runoff, confirming that the prohibition of land-spreading slurry if heavy rain is forecast in the next 48 h is justified. Averaged over the three TIs, the addition of amendment reduced all types of P losses to concentrations significantly different (p?<?0.05) to those from unamended slurry, with no significant difference between treatments. Losses from amended slurry with a TI of 12 h were less than from unamended slurry with a TI of 48 h, indicating that chemical amendment of slurry may be more effective at ameliorating P loss in runoff than current TI-based legislation. Due to the high cost of amendments, their incorporation into existing management practices can only be justified on a targeted basis where inherent soil characteristics deem their usage suitable to receive amended slurry.  相似文献

In May of 1990 the U.S. Environmental Protection Agency (EPA) completed a four year long series of rulemakings on land disposal of over. 450 hazardous wastes regulated under the Resource Conservation and Recovery Act (RCRA). The new regulations stipulate that hazardous wastes may not be disposed of on land—if at all—unless they are first treated in a prescribed manner. The Land Disposal Regulations (LDRs) will change disposal requirements for approximately 41 million tons of hazardous waste annually, at a cost to the regulated community of over a billion dollars. Despite EPA’s efforts to educate industry, the LDRs remain a source of confusion for many. This article is intended to clear up at least some of the confusion by providing an overview of the regulations and the decision-making processes which occurred during the four years of EPA rulemakings and, more recently, in the courts.  相似文献

A notable feature is the role of local government, which remains dominant despite expanding legislation and the increasing technical complexity of waste management. The private sector has long had a major role in the transporting and disposal of hazardous waste. The Environmental Protection Act of 1990 represented a major revision of UK environmental legislation. The pace and direction of electrostatic precipitator (ESP) technology evolution in the United States will be governed by two key forces. The first is new clean air legislation passed by the U.S. Congress and signed by President Bush on November 15,1990. This law requires electric utilities to further reduce SO2 and NOx emissions, which may impact particulate controls. In addition, very fine (< 10 micron) participates and potentially toxic trace emissions from utility power plants may be regulated. The second major factor is the expected upsurge in new plant construction beginning in the late 1990s. Together, these forces should define the performance requirements and market for new ESPs.

This paper identifies and briefly describes technologies that the Electric Power Research Institute (EPRI) is developing to help U.S. utilities meet these challenges cost-effectively. Among the technologies addressed are: advanced digital voltage controls, flue gas conditioning, intermittent energization, temperature-controlledprecharging (i.e., two-stage ESP), wide plate spacing, positive energization of corona electrodes for hot-side ESPs, and integration of conventional ESPs with pulse-jet baghouses.  相似文献

The national Environmental Protection Agency is expected to issue its recommendations on noise legislation some time during the latter part of 1973. This agency will assume primary responsibility for enforcing noise limits on new products, such as vehicles, construction equipment, electrical equipment, etc. Primary responsibility for community noise control will remain with local governments. Local EPA’s, now involved in air and water pollution, will be given the additional responsibility to enforce anti-noise legislation.This legislation will cover noise emissions fromvehicles, industries, construction equipment, residential air conditioners, and power equipment, and the noises that pervade multifamily dwellings. Responsibility for controlling aircraft noise will be shared with the FAA.

The noise ratings used in this legislation must be capable of easy measurement and yet correlate well with subjective response. For most noises the decibel level read on the A-scale of a sound level meter (dBA) is adequate. For aircraft noise a more complex rating scale must be used which includes consideration of the duration of the noise and the presence of a pure tone (engine whine). For still other noises (industries, construction) some consideration must be given to the total daily exposure time of the noise, along with its dBA rating.

New community noise ordinances will draw on the research and experience associated with the present Chicago, III., ordinance. Some modifications of this ordinance are expected, however, to improve enforcement procedures and to lower vehicle noise levels, which are considered the worst of all the community noise pollutants.  相似文献

Manure-based soil amendments (herein “amendments”) are important fertility sources, but differences among amendment types and management can significantly affect their nutrient value and environmental impacts. A 6-month in situ decomposition experiment was conducted to determine how protection from wintertime rainfall affected nutrient losses and greenhouse gas (GHG) emissions in poultry (broiler chicken and turkey) and horse amendments. Changes in total nutrient concentration were measured every 3 months, changes in ammonium (NH4+) and nitrate (NO3?) concentrations every month, and GHG emissions of carbon dioxide (CO2), methane (CH4), and nitrous oxide (N2O) every 7–14 days. Poultry amendments maintained higher nutrient concentrations (except for K), higher emissions of CO2 and N2O, and lower CH4 emissions than horse amendments. Exposing amendments to rainfall increased total N and NH4+ losses in poultry amendments, P losses in turkey and horse amendments, and K losses and cumulative N2O emissions for all amendments. However, it did not affect CO2 or CH4 emissions. Overall, rainfall exposure would decrease total N inputs by 37% (horse), 59% (broiler chicken), or 74% (turkey) for a given application rate (wet weight basis) after 6 months of decomposition, with similar losses for NH4+ (69–96%), P (41–73%), and K (91–97%). This study confirms the benefits of facilities protected from rainfall to reduce nutrient losses and GHG emissions during amendment decomposition.

Implications: The impact of rainfall protection on nutrient losses and GHG emissions was monitored during the decomposition of broiler chicken, turkey, and horse manure-based soil amendments. Amendments exposed to rainfall had large ammonium and potassium losses, resulting in a 37–74% decrease in N inputs when compared with amendments protected from rainfall. Nitrous oxide emissions were also higher with rainfall exposure, although it had no effect on carbon dioxide and methane emissions. Overall, this work highlights the benefits of rainfall protection during amendment decomposition to reduce nutrient losses and GHG emissions.  相似文献

To reduce atmospheric deposition, in 1990 Congress passed amendments to the Clean Air Act requiring electric utility power plants to decrease emissions of sulfur dioxide and nitrogen oxides, with Phase I beginning in 1995. We analyzed precipitation volume, wet deposition, and concentration of the sum of base cations measured at 12 National Atmospheric Deposition Program sites in Massachusetts, New Hampshire, New York, and Vermont. We compared five-year means prior to and following passage of the amendments and for five years after the implementation of Phase I. Whereas only one of the monitoring stations recorded a decline in base cation deposition, three sites out of the 12 showed a decline in base cation concentration. None of the sites exhibited a significant change in precipitation volume. Continued deposition of base cations may help to reduce the detrimental effects of acidic deposition.  相似文献

Organic soil amendments can be useful for improving degraded soil, but this increase in organic matter (OM) may influence adsorption of herbicides subsequently applied to the treated soil, even though the particle size of amendments and their nature differ from typical soil OM. In this study, a batch equilibrium method was used to measure adsorption of five herbicides following application to two organic media, wood pulp and sawdust, comparing these with two cropping soils. Herbicide adsorption, quantified by distribution coefficients (kd), was much higher in the two organic media than in the cropping soils. The increases in adsorption were strongly correlated to the percentage of organic carbon. When the kd was normalized to adsorption coefficients corrected for OM content (koc), variation in results between the media was greatly reduced, indicating that OM is an important factor influencing adsorption in these media. The results of this study suggest that herbicides will be less effective when applied to soils in which sawdust and wood pulp have been added. Using organic amendments to remediate soil will increase adsorption of pesticides, reducing their bio-availability and efficacy, but also reducing their tendency to leach into root zones of deep-rooted crops and into groundwater.  相似文献
