Neither Canada nor the United States attach much importance to the International Joint Commission (IJC) judging by the size of staffs and annual budgets. The Commission has been restricted to a relatively minor number of functions in the Great Lakes-St. Lawrence. It has investigated: the degree and causes of water and air quality deterioration; the effects of hydroelectric and navigation projects on water levels; the impacts of water-level fluctuations; and the feasibility of a deep waterway from the St. Lawrence to the Hudson River. Projects approved by the Commission have produced less than might be expected through no fault of the Commission. The Great Lakes Fishery Commission has promoted little international management. Budgetary limitations restrict its lamprey control program; institutional limitations restrict its ability to deal effectively with fishery problems. Commission responsibilities are limited to coordination and advisory functions. Since Canada and the United States have not chosen to refer most aspects of river basin management to international bodies, an institutional void exists in the Great Lakes Basin to consider these questions on a continuous basis. / A method adapted from the National Weather Service's Extended Streamflow Prediction technique is applied retrospectively to three Great Lakes case studies to show how risk assessment using probabilistic monthly water level forecasts could have contributed to the decision-mak-ing process. The first case study examines the 1985 International Joint Commission (IJC) decision to store water in Lake Superior to reduce high levels on the downstream lakes. Probabilistic forecasts are generated for Lake Superior and Lakes Michigan-Huron and used with riparian inundation value functions to assess the relative impacts of the IJC's decision on riparian interests for both lakes. The second case study evaluates the risk of flooding at Milwaukee, Wisconsin, and the need to implement flood-control projects if Lake Michigan levels were to continue to rise above the October 1986 record. The third case study quantifies the risks of impaired municipal water works operation during the 1964-1965 period of extreme low water levels on Lakes Huron, St. Clair, Erie, and Ontario. The International Joint Commission's Water Quality Board has identified 42 Areas of Concern in the Great Lakes ecosystem where Great Lakes Water Quality Agreement objectives or jurisdictional standards, criteria or guidelines, established to protect uses, have been exceeded and remedial actions are necessary to restore beneficial uses. As a result of the 1985 report of the Water Quality Board, the eight Great Lakes states and the Province of Ontario committed themselves to developing a remedial action plan (RAP) to restore all uses in each Area of Concern within their political boundaries. Each RAP must identify the specific measures necessary to control existing sources of pollution, abate existing contamination (e.g., contaminated sediments), and restore all beneficial uses. Points which must be explicitly addressed in each RAP include: geographic extent of problem, beneficial uses impaired, causes of problems, remedial measures and a schedule for implementation, responsible agencies, and surveillance and monitoring activities that will be used to track effectiveness of remedial actions. The jurisdictions are responsible for developing RAPs, and the International Joint Commission is responsible for evaluating the adequacy of each RAP and tracking progress in restoring beneficial uses.  相似文献

ABSTRACT. The critical role of political processes in water resource projects has recently been placed in a new perspective [Hall, 1970]. The “political hassle” period of institutional interaction which serves to resolve political conflicts over such aspects as organizational growth and survival, responsibility for economic liabilities, and responsibility for economic benefits, requires systematic analysis in order to improve our capability to implement water projects. Failure to properly assess the political aspects of a proposed water project may result in extensive delays with significant economic losses. The complexities associated with water use and re-use have created the need for new institutional arrangements which can more effectively function to implement policies and programs. One tool which has recently become available for the research investigator concerned with institutional interactions and political processes associated with water resource projects is the technique of computer simulation of such institutional interaction. In theory, this new approach will enable the investigator to assess the political feasibility or political acceptability of a proposed water project given existing institutional structures. Furthermore, the investigator has the opportunity to experiment with new and innovative institutional arrangements which may in turn enhance the political acceptability of a proposed project. The specific material presented within this paper reports upon the validation of an existing computer simulation model designed to replicate political interactions in resource allocation problems-including water resource problems. This validation effort is done by taking an actual water problem and comparing what the political simulation models predicts in terms of political outcomes with what actually takes place. United States-Mexican transboundary water resources management is presently experiencing significant reform resulting from long-term demographic processes in the border region and greater economic integration. The recently concluded North American Free Trade Agreement and supplementary environmental accord modify existing agreements and provide old institution with new mandates. Particularly affected is the International Boundary and Water Commission (IBWC), long the lead agency in binational water management. This essay reviews the development of the new water management regime against the two preceding phases of management reform and considers its implications for improved water management in the border region.  相似文献

ABSTRACT Providing adequate water supplies of good quality is becoming a serious problem in many areas of the United States. Some of the alternatives proposed for meeting the growing shortage of clean-water or cheap-water are reallocation, reuse, and importation. This paper outlines a methodology to assess all of these water supply alternatives by examining the amount and time-staging for development of water sources. In conceptualizing the problem, sources of supply are classified in three categories: primary or base supplies, secondary or effluent supplies, and supplementary or imported supplies. A model of the water system is formulated as a “transportation problem” in linear programming depicting the possible sources of supply which can be used to satisfy the requirements of various water users. The optimizing objective in the model is to minimize the cost of water under various assumptions for operating the system. A case study of the Salt Lake Qty, Utah, area is used to illustrate the application of the model in obtaining optimal water supply allocations for projected future demands. Assessment of alternatives in the study include redistribution of supplies, time-staging of supplies and related treatment facilities, and sensitivity of allocations to changes in costs.  相似文献

In 1994, after more than twenty years of work, the International Law Commission of the United Nations adopted a set of thirty-three draft articles on the Law of the Non-Navigational Uses of International Watercourses. In the same year, the draft articles were submitted to the General Assembly with a view to the adoption of an international convention. The present paper analyzes and comments upon some of the major issues dealt with in the draft articles, devoting special attention to the substantive legal principles governing the utilization of international rivers and the protection of related ecosystems. Various questions still remain open for consideration by the Working Group convened by the General Assembly in 1996–1997 for the elaboration of a definitive convention. In spite of this, the draft articles adopted by the International Law Commission stand as an important achievement in the effort at codification of the law of international water resources. The present article was written within the framework of the research project "Technical aspects of the international law of the sea" which is being carried out at the Faculty of Law, University of Milan, Italy.  相似文献

ABSTRACT: Western state water resources are drawing increasing attention because of prolonged drought, pound-water overdraft and an ever-increasing awareness of insufficient Colorado River water to supply a growing population and meet industrial demand. Arizona is no exception, and the alarming decline in ground-water levels has prompted the Arizona State Legislature to adopt legislation establishing the Ground-Water Management Study Commission to recommend legislative action by 1979. This paper summarizes Arizona's ground water legislative history and discusses possible alternatives for change. The authors address specific issues facing the State and offer a set of possible Commission recommendations.  相似文献

ABSTRACT. The task of resource management, in this case water resources, is rapidly becoming more complex, particularly because decision making is often contingent upon various prior activities and sets of data. Comprehensive planning is required in order to prevent misallocation of resources or mismanagement in resource development. Such planning involves five general phases which are applicable to any problem faced by society: (1) problem identification; (2) formulation of alternatives; (3) evaluation of alternatives; (4) implementation; (5) review. There have been many attempts to simplify the planning process and effectively carry out these five phases. The experience of the Alberta Water Resources Division has been that the Critical Path Method is one of the most useful tools available today for planning. It involves two basic steps: (1) preparation of a network diagram which (a) identifies all the activities necessary for the completion of a project, (b) correctly sequences these activities, (c) allocates resources; and (2) mathematical computations for scheduling the activities. In other words, this approach breaks a task down into smaller units or activities for easier organization, scheduling, and performance for eventual completion of the project. This paper will illustrate the effectiveness of the Critical Path Method by discussing its application to actual water resources projects.  相似文献

From a discussion of the main objectives of river basin planning, the author develops the elements needed to assure successful river basin planning at the multinational level. Functions of some existing international river basin commissions are described and a fourfold classification based on the degree of planning undertaken is proposed. The Canada—United States experience in river basin planning is placed in a historical framework and the political, legal and economic factors which influenced the operations of the Canada—US International Joint Commission are described. The central point about Canada—US experience appears to be that direct planning is less frequent than indirect “planning.” The two main functions of the Canada—US International Joint Commission are regulation on the one hand and dispute settlement on the other. Partant d'une discussion sur les principaux objectifs de la planification des bassins fluviaux, l'auteur analyse les éléments nécessaires à la planification efficace de ces bassins au niveau multinational. II décrit les fonctions de certaines commissions internationales de bassins fluviaux et propose une classification en quatre parties basée sur le degré de planification envisagé. L'auteur situe les travaux du Canada et des Etats-Unis en matière de planification de bassins fluviaux dans un contexte historique et analyse les facteurs politiques, juridiques et économiques qui influencent les activités de la Commission internationale mixte du Canada et des Etats-Unis. Le résultat principal des travaux de cette Commission semble être que la planification directe est plus rare que la planification indirecte. Les deux fonctions principales de la Commission sont la réglementation d'une part et le règlement de disputes de l'autre. Después de discutir los objetivos principales la Planificación de Cuencas Hidrográficas, el autor desarrolla los elementos necesarios para asegurar una planificación apropiada de cuencas a nivel multinacional. Se describen las funciones de algunas Comisiones de Cuencas Internacionales y se propone una clasificación basado en el grado de planificación emprendida. Se pone en un marco histórico la experiencia de Canadá y los Estados Unidos en materia de planficación de cuencas hydrográficas y se describen los factores politicos, legales y económicos que influenciaron las operaciones de la Comisión Conjunta Internacional Canadá-Estados Unidos. Arid zone rivers have highly variable flow rates, and flood control projects are needed to protect adjacent property from flood damage. On the other hand, riparian corridors provide important wildlife habitat, especially for birds, and riparian vegetation is adapted to the natural variability in flows on these rivers. While environmental and flood control goals might appear to be at odds, we show that both goals can be accommodated in the Limitrophe Region (the shared border between the United States and Mexico) on the Lower Colorado River. In 1999, the International Boundary and Water Commission proposed a routine maintenance project to clear vegetation and create a pilot channel within the Limitrophe Region to improve flow capacity and delineate the border. In 2000, however, Minute 306 to the international water treaty was adopted, which calls for consideration of environmental effects of IBWC actions. We conducted vegetation and bird surveys within the Limitrophe and found that this river segment is unusually rich in native cottonwood and willow trees, marsh habitat, and resident and migratory birds compared to flow-regulated segments of river. A flood-frequency analysis showed that the existing levee system can easily contain a 100 year flood even if vegetation is not removed, and the existing braided channel system has greater carrying capacity than the proposed pilot channel.  相似文献

Impact assessment and project appraisal are taking a participatory track but the potential gain from the information, creativity and values stakeholders bring to the process is seldom realized. At issue is the design and preliminary screening of alternatives, which remains the domain of experts: designers, architects and engineers. The authors were involved in a participatory 'quick scan' project around the passage of a new high-speed rail line in which participants were actively involved in generating and screening alternatives. In this case study report they will show that deliberate information management in the design and evaluation of alternatives offers potential for better outcomes, but that the absence of stimulation of participant creativity and insufficient embedding of the participatory process in the larger political setting may prevent this.  相似文献

The Environmental Impact Assessment (EIA) procedure should predict and identify the major impacts of a project development that may cause specific spatial and temporal effects. Early in the EIA, the scoping stage provides all the relevant information on the impacts of the project alternatives. In particular, potential effects on the territorial network such as habitat connectivity loss and accessibility improvements should be taken into account in the various proposed layout alternatives when evaluating transport infrastructure projects. However, several authors have identified deficiencies in practice. The aim of this article is to provide a methodology for the assessment of these territorial impacts using adequate indicators in the early stages of the EIA procedure.

The proposed method is based on a comparison of a range of alternative layouts for a railway line linking two population centres, using indicators calculated with geographic information systems. The methodology was applied to a case study – the rail link between Huelva (Spain) and Faro (Portugal) – and the high speed rail (HSR) and conventional rail were evaluated in different layouts. The method was effective in spatially identifying significant impacts on accessibility improvements, which occurred closer to the cross border area. The conventional railway alternatives have similar accessibility values to the HSR. The results also reveal that connectivity loss is not limited to the area around the infrastructure, but extends throughout the territory. The results are at variance with the initiative proposed by Spanish and Portuguese transport decision-makers, and raise the possibility of selecting a conventional railway option. An adequate territorial evaluation methodology enables the new action to be correctly assessed, and supplies the information required to propose the most suitable alternative from a socio-economic and environmental standpoint, regardless of whether this proposal was initially included in the transport policy.  相似文献

The lofty goals of the 1992 Earth Summit regarding sustainable development will not be achieved without major improvements in the management of transboundary water resources. This paper describes the serious nature of water-related conflicts and environmental damage associated with degradation of marine ecosystems, coastal zones, and shared surface/groundwater systems. Traditional approaches such as international conventions, watercourse agreements with basin organizations, and arbitration have generally fallen short of their objectives. This article suggests that a middle ground centered on multicountry institutional arrangements for joint fact finding, evaluation, and problem resolution may be a more productive approach over the short term to achieve sustainable development. The experience of the International Joint Commission (Canada and U.S.) is described as a way of providing a neutral ground for building trust among nations, for 'leveling the playing field' among small and large countries, and for providing mechanisms for countries to work jointly toward sustainable development of their shared resources without relinquishing their sovereignty. The Global Environment Facility (GEF) is playing a catalytic role in assisting countries to address transboundary water resources issues. The paper describes GEF's Operational Strategy and discusses the implications of joint institutional arrangements for the international waters focal area. Given that the environmental security of many nations rests on improved transboundary cooperation, the GEF provides a pragmatic opportunity for countries to cooperatively address these pressing problems.  相似文献

ABSTRACT: Procedures are presented for comparing and evaluating alternative engineering designs for a particular water resources project. By using certain aspects of fuzzy set theory, it is possible to introduce both quantitative and qualitative considerations into the decisionmaking process. In addition, the viewpoints of the various interest groups involved with the water resources development can be realistically incorporated by the evaluation techniques for the alternative designs. Methods are given for eliminating undesirable alternatives and thereby obtaining a reduced set of possible feasible solutions to the problem. Because of the flexibility of the evaluation methods, the viable alternatives should not only satisfy economical, technical. environmental and other types of constraints, but these possible solutions should be politically feasible as well. A method is formulated for checking the sensitivity of the feasible results with respect to the factors that are considered in the analysis.  相似文献

/ The International Joint Commission (IJC) has overseen the implementation of the Great Lakes Water Quality Agreement between Canada and the United States for 25 years. Part of its mandate has been to facilitate international cooperation among a diversity of stakeholders focusing on the "waters" and the "ecosystem." In the 1970s policy focused on phosphorus reduction and individual contaminants, with some efforts (after 1978) to take an ecosystem (ecological perspectives) approach. In the last 15 years human health effects from (real and perceived) environmental causes have received considerable recognition. By contrast, less concern has been expressed for what is traditionally considered "environment" issues (such as protecting fish species). This shift at the policy level is well illustrated in the manner in which human health is increasingly used as a way for mobilizing environmental agendas. This paper analyzes nine IJC biennial reports to track how the framing of Great Lakes issues has shifted from concern for its waters to concern for human neurobehavior and reproductive systems. Frame analysis is used to conceptualize the controversies that are expressed through the Great Lakes policy documents. The analysis of the reports also reveals a shift in operational frames, used by the IJC to mobilize decision-makers into action.  相似文献

ABSTRACT: Social scientists were included in the planning and design for an integrated, trans-basin water resource project. Within this complex project, a socioeconomic impact assessment (SIA) concentrated on identifying the social, political, and economic issues and potential impacts inherent in developing a city's water rights. Before the SIA began, some of the development alternatives had already generated widespread hostility and organized opposition from communities within the watershed. The SIA involved residents of affected communities in the study design and project planning. The study found a number of components that constituted the concerns, beliefs, and expectations about perceived, potential impacts that might result from the different alternatives. In most cases these issues constituted threats to valued environmental resources, valued community resources, the social environment, the economic base, and a secure future. The social science component was a key factor in the ultimate decision to pursue a particular alternative which was sensitive to the social and political issues, minimized environmental and socioeconomic impacts, and ultimately had support among the communities potentially affected. The experience from this case study suggests that the approach used can be applied successfully in the planning of other water development projects and result in cooperation from the wide range of interest groups that often present costly obstacles to such projects.  相似文献

The ability of Section 404 of the Clean Water Act to act as an effective, efficient, and equitable land-use planning tool was assessed through a survey of Section 404 permits in Wisconsin. In a six-month period of permitting, the 404 program reduced wetland losses in the state by 15%. Several factors were examined that may affect permit decisions; these factors are water dependency, alternatives, project type, wetland type, and public or agency comments. Only the water dependency of the project had a statistically significant effect on permit decisions, although development projects that were perceived to provide public good were more likely to be permitted. Environmental impacts of a proposed fill project were not adequately assessed in any of the permit decisions. Because of the way Section 404 is interpreted and administered by the US Army Corps of Engineers, increasing net benefits and achieving an equitable distribution of those benefits is difficult. The corps does not perform any functional evaluations of wetlands nor do they attempt to measure economic value and environmental impacts. In addition, the 404 review process is, in effect, inaccessible to the public. The de facto interpretations of the Section 404 regulations and a lack of program funding and trained personnel all contribute to the program's ineffectiveness.  相似文献

ABSTRACT The definition and comparison of alternative water resource systems designed to meet long-range goals (say 60 years) is illustrated by a case study in Hungary. A comprehensive cost-effectiveness approach is adapted to define goals, specifications, criteria, alternatives and their capabilities. Specifications include demands given in probabilistic terms. The comparison of alternative systems is based on 12 criteria, one of which is the balance between total energy consumed and peak energy produced. Important factors involving social elements, such as flood protection and land and forest use, are described both as monetary quantities and as qualitative appreciations. Five alternative systems are defied involving flat land reservoirs, pumped storage reservoirs, interbasin transfer, and conjunctive use of surface and ground water. International cooperation is then used to rank systems and reduce the problem to a tradeoff between only two alternatives.  相似文献
