This article summarizes the main findings from a study designed to examine the legal process in Canada as it applies to alcohol-impaired driving from the point of view of Crown prosecutors and defense counsel, and to identify evidentiary or procedural factors that may impact the legal process, the rights of the accused, and interactions of all parts in the legal process.
Method
The data in this study were collected by means of a survey that was mailed out to the population of Crown prosecutors and defense counsel in Canada. In total, 765 prosecutors and 270 defense lawyers or an estimated 33% of all Canadian prosecutors and 15% of defense lawyers completed and returned the questionnaire. The "systems improvement" paradigm was used to interpret the findings and draw conclusions. Such an approach acknowledges the importance of the context in which countermeasures are implemented and delivered and the structures or entities used to deliver countermeasures to a designated target group.
Results
Results on type of charges and breath alcohol concentration, caseload, case outcomes, case preparation time, conviction rate at trial and overall conviction rate, reasons for acquittals and time to resolve cases are described.
Discussion
The findings from this national survey suggest that there are important challenges within the criminal justice system that impede the effective and efficient processing of impaired driving cases. Some of these challenges occur as a function of practices and policies, while others occur as a function of legislation.
Impact on industry
This study illustrates that a "system improvements" approach that acknowledges the importance of all elements of the criminal justice system and the interaction between those elements, can be beneficial in overcoming the alcohol-impaired driving problem. 相似文献

The United Nations Framework Convention on Climate Change (UNFCCC) confers an obligation on developed states to lead in mitigation. This obligation challenges traditional conceptions of the modern state by calling forth a more outward looking state that is able to serve both the national and international communities in the service of global climate protection. Yet, the more skeptical theories of the ecological state suggest that climate leaders will only emerge if they can connect their climate strategy to the traditional state imperatives of economic growth or national security. How the governments of Germany and Norway, both relative climate leaders with ongoing fossil-fuel dependencies, have legitimated their climate policies and diplomacy is examined through a comparative discourse analysis. While both governments rely heavily on discourses of Green growth, they also construct national identities and international role conceptions that serve purposes beyond themselves. 相似文献
Landscape-scale conservation that considers metapopulation dynamics will be essential for preventing declines of species facing multiple threats to their survival. Toward this end, we developed a novel approach that combines occurrence records, spatial–environmental data, and genetic information to model habitat, connectivity, and patterns of genetic structure and link spatial attributes to underlying ecological mechanisms. Using the threatened northern quoll (Dasyurus hallucatus) as a case study, we applied this approach to address the need for conservation decision-making tools that promote resilient metapopulations of this threatened species in the Pilbara, Western Australia, a multiuse landscape that is a hotspot for biodiversity and mining. Habitat and connectivity were predicted by different landscape characteristics. Whereas habitat suitability was overwhelmingly driven by terrain ruggedness, dispersal was facilitated by proximity to watercourses. Although there is limited evidence for major physical barriers in the Pilbara, areas with high silt and clay content (i.e., alluvial and hardpan plains) showed high resistance to dispersal. Climate subtlety shaped distributions and patterns of genetic turnover, suggesting the potential for local adaptation. By understanding these spatial–environmental associations and linking them to life-history and metapopulation dynamics, we highlight opportunities to provide targeted species management. To support this, we have created habitat, connectivity, and genetic uniqueness maps for conservation decision-making in the region. INTRODUCTION: There is evidence suggesting that the problem of fatigued or drowsy driving is an important contributor to road crashes. However, not much is known about public perceptions of the issue. The purpose of this study was to obtain information on attitudes, opinions, and professed practices related to fatigued or drowsy driving. METHODS: The data were gathered by means of a public opinion poll among a representative sample of 750 Ontario drivers. RESULTS: A majority of drivers (58.6%) admitted that they occasionally drive while fatigued or drowsy. Of greater importance, 14.5% of respondents admitted that they had fallen asleep or "nodded off" while driving during the past year. Nearly 2% were involved in a fatigue or drowsy driving related crash in the past year. Respondents were also asked about measures they take to overcome fatigue or drowsiness. Results indicate that relatively ineffective measures such as opening the window or playing music are the most popular; the most effective preventive measure--taking a rest--is the least popular. DISCUSSION: The prevalence of the behavior, coupled with the ineffective prevention measures favored by the public suggest there is a need for increasing their level of awareness and knowledge about the problem. INTRODUCTION: Aggressive driving encompasses a continuum of behaviors that range from extreme acts, such as shootings, to less severe manifestations, such as arguments and gestures. It is clear from the available data that aggressive driving is not uncommon and very risky. However, little is known about the opinions and practices of drivers. The purpose of this study was to help bridge these gaps. METHODS: The data were gathered by means of a public opinion poll among a representative sample of 1,201 Canadian drivers. Univariate frequency distributions and 95% confidence intervals were calculated and logistic regression and generalized linear latent models were used to summarize the data. RESULTS: It was found that the issue of aggressive driving is a significant one as a considerable percentage of drivers admits to it. The results coming from the logistic regression and the generalized linear latent model suggest that male and younger drivers are more likely to behave aggressively in traffic and that behaving more aggressively is associated with a history of traffic tickets. DISCUSSION: When gauging people's attitudes, opinions, and behaviors, it becomes clear that aggressive driving is a considerable problem. There also seems to be a need for a better understanding of which specific behaviors respondents associate with the generic term "aggressive driving." Subway transit is a relatively safe mode of transportation, yet compared to all other forms of mass transit in the United States (U.S.), subways have the highest fatality rate. The aim of this paper is to characterize subway-related fatalities in order to identify opportunities for risk reduction.
Method
Medical examiner records for all New York City (NYC) subway-related deaths (1990-2003) were reviewed. Data were abstracted on decedents' demographics and autopsy findings, including laboratory findings.
Results
There were 668 subway-related fatalities, of these, 10 (1.5%) were homicides, 343 (51.3%) were determined to be suicides, and 315 (47.2%) were accidental. Although decedent characteristics varied between fatality categories, they were not particularly informative with regard to prevention.
Conclusion
Prevention strategies that focus on structural controls are likely to be most efficacious in improving the overall safety of the NYC subway systems.
Impact on industry
These findings suggest that structural rather than individual-level interventions would be most successful in preventing subway fatalities. 相似文献
Objectives: In a pilot randomized controlled trial of contingency management (CM) and transdermal alcohol monitoring (TAM) with offenders driving while impaired by alcohol (DWI), perceptions regarding the acceptability of a TAM device, recruitment issues, and the impact of CM and TAM on alcohol use over a 6-week period were evaluated. The results aimed to inform the design of future trials and programs involving CM and TAM for DWI remediation.
Methods: TAM devices were affixed to 37 voluntary, community-recruited male DWI offenders with problem alcohol use. They were randomized to one of 3 groups: (1) CM; (2) alcohol use feedback (FB); and (3) TAM device only (CTL). Quantitative and qualitative data were gathered on the acceptability of TAM devices and recruitment, and alcohol use was monitored via TAM and self-report.
Results: The TAM device was perceived positively, with benefits for reducing drinking noted. Nevertheless, some of its inconveniences appeared to influence participant recruitment and attrition, including its large size and limited water resistance. TAM data revealed a significant main effect of time for reduction in weekly peak transdermal alcohol concentration (P = .02), with a decrease between means of weeks 1 and 6 (M = 0.15, SE = 0.02 vs. M = 0.09, SE = 0.02; P = .005). No significant group effect was detected.
Conclusions: TAM is a viable adjunct to CM with DWI offenders, though the TAM device used here may influence both study recruitment and adherence. These findings can guide the design of future studies into CM and TAM for DWI remediation. 相似文献
Ecological citizens are increasingly encouraged to adopt ‘precautionary consumption’ – a set of practices aimed at shielding them from the potential health harms of exposures to everyday toxics. The utility and the effects of precautionary consumption in relation to common chemical exposures are investigated. Precautionary consumption is not only of questionable utility, but is fundamentally misguided as an approach for inspiring antitoxics organizing. The failure of this approach is in part due to its assumption of a naturally bounded, autonomous individual who is able to maintain an impermeable boundary between herself and the environment. Drawing on the work of material feminist theorists, it is argued that Gabrielson and Parady’s notion of corporeal citizenship, an approach that places bodies into a complex web of material, ecological relations entangled with the social, offers several strategic advantages for framing resistance strategies. 相似文献
