面对生态环境损害赔偿诉讼这一新型诉讼形式,准确把握其定义和定位至关重要。现有生态环境损害赔偿诉讼按国家自然资源所有权私权化路径进行制度构建,其现行定义为特殊私益诉讼,现行定位为环境行政替代工具。这种定义与定位导致其与环境公益诉讼割裂,运行序位上优先于环境民事公益诉讼,引起国家机关角色错位。生态环境损害赔偿诉讼与环境民事公益诉讼的诉讼标的相同,救济和保护的利益均为环境公益,其定义应回归公益诉讼本位;政府在环境公益保护上有着广泛的职权和手段,是环境公共治理的优先主体,仅在少数行政不能的情形下才有借助司法的必要性和合理性,其在定位上应作为环境行政执法的补充机制在有限范围内发挥作用。据此,生态环境损害赔偿诉讼在制度体系上应与既有环境民事公益诉讼置于同一诉讼系属统筹立法,在诉讼序位上应让位于社会组织提起的环境民事公益诉讼。 相似文献

Conservation projects subscribing to a community-based paradigm have predominated in the 21st century. We examined the context in which the phrase was coined and traced its growth over time. Community-based conservation first appeared in the literature in the early 1990s; but grew little until after the 5th World Parks Congress in 2003. Thereafter, publications describing community-based conservation approaches increased exponentially. The conference theme was Benefits Beyond Boundaries, and its goal was to provide an economic model based on revenue accrued from conservation fundraising and ecotourism to support ecosystems, wildlife, and people, particularly in the Global South. Such models tended not to incorporate, as a core principle, the heritage of local human communities. Human heritage varies substantially over time and space making generalization of conservation principles across scales challenging. Pitfalls that have grown out of the community-based conservation approaches in the Global South include fortress conservation, conservation militarism, consumptive and nonconsumptive ecotourism, and whiz-bang solutions. We propose 10 tenets in a human heritage-centered conservation framework (e.g., engage in conservation practices using local languages, thoughtfully propose and apply solutions consistent with human heritage, provide clear professional development pathways for individuals from local communities, and promote alternative revenue-generating programs centered in local communities, among others). Strategies to reduce, halt, and reverse global declines in marine biodiversity are needed urgently. We reviewed, coded, and synthesized historical and contemporary marine conservation strategies of the Kitasoo/Xai'xais First Nation in British Columbia, Canada to show how their approaches work. We assessed whether the conservation actions classification system by the Conservation Measures Partnership was able to encompass this nation's conservation approaches. All first-order conservation actions aligned with the Kitasoo/Xai'xais First Nation's historical and contemporary marine conservation actions; hereditary chief management responsibility played a key role. A conservation ethic permeates Kitasoo/Xai'xais culture, and indigenous resource management and conservation existed historically and remains strong despite extreme efforts by colonizers to suppress all indigenous practices. The Kitasoo/Xai'xais's embodiment of conservation actions as part of their worldview, rather than as requiring actions separate from everyday life (the norm in nonindigenous cultures), was missing from the conservation action classification system. The Kitasoo/Xai'xais are one of many indigenous peoples working to revitalize their governance and management authorities. With the Canadian government's declared willingness to work toward reconciliation, there is an opportunity to enable First Nations to lead on marine and other conservation efforts. Global conservation efforts would also benefit from enhanced support for indigenous conservation approaches, including expanding the conservation actions classification to encompass a new category of conservation or sacredness ethic. 相似文献

The desire to capture natural regions in the landscape has been a goal of geographic and environmental classification and ecological land classification (ELC)
for decades. Since the increased adoption of data-centric, multivariate, computational methods, the search for natural regions
has become the search for the best classification that optimally trades off classification complexity for class homogeneity.
In this study, three techniques are investigated for their ability to find the best classification of the physical environments
of the Mt. Lofty Ranges in South Australia: AutoClass-C (a Bayesian classifier), a Kohonen Self-Organising Map neural network,
and a k-means classifier with homogeneity analysis. AutoClass-C is specifically designed to find the classification that optimally
trades off classification complexity for class homogeneity. However, AutoClass analysis was not found to be assumption-free
because it was very sensitive to the user-specified level of relative error of input data. The AutoClass results suggest that
there may be no way of finding the best classification without making critical assumptions as to the level of class heterogeneity
acceptable in the classification when using continuous environmental data. Therefore, rather than relying on adjusting abstract
parameters to arrive at a classification of suitable complexity, it is better to quantify and visualize the data structure
and the relationship between classification complexity and class homogeneity. Individually and when integrated, the Self-Organizing
Map and k-means classification with homogeneity analysis techniques also used in this study facilitate this and provide information
upon which the decision of the scale of classification can be made. It is argued that instead of searching for the elusive
classification of natural regions in the landscape, it is much better to understand and visualize the environmental structure
of the landscape and to use this knowledge to select the best ELC at the required scale of analysis. 相似文献

Incentive-Based Conservation Programs in Developing Countries: A Review of Some Key Issues and Suggestions for Improvements 总被引:2,自引:2,他引:0
Biodiversity conservation in developing countries has been a challenge because of the combination of rising human populations,
rapid technological advances, severe social hardships, and extreme poverty. To address the social, economic, and ecological
limitations of people-free parks and reserves, incentives have been incorporated into conservation programs in the hopes of
making conservation meaningful to local people. However, such incentive-based programs have been implemented with little consideration
for their ability to fulfill promises of greater protection of biodiversity. Evaluations of incentive-based conservation programs
indicate that the approach continually falls short of the rhetoric. This article provides an overview of the problems associated
with incentive-based conservation approaches in developing countries. It argues that existing incentive-based programs (IBPs)
have yet to realize that benefits vary greatly at different “community” scales and that a holistic conceptualization of a
community is essential to incorporate the complexities of a heterogeneous community when designing and implementing the IBPs.
The spatial complexities involved in correctly identifying the beneficiaries in a community and the short-term focus of IBPs
are two major challenges for sustaining conservation efforts. The article suggests improvements in three key areas: accurate
identification of “target” beneficiaries, greater inclusion of marginal communities, and efforts to enhance community aptitudes. 相似文献

In urban ecosystems, the ecological system has become completely unbalanced; this, in turn, has led to an increase in well-known
problems such as air pollution, ground pollution, and water pollution. This imbalance has also led to the growth and spread
of pathogens harmful to man, animals, and plants. Urban sustainability indicators, both global and local, also “indicate”
the percentage of population, but these refer only to the human population, not the animal population. Cities need good waste,
water, and air management, effective traffic planning, and good zoning of businesses, crafts, and services; over and above
these activities, cities also need for planning to take into account the existence of pets (dogs, cats, and etc.) and nonpet
animals (insects, birds, mice, etc.). Cities tend to be designed around humans and “on a human scale,” without taking into
account the fact that a huge animal population is living side by side with people. That explains why overcrowding tends to
go hand in hand with urbanization; all these populations, including humans, need to adapt to new spaces and often need to
drastically change their behavior. This is a fact that must be included when drafting sustainable city plans. The supposed
strategy is that of “integrated-participatory” control of the interactions between the environment and animals in the cities.
Strategy will focus on the development of integrated approaches and tools for environment and animal management in the context
of urban settings. This will require such specific methods as ecological balance sheets and ecoplans for the planning, management,
and control of the interrelation among environment, animal, and public health. The objective is to develop a better understanding
of urban biodiversity and of urban ecosystem functioning, in order to understand and minimize the negative impacts of human
activities on them. The research will focus on assessing and forecasting changes in urban biodiversity, structure, function,

The development of ecologically sound water allocation strategies that account for the needs of riverine ecosystems is a pressing
issue, especially in semiarid river basins. In the Aral Sea Basin, a search for strategies to mitigate ecological and socioeconomic
deterioration has been in process since the early 1990s. The Geographic Information System–based simulation tool TUGAI has
been developed to support the policy determination process by providing a simple, problem-oriented method to assess ecological
effects of alternative water management strategies for the Amudarya River. It combines a multiobjective water allocation model
with simple, spatially explicit statistical and rule-based models of landscape dynamics. Changes in environmental conditions
are evaluated by a fuzzy habitat suitability index for Populus euphratica, which is the dominant species of the characteristic riverine Tugai forests. Water management scenarios can be developed
by altering spatiotemporal water distribution in the delta area or the amount of water inflow into the delta. Outcomes of
scenario analysis are qualitative comparisons of the ecological effects of different options for a time period of up to 28
years. The given approach utilizes different types of knowledge, from quantitative hydrological data to qualitative local
expert knowledge. The main purpose of the tool is to integrate the knowledge in a comprehensive way to make it available for
discussions on alternative policies in moderated workshops with stakeholders. In this article, the modules of the tool, their
integration, and three hypothetical scenarios are presented. Based on the experience gained when developing the TUGAI tool,
we propose that the general framework can be transferred to other areas where tradeoffs in water allocation between the environment
and other water users are of major concern. The potential for a simulation tool to structure and inform a complex resource
management situation by involving local experts and stakeholders in the development of possible future scenarios will become

Soil pollution with Cd is an environmental problem common in the world, and it is necessary to establish what Cd concentrations
in soil could be dangerous to its fertility from toxicity effects and the risk of transference of this element to plants and
other organisms of the food chain. In this study, we assessed Cd toxicity on soil microorganisms and plants in two semiarid
soils (uncultivated and cultivated). Soil ATP content, dehydrogenase activity, and plant growth were measured in the two soils
spiked with concentrations ranging from 3 to 8000 mg Cd/kg soil and incubated for 3 h, 20 days, and 60 days. The Cd concentrations
that produced 5%; 10%;, and 50%; inhibition of each of the two soil microbiological parameter studied (ecological dose, ED,
values) were calculated using two different mathematical models. Also, the effect of Cd concentration on plant growth of ryegrass
(Lolium perenne, L.) was studied in the two soils. The Cd ED values calculated for soil dehydrogenase activity and ATP content were higher
in the agricultural soils than in the bare soil. For ATP inhibition, higher ED values were calculated than for dehydrogenase
activity inhibition. The average yields of ryegrass were reduced from 5.03 to 3.56 g in abandoned soil and from 4.21 to 1.15
g in agricultural soil with increasing concentrations of Cd in the soil. Plant growth was totally inhibited in abandoned and
agricultural soils at Cd concentrations above 2000 and 5000 mg/kg soil, respectively. There was a positive correlation between
the concentration of Cd in the plants and the total or DTPA-extractable concentrations of Cd in the soil. 相似文献
