财产保全法律制度浅探

关于财产保全制度我国民事讼诉法及最高人民法院的司法解释规定的不完善,有些制度应在立法上加以规定,并严格申请财产保全的条件,将司法实践中行之有效的财产保全的做法上升为法律规定,使我国的财产保全制度更加完善、科学。     

Naturalness: Beyond Animal Welfare

There is an ongoing debate in animalethics on the meaning and scope of animalwelfare. In certain broader views, leading anatural life through the development of naturalcapabilities is also headed under the conceptof animal welfare. I argue that a concern forthe development of natural capabilities of ananimal such as expressed when living freelyshould be distinguished from the preservationof the naturalness of its behavior andappearance. However, it is not always clearwhere a plea for natural living changes overinto a plea for the preservation of theirnaturalness or wildness. In the first part ofthis article, I examine to what extent theconcerns for natural living meet ``theexperience requirement.' I conclude that someof these concerns go beyond welfare. In thesecond part of the article. I ask whether wehave moral reasons to respect concernsfor the naturalness of an animal's living thattranscend its welfare. I argue that the moralrelevance of such considerations can be graspedwhen we see animals as entities bearingnon-moral intrinsic values. In my view the``natural' appearance and behavior of an animalmay embody intrinsic values. Caring for ananimal's naturalness should then be understoodas caring for such intrinsic values. Intrinsicvalues provide moral reasons for action iffthey are seen as constitutive of the good lifefor humans. I conclude by reinterpreting,within the framework of a perfectionist ethicaltheory, the notion of indirect dutiesregarding animals, which go beyond andsupplement the direct duties towardsanimals.

Emergency and institutional crisis in Peru during El Nino 1982-1983

From December 1982 through July 1983, Peru was plagued by disastrous consequences of El Nino/Southern Oscillation phenomenon. While the northern part of the country was devastated by torrential rains and floods, central Andean Peru endured landslides and flash floods, the southern Altiplano suffered a severe drought. Hazard preparedness was nonexistent, and official disaster relief uncoordinated and slow in coming. Administrative inefficiency magnified the stress upon the populations under disaster conditions. Provisions of disaster training from specialized international organizations is recommended as a preventive measure and as a policy to improve catastrophe-coping abilities in developing nations.

Environmental status and management in Chiba Prefecture

Chiba Prefecture is located in the east of Tokyo Metropolis. A large scale development of industrial and residential areas began in the late 1950s until then the main industries of the prefecture were agriculture and fisheries. During the past 30 years rapid industrialization and urbanization took place resulting in occurrence of various environmental problems.In an attempt to establish a better environment condition towards 21st century Chiba Prefecture has made Environmental Plan which all the municipal governments, enterprises and inhabitants should observe to realize better environment.

我国黑土退化研究现状与展望

黑土是一种腐殖质层厚,质地松散,肥力很高,孔隙比较大而透水性差,粘粒含量高,适于耕作的淋溶土。但是随着人类社会的发展,在缺乏保护和可持续利用意识、急功近利思想影响下,黑土遭到过度垦殖和掠夺式经营,人类对其活动范围远远超过了其再生能力,导致有机质含量减少,肥力下降,孔隙比减小,保水持水能力降低, 土壤板结,黑土严重退化。在国家振兴东北老工业基地和防止黑土退化及加强黑土保护之际,通过对黑土分布状况和黑土退化研究现状的分析,总结出黑土退化方式,揭示了其退化的主要原因,提出了防止黑土地退化和保护黑土地的措施,在现有研究的基础上提出黑土退化研究的新方向,希望能为黑土资源可持续利用和进一步研究起到抛砖引玉的作用。
