基于新环保法解读的长江经济带开发环保法制探析

长江经济带近年来上升为新一轮的国家战略,然而区域内生态环境面临严峻压力,生态环境保护关系到其有序开发与可持续发展。新环保法的出台与实施为长江经济带开发过程中生态环境保护工作提供了有力的制度保障。从生态环境退化、物种持续减少、环境事故高发等7个方面剖析了我国生态环境问题的趋向,并从明确政府环境责任、解决违法成本低等5个方面对新环保法展开解读,然后基于综合规划、合理布局、严守红线、优化技术、地方立法、依法行政、降低风险、公开信息与共同参与等9个方面对长江经济带的环保执法进行探讨,以期为新时期长江经济带开发法制建设提供参考。     

“Justice” and “fairness” are not the same thing

Organizational justice researchers tend to treat as synonyms the terms “justice” and “fairness”. We discuss different definitional arguments, concluding that these two concepts are distinct. Justice should be defined as adherence to rules of conduct, whereas fairness should be defined as individuals' moral evaluations of this conduct. Copyright © 2014 John Wiley & Sons, Ltd.     

设立国家消防教育日的法学思考

119消防日虽由来已久,但其在实践中的运行效果却并不十分理想,这部分归因于中央层级消防法律规范中相应法律规则的缺失.因此,应在《消防法实施条例》中设立“消防教育日”,并通过将消防教育活动的具体内容纳入该条例调整范畴的方式,明晰政府消防宣传教育的法定职责,并为全体公民参与消防宣传教育活动开拓法定渠道.     

论中国的环境政策

对中国环境政策文字表述形式进行论述，指出中国环境政策基本原则包括：环境与经济、社会协调、持续发展原则、环境责任原则，预防为主，防治结合，综合整治原则，环境民主原则，等等。对中国环境政策的基本特征进行分析，从环境经济政策，环境技术政策，环境社会政策，环境行政政策、国际环境政策探讨了中国环境政策的体系结构。对中国环境政策存在的问题进行研究，指出中国环境政策的制定机制还不够健全、环境政策目标与现实可行性     

砂尘一体化环境试验系统的设计及研制

本文对自行研制的砂尘一体化试验系统进行了介绍。设备研制中对基于文丘里原理的加砂/尘试验系统和自动监控除湿试验系统进行了详细说明,同时根据环境试验要求,指出了该试验设备研制过程中所遇到的加砂方式优化、温度调控、砂/尘浓度的测量与控制以及吹砂吹尘合一等技术难点,并给出了相应的解决途径。该试验系统研制成功,为考核装备的环境适应性和产品可靠性提供了科学的试验手段。     

The Nottingham Cycle-friendly Employers Project: Lessons for encouraging cycle commuting

The Nottingham Cycle Friendly Employers Project studied the effectiveness of measures to promote cycling to work by eight large city employers under the 1995 governmentfunded Cycle Challenge. Progress was monitored by ‘before’ and ‘after’ surveys, by examination of the measures, and by discussions with the employers. Overall cycling awareness and activity were increased by the project: 42% of employees said their cycle commuting had increased. The main influences, about equally, were providing workplace cycling facilities, a house or job move making cycling more attractive, and heightened awareness of the importance of regular exercise for health. The most welcomed and best used measures were secure cycle parking, showering and changing facilities, and cycle purchase loans.     

The elaboration of the 'Stockholm convention' on persistent organic pollutants (POPs): a negotiation process fraught with obstacles and opportunities

The conclusion in December 2000 of the negotiations for the 'Stockholm Convention' can clearly be labeled as a success. The Convention text was negotiated in merely five sessions of the Intergovernmental Negotiating Committee (INC) and accomplished after its fifth session despite the fact that numerous controversial issues, such as the inclusion of new substances under the ambit of the Convention, the acknowledgement of the precautionary principle or--clearly most controversial--the financing mechanisms, remained to be resolved. This paper attempts to provide a somewhat impressionistic account of the negotiations leading to the conclusion of the 'Stockholm Convention' as experienced by the members of the Swiss delegation participating in the negotiations of the INC. Besides a brief overview on the 'history' of the negotiations, it will focus on some issues of special interest--and controversy--to the negotiators, and finally attempt to provide an outlook on the future of the work performed by the INC and the implementation of the Convention. Issues of special interest are environmental policy issues, capacity building and financing, trade-related issues, precautionary principles, and technical and scientific issues.
