All U.S. federal agencies administering environmental laws purport to practice adaptive management (AM), but little is known about how they actually implement this conservation tool. A gap between the theory and practice of AM is revealed in judicial decisions reviewing agency adaptive management plans. We analyzed all U.S. federal court opinions published through 1 January 2015 to identify the agency AM practices courts found most deficient. The shortcomings included lack of clear objectives and processes, monitoring thresholds, and defined actions triggered by thresholds. This trio of agency shortcuts around critical, iterative steps characterizes what we call AM‐lite. Passive AM differs from active AM in its relative lack of management interventions through experimental strategies. In contrast, AM‐lite is a distinctive form of passive AM that fails to provide for the iterative steps necessary to learn from management. Courts have developed a sophisticated understanding of AM and often offer instructive rather than merely critical opinions. The role of the judiciary is limited by agency discretion under U.S. administrative law. But courts have overturned some agency AM‐lite practices and insisted on more rigorous analyses to ensure that the promised benefits of structured learning and fine‐tuned management have a reasonable likelihood of occurring. Nonetheless, there remains a mismatch in U.S. administrative law between the flexibility demanded by adaptive management and the legal objectives of transparency, public participation, and finality.  相似文献

Many of the challenges conservation professionals face can be framed as scale mismatches. The problem of scale mismatch occurs when the planning for and implementation of conservation actions is at a scale that does not reflect the scale of the conservation problem. The challenges in conservation planning related to scale mismatch include ecosystem or ecological process transcendence of governance boundaries; limited availability of fine‐resolution data; lack of operational capacity for implementation; lack of understanding of social‐ecological system components; threats to ecological diversity that operate at diverse spatial and temporal scales; mismatch between funding and the long‐term nature of ecological processes; rate of action implementation that does not reflect the rate of change of the ecological system; lack of appropriate indicators for monitoring activities; and occurrence of ecological change at scales smaller or larger than the scale of implementation or monitoring. Not recognizing and accounting for these challenges when planning for conservation can result in actions that do not address the multiscale nature of conservation problems and that do not achieve conservation objectives. Social networks link organizations and individuals across space and time and determine the scale of conservation actions; thus, an understanding of the social networks associated with conservation planning will help determine the potential for implementing conservation actions at the required scales. Social‐network analyses can be used to explore whether these networks constrain or enable key social processes and how multiple scales of action are linked. Results of network analyses can be used to mitigate scale mismatches in assessing, planning, implementing, and monitoring conservation projects. Trophy hunting can provide economic incentives to conserve wild species, but it can also involve risk when rare species are hunted. The anthropogenic Allee effect (AAE) is a conceptual model that seeks to explain how rarity may spread the seeds of further endangerment. The AAE model has increasingly been invoked in the context of trophy hunting, increasing concerns that such hunting may undermine rather than enhance conservation efforts. We question the appropriateness of uncritically applying the AAE model to trophy hunting for 4 reasons. First, the AAE assumes an open‐access resource, which is a poor characterization of most trophy‐hunting programs and obscures the potential for state, communal, or private‐property use rights to generate positive incentives for conservation. Second, study results that show the price of hunting increases as the rarity of the animal increases are insufficient to indicate the presence of AAE. Third, AAE ignores the existence of biological and behavioral factors operating in most trophy‐hunting contexts that tend to regulate the effect of hunting. We argue that site‐specific data, rather than aggregated hunting statistics, are required to demonstrate that patterns of unsustainable exploitation can be well explained by an AAE model. Instead, we suggest that conservation managers seeking to investigate and identify constraints that limit the potential conservation role of trophy hunting, should focus on the critical governance characteristics that shape the potential conservation role of trophy hunting, such as corruption, insecure property rights, and inadequate sharing of benefits with local people. Abstract:  Bycatch—the incidental catch of nontarget species—is a principal concern in marine conservation and fisheries management. In the eastern Pacific Ocean tuna fishery, a large fraction of nonmammal bycatch is captured by purse-seine gear when nets are deployed around floating objects. We examined the spatial distribution of a dominant species in this fishery's bycatch, the apex predator silky shark ( Carcharhinus falciformis ), from 1994 to 2005 to determine whether spatial closures, areas where fishing is prohibited, might effectively reduce the bycatch of this species. We then identified candidate locations for fishery closures that specifically considered the trade-off between bycatch reduction and the loss of tuna catch and evaluated ancillary conservation benefits to less commonly captured taxa. Smoothed spatial distributions of silky shark bycatch did not indicate persistent small areas of especially high bycatch for any size class of shark over the 12-year period. Nevertheless, bycatch of small silky sharks (<90 cm total length) was consistently higher north of the equator during all years. On the basis of this distribution, we evaluated nearly 100 candidate closure areas between 5°N and 15°N that could have reduced, by as much as 33%, the total silky shark bycatch while compromising only 12% of the tuna catch. Although silky sharks are the predominant species of elasmobranchs caught as bycatch in this fishery, closures also suggested reductions in the bycatch of other vulnerable taxa, including other shark species and turtles. Our technique provides an effective method with which to balance the costs and benefits of conservation in fisheries management. Spatial closures are a viable management tool, but implementation should be preceded by careful consideration of the consequences of fishing reallocation.  相似文献

Abstract:  Conservation efforts are only as sustainable as the social and political context within which they take place. The weakening or collapse of sociopolitical frameworks during wartime can lead to habitat destruction and the erosion of conservation policies, but in some cases, may also confer ecological benefits through altered settlement patterns and reduced resource exploitation. Over 90% of the major armed conflicts between 1950 and 2000 occurred within countries containing biodiversity hotspots, and more than 80% took place directly within hotspot areas. Less than one-third of the 34 recognized hotspots escaped significant conflict during this period, and most suffered repeated episodes of violence. This pattern was remarkably consistent over these 5 decades. Evidence from the war-torn Eastern Afromontane hotspot suggests that biodiversity conservation is improved when international nongovernmental organizations support local protected area staff and remain engaged throughout the conflict. With biodiversity hotspots concentrated in politically volatile regions, the conservation community must maintain continuous involvement during periods of war, and biodiversity conservation should be incorporated into military, reconstruction, and humanitarian programs in the world's conflict zones.  相似文献

Abstract:  We assessed the conservation priority of 18 freshwater ecoregions in southern South America on the basis of Aegla (genus of freshwater crabs) genetic diversity and distribution. Geographical distributions for 66 Aegla species were taken from the literature and plotted against ecoregions and main river basins of southern South America. Species richness and number of threatened and endemic species were calculated for each area. To assess taxonomic and phylogenetic diversity, we generated a molecular phylogeny based on DNA sequences for one nuclear (28S) and 4 mitochondrial (12S, 16S, COI, and COII) genes. All species richness and phylogenetic methods agreed, to a large extent, in their rankings of the importance of conservation areas, as indicated by the Spearman's rank correlation coefficient ( p < 0.01); nonetheless, some of the lowest correlations were observed between taxonomic and phylogenetic diversity indices. The 5 ecoregions of the Laguna dos Patos Basin (Eastern Brazil), Central Chile, South Brazilian Coast, Chilean Lakes, and Subtropical Potamic Axis (northern Argentina and southern Uruguay and Paraguay) had the highest biodiversity scores. Conservation of these regions will preserve the largest number of species and the greatest amount of genetic diversity within the South American freshwater Aegla fauna. Biodiversity across rivers and within areas was heterogeneously distributed in the ecoregions of Upper Paraná, Ribeira do Iguape, Upper Uruguay, and South Brazilian Coast (i.e., one river showed significantly more biodiversity than any other river from the same ecoregion), but homogeneously distributed in the other ecoregions. Hence, conservation plans in the former regions will potentially require less effort than plans in the latter regions.  相似文献

Conservation scientists are increasingly focusing on the drivers of human behavior and on the implications of various sources of uncertainty for management decision making. Trophy hunting has been suggested as a conservation tool because it gives economic value to wildlife, but recent examples show that overharvesting is a substantial problem and that data limitations are rife. We use a case study of trophy hunting of an endangered antelope, the mountain nyala (Tragelaphus buxtoni), to explore how uncertainties generated by population monitoring and poaching interact with decision making by 2 key stakeholders: the safari companies and the government. We built a management strategy evaluation model that encompasses the population dynamics of mountain nyala, a monitoring model, and a company decision making model. We investigated scenarios of investment into antipoaching and monitoring by governments and safari companies. Harvest strategy was robust to the uncertainty in the population estimates obtained from monitoring, but poaching had a much stronger effect on quota and sustainability. Hence, reducing poaching is in the interests of companies wishing to increase the profitability of their enterprises, for example by engaging community members as game scouts. There is a threshold level of uncertainty in the population estimates beyond which the year‐to‐year variation in the trophy quota prevented planning by the safari companies. This suggests a role for government in ensuring that a baseline level of population monitoring is carried out such that this level is not exceeded. Our results illustrate the importance of considering the incentives of multiple stakeholders when designing frameworks for resource use and when designing management frameworks to address the particular sources of uncertainty that affect system sustainability most heavily. Abstract: Habitat corridors can be essential for persistence of wildlife populations in fragmented landscapes. Although much research has focused on identifying species and places critical for conservation action, the conservation literature contains surprisingly few examples of corridors that actually have been protected and so provides little guidance for moving from planning through implementation. We examined a case study from southern California that combines monitoring of radio‐collared mountain lions (Puma concolor) with an assessment of land‐protection efforts to illustrate lessons learned while attempting to maintain ecological connectivity in a rapidly urbanizing landscape. As in many places, conservation scientists have provided science‐based maps of where conservation efforts should focus. But implementing corridors is a business decision based not solely on ecological information but also on cost, opportunity cost, investment risk, and other feasibility considerations. Here, the type and pattern of development is such that key connections will be lost unless they are explicitly protected. Keeping pace with conversion, however, has been difficult, especially because conservation efforts have been limited to traditional parcel‐by‐parcel land‐protection techniques. The challenges of and trade‐offs in implementation make it clear that in southern California, connectivity cannot be bought one parcel at a time. Effective land‐use plans and policies that incorporate conservation principles, such as California's Natural Communities Conservation Planning program, are needed to support the retention of landscape permeability. Lessons from this study have broad application, especially as a precautionary tale for places where such extensive and intensive development has not yet occurred. Given how limiting resources are for biodiversity conservation, conservationists must be disciplined about where and how they attempt corridor protection: in rapidly fragmenting landscapes, the opportunity for success can be surprisingly fleeting.  相似文献
