生物多样性保护法律的有效执行,应立足于具体规制工具的设计。生物多样性保护立法涉及三个主要法律领域——物种保育法、自然保护地法和生物安全法,从法律规范层面分析,这三个法律领域对规制工具的偏好与选择呈现出"硬者极硬,刑罚优先,软者无力"的整体格局。本文以生物多样性保护原理对现行规制工具进行检验,物种保育法和自然保护地法应以规制领域的去极端化为导向进行规制工具更新,一方面要软化甚至去除极硬规制,与此同时应建立完善行政合同、行政指导、行政奖励等柔性规制工具,赋予其可操作性,使之柔而有力。 相似文献

为从城市具体规划建设的视角进行防灾能力评价,找到城市空间与设施的防灾薄弱环节,提升城市的防灾减灾能力,首先,在深入分析城市抗灾-救灾理念的基础上,从抗灾能力和救灾能力2个方面,建立适用于控制性详细规划层面的防灾能力评价指标体系;其次,基于防灾能力评价指标体系构建城市防灾有向加权图模型,通过PageRank算法对用地单元防灾能力值进行排序,实现防灾减灾能力的定量评价;最后,通过某市规划实例检验评价模型,针对控规单元的防灾问题提出规划提升措施。研究结果表明:所构建模型能够实现对各控规单元的防灾能力等级评价,反映城市控规单元防灾能力的分布情况,发现用地单元规划建设中的防灾减灾问题。 相似文献

从我国游乐设施相关法律、法规、规章、技术规范和技术标准5个层次入手,梳理并分析了我国目前游乐设施安全法规与技术标准体系,针对游乐设施法律的欠缺、安全技术规范不能涵盖全部游乐设施及其安全监察、游乐设施的设计理念偏颇、现有游乐设施法规标准对游乐设施的一些要求与国际不接轨且量化要求不足等问题,笔者提出了国家应尽快制定颁布《特种设备安全法》或游乐设施的相关法律,早日填补游乐设施在型式试验、安全评价、评估、寿命预测、预警和进出口大型游乐设施监督管理办法的安全技术规范空白,改变游乐设施设计理念,完善游乐设施安全技术规范和技术标准的量化要求,尽快使我国游乐设施安全法规与技术标准体系适应国情并与国际体系接轨。 相似文献

Via a historical reconstruction, this paper primarily demonstrates how the societal debate on genetically modified organisms
(GMOs) gradually extended in terms of actors involved and concerns reflected. It is argued that the implementation of recombinant
DNA technology out of the laboratory and into civil society entailed a “complex of concerns.” In this complex, distinctions
between environmental, agricultural, socio-economic, and ethical issues proved to be blurred. This fueled the confusion between
the wider debate on genetic modification and the risk assessment of transgenic crops in the European Union. In this paper,
the lasting skeptical and/or ambivalent attitude of Europeans towards agro-food biotechnology is interpreted as signaling
an ongoing social request – and even a quest – for an evaluation of biotechnology with Sense and Sensibility. In this (re)quest, a broader-than-scientific dimension is sought for that allows addressing the GMO debate in a more “sensible”
way, whilst making “sense” of the different stances taken in it. Here, the restyling of the European regulatory frame on transgenic
agro-food products and of science communication models are discussed and taken to be indicative of the (re)quest to move from
a merely scientific evaluation and risk-based policy towards a socially more robust evaluation that takes the “non-scientific”

为了满足国土空间规划体系的建设和应对突发公共卫生事件,城市控制性详细规划指标和管理体系需要改革。在深入分析现有控规管理对国土空间应急安全保障方面的响应与不足的基础上,增加了“预防+应急”的控规管理工作路径并构建指标实施体系。“预防”是指通过空间环境的塑造来提高城市韧性,增强城市抵御不确定性风险的能力。“预防”主要方法是: (1)将健康城市理念融入控规指标体系;(2)缩小控规单元管理规模,形成从编制单元到地块单元的空间传导体系。“应急”是在应对突发公共卫生事件发生时,通过控规管理首先保障城市生命系统的可持续性;通过控规对部分土地兼容性的引导及对应急设施、通道、空间的布局来满足防疫需要。 相似文献

Applying Higgins' regulatory focus theory, we hypothesized that the effect of positive/negative feedback on motivation and performance is moderated by task type, which is argued to be an antecedent to situational regulatory focus (promotion or prevention). Thus, first we demonstrated that some tasks (e.g., tasks requiring creativity) are perceived as promotion tasks, whereas others (e.g., those requiring vigilance and attention to detail) are perceived as prevention tasks. Second, as expected, our tests in two studies of the moderation hypothesis showed that positive feedback increased self‐reported motivation (meta‐analysis across samples: N = 315, d = 0.43) and actual performance (N = 55, d = 0.67) among people working on promotion tasks, relative to negative feedback. Positive feedback, however, decreased motivation (N = 318, d = ?0.33) and performance (N = 55, d = ?0.37) among individuals working on prevention tasks, relative to negative feedback. These findings suggest that (a) performance of different tasks can affect regulatory focus and (b) variability in positive/negative feedback effects can be partially explained by regulatory focus and task type. The Australian environment and agriculture is suffering from land degradation and declining biodiversity. Laws protecting native vegetation are aimed at addressing these problems but have been resisted by farmers, compromising the social agreement necessary for regulatory success. A case study drawing on farmer interviews in central northern New South Wales reveals that the laws are considered to be under-achieving environmental outcomes since they are ill-suited to local conditions. The low feasibility of the rules is also undermining rule and state legitimacy. Regulatory resistance is due to the lack of recognition of place-specifics by government and laws that impose universal requirements. There is an epistemic distance between the bureaucratic knowledge held by government and the vernacular knowledge (place-based knowledge) of heterogeneous environments held by farmers. Incorporating vernacular knowledge so that laws are more geographically sympathetic may close vernacular disjunctures and cure regulatory failure. 相似文献

为解决现行的传统城市地区控制性详细规划(简称控规,后同)对山水风景地区控制不力的现象,以千岛湖地区为例,对山水风景地区控规进行了探讨,对控规指标体系的内容和赋值方法进行了有针对性的扩展和改进。借助GIS等技术手段,对地方性特色元素进行分析,并以此为基础,建立了以”分区控制和分类引导”为核心的控制指标体系。将单一地块进一步划分为亚区域进行分别控制,同时通过图示的方式对不同的建设类型进行引导。根据山水风景地区的建设特征,进一步引入、明确了地表改变率、建筑绝对高度、建筑投影面积等指标的赋值方法,增加了城市设计导引等内容,丰富、强化了山水风景地区控规的内容和可操作性。 相似文献
