面对生态环境损害赔偿诉讼这一新型诉讼形式,准确把握其定义和定位至关重要。现有生态环境损害赔偿诉讼按国家自然资源所有权私权化路径进行制度构建,其现行定义为特殊私益诉讼,现行定位为环境行政替代工具。这种定义与定位导致其与环境公益诉讼割裂,运行序位上优先于环境民事公益诉讼,引起国家机关角色错位。生态环境损害赔偿诉讼与环境民事公益诉讼的诉讼标的相同,救济和保护的利益均为环境公益,其定义应回归公益诉讼本位;政府在环境公益保护上有着广泛的职权和手段,是环境公共治理的优先主体,仅在少数行政不能的情形下才有借助司法的必要性和合理性,其在定位上应作为环境行政执法的补充机制在有限范围内发挥作用。据此,生态环境损害赔偿诉讼在制度体系上应与既有环境民事公益诉讼置于同一诉讼系属统筹立法,在诉讼序位上应让位于社会组织提起的环境民事公益诉讼。 相似文献

The ongoing biodiversity crisis becomes evident in the widely observed decline in abundance and diversity of species, profound changes in community structure, and shifts in species’ phenology. Insects are among the most affected groups, with documented decreases in abundance up to 76% in the last 25–30 years in some terrestrial ecosystems. Identifying the underlying drivers is a major obstacle as most ecosystems are affected by multiple stressors simultaneously and in situ measurements of environmental variables are often missing. In our study, we investigated a headwater stream belonging to the most common stream type in Germany located in a nature reserve with no major anthropogenic impacts except climate change. We used the most comprehensive quantitative long-term data set on aquatic insects available, which includes weekly measurements of species-level insect abundance, daily water temperature and stream discharge as well as measurements of additional physicochemical variables for a 42-year period (1969–2010). Overall, water temperature increased by 1.88 °C and discharge patterns changed significantly. These changes were accompanied by an 81.6% decline in insect abundance, but an increase in richness (+8.5%), Shannon diversity (+22.7%), evenness (+22.4%), and interannual turnover (+34%). Moreover, the community's trophic structure and phenology changed: the duration of emergence increased by 15.2 days, whereas the peak of emergence moved 13.4 days earlier. Additionally, we observed short-term fluctuations (<5 years) in almost all metrics as well as complex and nonlinear responses of the community toward climate change that would have been missed by simply using snapshot data or shorter time series. Our results indicate that climate change has already altered biotic communities severely even in protected areas, where no other interacting stressors (pollution, habitat fragmentation, etc.) are present. Conservation projects subscribing to a community-based paradigm have predominated in the 21st century. We examined the context in which the phrase was coined and traced its growth over time. Community-based conservation first appeared in the literature in the early 1990s; but grew little until after the 5th World Parks Congress in 2003. Thereafter, publications describing community-based conservation approaches increased exponentially. The conference theme was Benefits Beyond Boundaries, and its goal was to provide an economic model based on revenue accrued from conservation fundraising and ecotourism to support ecosystems, wildlife, and people, particularly in the Global South. Such models tended not to incorporate, as a core principle, the heritage of local human communities. Human heritage varies substantially over time and space making generalization of conservation principles across scales challenging. Pitfalls that have grown out of the community-based conservation approaches in the Global South include fortress conservation, conservation militarism, consumptive and nonconsumptive ecotourism, and whiz-bang solutions. We propose 10 tenets in a human heritage-centered conservation framework (e.g., engage in conservation practices using local languages, thoughtfully propose and apply solutions consistent with human heritage, provide clear professional development pathways for individuals from local communities, and promote alternative revenue-generating programs centered in local communities, among others). 农地整治权属调整是实现农业规模化和现代化的重要手段,而农户有效参与是推动权属调整的内在动力,研究农地整治权属调整中农户认知对其行为响应的作用机制,有助于高效引导农户参与权属调整,并为制定农地整治权属调整的政策提供科学依据。基于改进计划行为理论和湖北省11个县(市、区)1044份农户抽样调查数据,采用多群组结构方程模型探究了农地整治权属调整中不同类型农户认知对其行为响应的作用机制。结果表明:农地整治权属调整中农户行为逻辑符合改进计划行为理论,农户的行为态度、主观规范、知觉行为控制交互影响行为意愿,进而转换为行为响应,政府支持在行为意愿和行为响应之间起到部分中介作用。总体上,农户行为响应是"自发性""诱发性"和"约束性"三重行动逻辑的结合,且"自发性"占主导地位。多群组结构方程估计结果表明,纯农型与兼业Ⅰ型农户的行为响应受到"自发性""诱发性"和"约束性"三重影响,兼业Ⅱ型农户受到"自发性"和"诱发性"双重影响,非农型农户仅受到"诱发性"单一影响。因此,为引导农户积极参与农地整治权属调整,应该分别针对各类农户相应地提高其参与的"自发性"和"诱发性",降低"约束性",充分发挥农村社会经济组织的作用,将四种不同类型农户的利益需求统筹考虑,降低权属调整过程中利益协调难度。 相似文献

主体功能区划通过主体功能划分的方式将开发和保护结合,自然资源开发利用复杂化过程中资源利用与目标实现之间亟需实现基本的定量核算关系。本文从自然资源可持续利用角度,试图探讨建立初步的主体功能核算关系,通过核算框架进行生产、生活、生态主体功能概算与比较。以京津冀主体功能区与水资源为例,对所设立的核算关系进行了验证与应用,并构造绝对与相对量指标量化京津冀主体功能量、功能水资源投入量与效率,进行了异空间尺度与异质性功能的比较,为以主体功能实现最大化为目标的资源优化配置提供量化工具。结果显示:①利用生态服务价值测算的当量因子法与水足迹测算的投入产出法,刻画了水资源对于地区主体功能的支撑作用。②利用功能总量与单位功能水资源投入量指标完成了异质性功能在异质性空间上规模、结构、相应水资源效率的比较。基于算例结果得到以下结论:①本文构建的自然资源-主体功能核算关系框架能够有效衔接主体功能规划,定量核算能有效反映与评价资源对区域功能目标、经济开发活动的支撑作用。②区域资源配置存在相对功能实现的效率差异,可根据资源投入与功能产出之间的关系引导实现功能最大化目标的资源配置。合理、有效的量化手段能够推进主体功能制度的落实,也有助于当前中国空间规划体系编制与落实的实际指导效果。 相似文献

Prospective, community-based surveillance systems for measuring birth, death, and population movement rates may have advantages over the ‘gold-standard’ retrospective household survey in humanitarian contexts. A community-based, monthly surveillance system was established in South Kivu, Democratic Republic of the Congo, in partnership with a local implementing partner and the national ministry of health. Data were collected on the occurrence of births, deaths, arrivals, and departures over the course of one year, and a retrospective survey was conducted at the end of the period to validate the information. Discrepancies between the two approaches were resolved by a third visit to the households with discordant records. The study found that the surveillance system was superior in terms of its specificity and sensitivity in measuring crude mortality and birth rates as compared to the survey, demonstrating the method's potential to measure accurately important population-level health metrics in an insecure setting in a timely, community-acceptable manner. 相似文献
