Objectively best or most acceptable? Expert and lay knowledge in Swedish wind power permit processes
This article analyses legal aspects of the Swedish wind power development, theoretically based on how different types of knowledge are represented in legal contexts, mainly in the courts. A sample of appealed wind power permits is analysed, a handful of relevant informants are interviewed – including two judges in the Land and Environment Court and the appeal court – and the legal setting is analysed. Of key interest here is the interplay between expert and lay statements in the court cases, which here is related to the concepts of calculating and communicative rationalities that are developed in the planning literature. The results indicate that the juridification – which takes place as a permit issue is appealed in the judiciary system – supports the calculating rationality more than the communicative, and that the plaintiffs often attempt to adapt in how they shape their argumentation. 相似文献

The tradable planning permit (TPP) policy seeks to limit the land take by development. It can be used in countries where development rights are vested by land-use planning to certain landowners only. TPPs are traded among public authorities. We introduce here a new policy, called the auctioned tradable development rights (ATDR) policy, which takes advantage of unvested rights of development and of trading among private actors. We compare the TPP, the ATDR policy and our baseline land-use planning model using a set of criteria. There are trade-offs within compared models. Both trading policies extend opportunities for land protection from development in exchange for higher transaction costs (highest in the ATDR policy). Trading policies seek also to recapture a part of development rent, decrease rent-seeking, and locate new development more effectively from the investors' perspective. Soil sealing has negative impacts on ecosystem services since urban green and soil get lost. Although there is political commitment to stop further sealing, no reversal of this trend can be observed in Europe. This paper raises the questions (1) which strategies can be regarded as being efficient toward ecologically sustainable management of urban soil sealing and (2) who has competences and should take responsibility to steer soil sealing? The analyses are conducted in Germany. The assessment of strategies is carried out using indicators as part of a content analysis. Legal-planning, informal-planning, economic-fiscal, co-operative, and informational strategies are analyzed. Results show that there is a sufficient basis of strategies to secure urban ecosystem services by protecting urban green and reducing urban gray where microclimate regulation is a main target. Balancing urban growth and ecological conservation: A challenge for planning and governance in China
China has high biodiversity and is rapidly urbanizing. However, there is limited understanding of how urban expansion in the country is likely to affect its habitats and biodiversity. In this study, we examine urban expansion patterns and their likely impacts on biodiversity in China by 2030. Our analysis shows that most provinces are expected to experience urban expansion either near their protected areas or in biodiversity hotspots. In a few provinces such as Guangdong in the south, urban expansion is likely to impinge on both protected areas and biodiversity hotspots. We show that policies that could facilitate the integration of natural resource protection into urban planning exist on paper, but the prevailing incentives and institutional arrangements between the central and local governments prevent this kind of integration. Removing these obstacles will be necessary in order to safeguard the country’s rich biodiversity in light of the scale of urbanization underway. 相似文献

区域交通土地一体化规划需要明晰公路沿线的土地利用变化过程。基于随机概率的土地转移矩阵模型及相关结构指数,分析了武汉城市圈公路沿线的土地变化规律。结果显示,从变化量而言,武汉城市圈各类型公路沿线耕地转为建设用地的比例最大,且以国道最为明显;从系统的变化方向而言,各公路类型沿线建设用地占用耕地现象显著,此外,高速沿线建设用地占用水域,国道沿线耕地占用林地,以及各类型公路沿线耕地、林地闲置现象也需及时监测和预警。 相似文献
