This article develops a practical proposal for progress on sustainable development law. It examines the prospects for an international sustainable development law to provide a framework for more effective, coherent governance. Sustainable development law is briefly defined and an analytical framework is provided. Different degrees of integration between economic, social and environmental law are described. Certain principles of international law related to sustainable development are also highlighted. It is argued that these principles may serve to guide law‐makers and jurists where social, economic and environmental law and policy conflict or overlap. Continuing, underlying questions of sustainable development governance are addressed and its global frameworks analysed. The article also focuses on the 2002 World Summit on Sustainable Development, held in Johannesburg in August‐September 2002, and its specific mandate for the United Nations Commission on Sustainable Development (UNCSD) to take related legal developments into account. The article advances a proposal: that governments, economic, social and environmental intergovernmental organizations and other actors establish a ‘network of inquiry’ with members from relevant groups, including legal and academic organizations, and other expert groups, in order to follow, research, analyse and debate legal developments in a balanced way. 相似文献

Towards emergency management of natural disasters and critical accidents: the Greek experience 总被引:1,自引:0,他引:1
This paper presents the findings of a prototype study which sought to identify factors that contribute to effective emergency management in Greece and other European states regarding both natural disasters and critical accidents. The parameters for proper action and successful intervention in operational and logistical are identified based on the document analysis and interviews with emergency responders. The interviews are conducted between state-owned and voluntary organizations. They were asked to rate in terms of their importance for effective emergency response efforts. This paper offers useful information of the organization and management of emergency response in Greece, as well as provides interesting responders' opinions data concerning important priorities in the emergency management area. Despite the fact that the data come from the Greek experience, the conclusions may be applied for a broader use in the emergency planning of disasters. ABSTRACTScholars and practitioners have focused in recent years on the potential for achieving cooperation in small “clubs” of countries. While solutions to global climate change will eventually require widespread cooperation, club strategies could help to catalyze that outcome. Unlike the Paris Agreement, which has achieved widespread but relatively shallow cooperation, it could be easier to tailor agreements that allow deep cooperation within smaller groups. This essay extends that logic to clubs whose geometry varies two-dimensionally across countries but also along a third dimension: within countries. Most of the key elements of international relations and international law theory that explain how clubs achieve cooperation are directly applicable to three-dimensional clubs. Most of the relevant experience for these clubs has occurred in the west; overdue is a close assessment of how key units – such as provinces and firms – within China and other emerging economies. 相似文献

We are witnessing a growing concern with the global dimension of many environmental issues, reflected in the increase in the number and significance of international environmental organizations. Yet there is no internationally applicable strategy for environmental research which is management oriented. A new type of research policy, which integrates ideas derived from environmental and human ecology, is required in order to deal with cultural and ecological diversity and their interactions as reflected in the ecology of landscapes. The newly defined concept of environmental health is proposed to fill this gap. This concept integrates the latest developments in landscape evolutionary ecology and environmental health, bringing out a conflict between making the environment conducive to human health and increasing the available options for supporting the essential biological and ecological processes of the environment. Lessons derived from the evolution of human environments are used in order to illustrate how health may become un umbrella for developing an environmental research policy, which could also serve as a catalyst for international environmental projects. 相似文献

BACKGROUND: Safety teams have become a popular means to recognize and prevent injuries in the workplace. In fact, organizations, such as OSHA, NIOSH, NIEHS, DOE, and the Ohio BWC, not only encourage safety teams, but have implemented them in their organizations. However, safety teams may not be legal as defined by NLRB Act Sections 2(5) and 8(a)(2). OBJECTIVE: To determine whether safety teams are illegal labor organizations. METHODS: A review of government regulations, safety programs, and safety teams was performed to create a framework of what types of safety programs/regulations are requested and/or required by a variety of government agencies. Next, these requirements were compared to existing case law on illegal labor organizations as defined by the NLRB. RESULTS: Most safety teams and programs, even those implemented by the Federal Government, are illegal labor organizations as defined by NLRB Act Sections 2(5) and 8(a)(2). CONCLUSIONS: The Federal Government needs to amend existing legislation and develop a revision of the NLRB Act that would allow safety teams to function legally in organizations without having to meet intrusive, constricting guidelines that may inhibit the value of safety teams. IMPACT ON INDUSTRY: Organizations must be aware that safety teams may be valuable in reducing job-related accidents and injuries but they may be illegal labor organizations. 相似文献

Advocates of community-based approaches to environmental management argue that by respecting local circumstances, skills,
and concerns we may improve the prospects of achieving environmental sustainability; yet, within nation states such as Canada,
environmental conditions, management and enforcement costs and capabilities, and power differentials within and among civic
and public sectors may result in a highly differentiated capacity for environmental management across different localities
and regions. This article draws on insights of political ecology to 1) create a conceptual framework that identifies key elements
shaping regional environmental management regimes and to 2) undertake a comparative analysis to assess how elements interact
to generate uneven management outcomes. I compare experiences of two Canadian biosphere reserves designated in 2000: Clayoquot
Sound, BC; and Redberry Lake, SK. Analysis reveals that differences in governance and institutional capacities in the biosphere
reserves are key to explaining uneven local outcomes. Where the public and civic sectors are strong, a robust and publicly
vetted form of management will emerge. Where these sectors are weak and land is held as private property, environmental nongovernmental
organizations can set the type and level of management, to the exclusion of effective civic and state involvement. This result
may improve environmental sustainability but hinder social sustainability of a management regime and raises questions about

Scholars of environmental injustice have pushed to see beyond the spatial distribution of environmental harms in studies of unwanted land uses. Building upon this work, this article examines how the complex geographies of environmental injustice play out in a coalition to prevent the construction of a coal-fired power plant in Surry County, Virginia. While spatially dispersed coalitions of negatively affected actors can strengthen efforts to prevent the construction of an unwanted land use, they can also perpetuate the environmental injustices surrounding it. To make this argument, particular attention is paid to the diverse reasons and ways differentially situated actors oppose an unwanted land use. It is demonstrated how the disparate concerns and differential tactics deployed by actors in coalitions against unwanted land uses are often embedded in and potentially contribute to longer histories of social injustice. 相似文献

There are many barriers to using science to inform conservation policy and practice. Conservation scientists wishing to produce management‐relevant science must balance this goal with the imperative of demonstrating novelty and rigor in their science. Decision makers seeking to make evidence‐based decisions must balance a desire for knowledge with the need to act despite uncertainty. Generating science that will effectively inform management decisions requires that the production of information (the components of knowledge) be salient (relevant and timely), credible (authoritative, believable, and trusted), and legitimate (developed via a process that considers the values and perspectives of all relevant actors) in the eyes of both researchers and decision makers. We perceive 3 key challenges for those hoping to generate conservation science that achieves all 3 of these information characteristics. First, scientific and management audiences can have contrasting perceptions about the salience of research. Second, the pursuit of scientific credibility can come at the cost of salience and legitimacy in the eyes of decision makers, and, third, different actors can have conflicting views about what constitutes legitimate information. We highlight 4 institutional frameworks that can facilitate science that will inform management: boundary organizations (environmental organizations that span the boundary between science and management), research scientists embedded in resource management agencies, formal links between decision makers and scientists at research‐focused institutions, and training programs for conservation professionals. Although these are not the only approaches to generating boundary‐spanning science, nor are they mutually exclusive, they provide mechanisms for promoting communication, translation, and mediation across the knowledge–action boundary. We believe that despite the challenges, conservation science should strive to be a boundary science, which both advances scientific understanding and contributes to decision making.
