关于禁止或暂停严重环境违法企业参与政府采购的思考

禁止或暂停环境违法企业参与政府采购,不但直接打击违法企业的资金流,且影响其客户群,还会形成威慑示范效应,实为污染防治攻坚战的精准长效政策。本文分析了国际经验和中国现状,提出将"禁止或暂停严重环境违法企业参与政府采购"纳入相关法律法规;发布《关于禁止或暂停严重环境违法企业向政府提供产品和服务的指导意见》;建立"禁止或暂停参与政府采购的严重环境违法企业信息管理系统";设立环保专家参与政府采购评标机制。

Thinking on banning or suspending government procurement for serious environmental illegal enterprises

It not only directly influence its cash flow and customer base of illegal enterprises, but also form demonstration effect of deterrence through prohibiting or suspending environmental illegal enterprises from participating in government procurement, which is an accurate and long-term policy for the battle of preventing pollution. Based on the analysis of the international experience and the status quo of China, this paper proposed four suggestions, including writing the provisions of "banning or suspending serious environmental illegal enterprises from participating in government procurement" into relevant laws and regulations;promulgating the "Guidance on ban or suspension of governmental procurement of products and services provided by the serious environmental illegal enterprises";establishing a serious environmental illegal enterprise information management system for the reference of governmental procurement;establishing the mechanism for environmental experts to participate in the bidding evaluation of government procurement.
