| 摘 要： | 生态地役权是指为某种环境利益而利用他人土地的权利,它是保护环境的一种方式,是保护环境权利的一种物权制度安排,它是对传统地役权制度的继承和发展,在当今环境问题凸显的时代,生态地役权制度在环境保护方面有了很多创新性的运用,其大致分为:环境资源开发利用地役权、环境享用地役权以及环境保护地役权,生态地役权在法律生态化的时代很有深究的必要.

| Abstract: | Ecological servitude is the rights of use other land for certain environmental benefit; it is one of the ways of environmental protection, one kind of system design of environmental right protection. It is the heritage and development of the traditional servitude. Today environmental servitude has been used in many field of environmental protection, for example: the servitude of resource development, the servitude of use of environment, and the servitude of environmental protection. It is necessary of study on the ecological servitude in the era of ecological law. |
