| 摘 要： | 环境侵权责任归责原则是环境侵权的一项重要内容。而在长期环境法学研究和环境司法实践中却没能引起足够的重视。从经济学视野透视该问题，把严格责任归责原则和过失责任归责原则进行比较分析。并探讨了环境侵权责任归责原则中的效率与公平问题。提出分别在不同的环境侵权案件中适用不同的归责原则。

| Abstract: | The principle of imputation of environment tort responsibility is one of the important aspects of environment tort, but we have not given enough attention to the long - term environment law research and justice practice. The article which discusses the problem, insightingly from the economic point of view, analyses the strict liability and the negligence liability respectively, and probes into the efficiency and fairness in the principle of imputation of environment tort, tries to rethink the principle of imputation of environment tort responsibility. |
