论我国环境保护中的公众参与制度

环境公众参与制度是公民社会运动、全球环境保护运动发展的结果 ,它与传统的解决环境问题的机制相比有着独特的优势 ,适应了环境问题的特征要求。通过公众参与机制解决环境冲突是各国环境政策、环境法发展的必然趋势。目前我国相关的法律法规中只有原则性的公众参与解决环境问题的规定及零散保护环境公众参与权的规定 ,公众的环境意识和环境参与意识都很薄弱 ,环境保护中的公众参与制度在我国尚未成为一项真正的法律制度 ,离建立该机制的差距还比较大。所以应当借鉴发达国家的经验 ,结合我国国情 ,建立和完善我国的公众参与制度。基于此 ,本文将在公众参与制度产生、发展及其存在意义的基础上 ,对我国公众参与制度现状进行分析 ,提出完善我国公众参与制度的建议 ,改变我国环境保护中的公众参与制度流于形式的现状。

ON THE PUBLIC PARTICIPATION SYSTEM OF ENVIRONMNETAL PROTECTION IN CHINA

Public Participation is the result of the development of civil society movement and global environmental protection movement, compared with the traditional mechanisms to solve the environmental problems,it has its unique advantagc and meets the needs of solving environmental problems. It is inevitable for countries to solve environmental conflicts through Pubic Participation during the development of environmental politics,environmental law. At present, Public Participation on solving environmental problems existing in principle and sporadic stipulations on thc protection of Public Participation m thc related laws and codes, public awareness and participation on enviromnental protection is still weak, public participation hasn't become a legal law in our country. and there is still a long way to go before the establishment of that mechanism. We should establish and improve Public Participation in our country, combining with ournational situations, Based on all these, this thesis tries to analyze our current Public Participation on the basis of its beginning, development and meanings for existence, and combines it with related foreign Public Participation, thus suggests ways to improve our national Public Participation, so as to change the current national Public Participation which only lives in lip service.
