| Abstract: | Beginning with the serious environment pollution and destruction accidents that happened in recent years,this paper explores the phenomena and essence of "environmental damage" from the angle of environmental right,while distinguishes it from "environmental tort" and "environmental encroachment" and takes advantage of foreign lawmaking experiences in order to give a legal definition of "environmental damage" for legislation of Environmental Damage Act. |
