生态旅游资源有偿使用法律制度研究

资源有价已经逐渐成为当代社会的共识,自然资源的价值和价格问题也已成为当今社会热点问题,生态旅游资源作为当前新兴的资源在中国尚无明文规定有偿使用这一制度,国家或集体作为民事主体对生态旅游资源所享有的收益权被严重低估甚至忽视,生态旅游资源几乎成了"免费午餐".因此,必须健全中国生态旅游资源有偿使用法律制度,完善相关立法,建立科学的价格形成机制和规范的出让程序,最大程度地实现国家或集体的收益权能.

Study on Legal System of Paid Use of Ecotourism Resources

Giving prices to resources have gradually become the consensus of contemporary society.The value of natural resources and the price problem have become the hot issues of the society.Since there`s no regulation on eco-tourism resources in China, the state or collective as a civil subject to the ecological tourism resources enjoyed by the right to be seriously underestimated or even ignored, eco-tourism resources almost become a "free lunch." Therefore, it`s necessary to improve the Chinese eco-tourism resources paid use of the legal system, improve the relevant legislation, the establishment of a scientific mechanism for the formation of the price and norms of the transfer procedures to maximize the national or collective income power.
