| 摘 要： | 本文以2020年生态环境部公布的生态环境损害赔偿磋商十大典型案件为例,从磋商组织形式、公众参与和赔偿协议履行保障措施三大关键要素考察了我国生态环境损害赔偿磋商制度实行情况,发现磋商实例中存在磋商过程组织形式不统一、公众参与缺失以及履行赔偿协议时司法确认存在不足等规范性问题,并据此提出了健全我国生态环境损害赔偿磋商制度的相关建议。

| Abstract: | This paper analyzed ten typical ecological and environmental damage negotiation cases published by Ministry of Ecology and Environment in China.Negotiation organizations,public participation and fulfillment of compensation agreement were investigated.It was found that there were inconsistent of negotiation organizations,lack of public participation and insufficient legal confirmation when fulfill compensation agreement.Based on these observations,several suggestions to improve our ecological and environmental damage compensation negotiation system has been brought up. |
