| 摘 要： | 论述了修订后的《刑法》第３３８条规定的重大环境污染事故罪的概念、构成、特征及刑罚处罚、比较了重大环境事故罪与相关犯罪的异同，如与非法进口固体废物罪，重大责任事故罪、违反危险物品管理规定肇事罪以及因失职导致发生重大环境污染事故犯罪的区别。

| Abstract: | The revised Criminal Law stipulated crime of great accident arising from environ mental pollution. The conception, constitution and punishment of this crime were discussed. The issues which should be noticed in applying crime of great accident arising from environmental pollu tion were pointed out, such as distinctions between this crime and crime of solid waste illegally im ported, crime of great accident arising from violating management regulations of dangerous materi als, crime of great accident arising from environmental pollution creatad by derelict of duty. |
