《环境保护法》与《海洋环境保护法》陆海统筹的方案及建议研究

“陆海统筹”是《海洋环境保护法》修改的重要原则之一，这就要求处理好《环境保护法》与《海洋环境保护法》的关系，明确《海洋环境保护法》的修改形式。本文通过对《环境保护法》与《海洋环境保护法》立法背景的梳理以及定位的分析，厘清了二者的关系，通过对世界各主要海洋国家的法律体系研究，归纳出了6种主要立法模式。为落实陆海统筹原则，笔者提出3种修法方案，分析了不同方案的优点和难点，并给出有关建议。

Research on the plan and suggestion of land-sea integration base on the Environmental Protection Law and the Marine Environment Protection Law

Land-sea integration is an important principle in the revision of the Marine Environment Protection Law, which requires that the relationship between the Environmental Protection Law and the Marine Environment Protection Law be properly handled, and the form of revision of the Marine Environmental Protection Law should be clarified. This research clarifies the relationship between the Environmental Protection Law and the Marine Environment Protection Law through the analysis of the legislative background and positioning, and summarizes six legal models through the study of the legal systems of the world's major maritime countries. In order to implement the principle of land-sea integration, the author puts forward three projects, analyzes the advantages and difficulties of different projects, and gives some suggestions.
