| 摘 要： | 台湾地区"环境基本法"伴随着争议艰辛出台.该法在结构和内容上均具有明显的特色,它整合了污染防治法和自然资源法两大领域,强调对环境的整体性保护,法律的基本原则有所突破,并强化了统一协调的监管体制.但该法内容过于原则,法律责任机制极度缺乏,指导思想存在一定偏差.该法对我们修改环境保护法或制定环境基本法的最大启示是,在体现基本法特色的统合性与作为法律的可操作性之间寻求合理平衡.

| Abstract: | The Basic Environmental Law of Taiwan area is promulgated with controversy.The structure and contents of the law have obvious characteristics,and it integrates two fields of prevention and control of pollution and natural resources,strengthening the integral protection on environment and setting up the supervision system with unified coordination.But it is too principle and lack of responsibility system. |
