国家行政征用海域使用权补偿标准法律问题探讨

根据2002年开始实施的《中华人民共和国海域使用管理法》,在海域使用管理法中关于国家行政征用海域使用权、进行清海补偿标准的未作规定,只在渔业管理法中规定参照土地管理法的补偿标准进行补偿,因此,各沿海地区确定征用补偿标准缺乏统一标准。本文根据国家行政征用海域使用权补偿存在的无专门系统的行政征用补偿法、海域征用补偿程序混乱、海域征用补偿救济手段不完善、海域管理适用法律冲突和安置补偿与生产损失补偿混淆在一起等问题进行了探讨,对于完善国家行政征用海域补偿制度提出了法律建议。

The legal issue in the compensatory standard used by the state expropriation in the sea areas

Law of the People's Republic of China on the Administration of Sea Areas has been implemented in 2002.However,there are not stipulations in that law with respect to the right used by the administrators in the sea areas and the compensation standard for the clearance of sea areas,only in the Fishery Law of the People's Republic of China a rule stipulates and relevant compensation can be found with reference to the compensation standard in the Land Administration Law of the People's Republic of China.Consequently,there is not unified standard for various coastal areas and the compensation standards for expropriation.The relevant issues are discusses,such as,the lack of specialized and systematic law on the compensation to the administrative expropriation,the chaos in the procedure of compensation for sea-area expropriation,the imperfection of compensation remedies for sea-area expropriation,the conflict of laws applicable to the administration of sea areas,and the confusion of compensation for resettlement and compensation for production losses.The legal suggestions were also made for the improvement of the system of compensation for State's administrative expropriation in sea areas.
