| 摘 要： | 新刑法增加破坏环境资源保护罪,标志着我国环境资源保护法制建设的日臻完善,但也给环境资源法如何适用刑法带来一些需要思考的问题。从环境资源法适用刑法的形式,新刑法的特点,环境资源法如何与新刑法接轨等几方面进行了初步探讨,并就环境资源法适用新刑法存在的问题提出几点立法建议。

| Abstract: | The item of contaminating environment and resources was added into the newly-issued Criminal Law, which is a symbol that the construction of national environment and resources protection law is getting perfection, and then some problems on how to apply the environmental law into the criminal law had to be thought about. In this paper, the way of the application of environmental law into the criminal law, the features of the newly-issued criminal law and take-over from old criminal law to new criminal law were primarily discussed, and some proposals about the above problems were put forward. |
