In this new article, EIS reports on the compliance performance of the largest companies in the petroleum industry focusing on five key environmental concerns: toxic waste management, air pollution, water pollution, spills, and Superfund. It is important to note that the following article does not contain normalized data and graphs which would adjust findings to various size features (e.g., worldwide revenues per company). This as well as detailed environmental policy and program data on each company can be obtained from EIS. EIS reports help companies of all sizes benchmark their environmental performance and quality improvement efforts.

Here we examine one of those—penalties—and the policies of three of the largest companies in the chemical industry. In the full report, which can be obtained from EIS, 15 corporations are analyzed based on all the performance criteria.

How Well Does Brazil's Environmental Law Work in Practice? Environmental Impact Assessment and the Case of the Itapiranga Private Sustainable Logging Plan

/ The Itapiranga Sustainable Logging Plan provides an example of how Brazil's licensing system functions for logging companies in the state of Amazonas. Two questions need to be dealt with: "How sustainable can logging in the Amazon be?" and "What and how effective are existing legal mechanisms to deal with logging projects?" The environmental impact assessment (EIA) and environmental impact statement (EIS, known as the RIMA in Brazil), present relatively detailed accounts of biodiversity and the need to adopt conservation strategies to protect it. However, social and health impacts are only superficially addressed. The economic sustainability of the operation over multiple cycles is not demonstrated. The multidisciplinary teams responsible for the EIA and EIS (RIMA) reports are hired by the project proponent, an arrangement inherently carrying the risk of biasing the result. Logging reduces biodiversity, releases greenhouse gases and inflicts social and health costs. These impacts reduce the ability of Amazonian forests to provide environmental services and to supply food and livelihood security to local populations. The reports inflate positive effects such as employment: the estimated number of jobs was cut by more than half in a revision made after the EIA and EIS (RIMA) had been approved. Not only do the reports need to be more realistic in assessing both positive and negative consequences of proposed projects, but better means are needed to ensure that promised mitigatory measures are enforced in practice. Many of the lessons that can be drawn from the Itapiranga Plan are not unique to logging projects and apply to licensing of development activites generally in Brazil and elsewhere.

Environment and industrialization in Puerto Rico: disenfranchising the people

This paper explores the effects of industrialization policy on environmental regulation in Puerto Rico, focusing on implementation of the Environmental Impact Statement (EIS) review process. Adopted in 1970, the EIS process has been transformed to pave the way for extensive use of a concise, alternative mechanism for analysing project environmental impacts, one with less opportunity for public input. This policy shift, virtually replacing the full‐scale EIS, occurred as a way to mediate the conflict between environmental policy and industrialization policy. Formal public participation in environmental decision‐making became the target of reform by the Puerto Rican Government because it perceived that public review was interfering with the location of industry.     

浅论"三表合一"的设想

对国家环保总局提出的"三表合一"的设想,从三个方面提出自己的观点。第一,应以排污申报登记核定为基础,客观建立污染源动态数据库;第二,"三表合一"应该是环境统计报表、排污收费报表、污染控制报表等各方面污染源的数据统一到排污申报登记报表;第三,"三表合一"首先应建立统一的污染源指标体系,统一的污染测算方法和统一的基础数据库。

党的十七大、十八大和十九大报告均对生态文明建设作了阐述。本文系统梳理了党的十七大以来我国生态文明推进工作的历程和成就,数据显示我国在水环境保护、大气环境保护、生态环境保护方面取得了成绩。我国通过健全立法、调整结构、联防联控、专项督查等手段应对突出的大气污染、水体污染、土壤污染和生态保护等问题,其中健全党内法规和环保立法、实行党政同责与一岗双责、开展中央环境保护督察与专项环保督查以及统筹优化区域资源是关键的手段。党的十九大对生态文明建设作出了新的判断,提出两步走的战略,并作出行动部署,为美好中国的目标提供了体制和制度保障。     

固定源排污许可合规制度研究

固定源合规制度是确保固定源企业将排污许可证中载明的要求得以实施的具体措施和规定,也是将排污许可制度打造为固定源环境管理核心制度的重要环节。本文基于美国固定源合规监管经验和当前国内排污许可实施基础,构建了固定源排污许可合规管理制度。所构建的制度基于整体性治理理论,以固定源企业需提交的排污许可合规报告为主要合规监管环节,将政府部门对于固定源企业的合规监管分为以合规报告为主的书面核查和企业现场核查两个环节,并在整个合规监管过程中贯彻数据管理,设计了企业合规报告、政府核查报告、核查类型及任务、核查评估方法、合规信息公开及违规处罚方式等关键内容,以节省对于固定源企业污染排放合规监管过程的环境执法资源和提升监管效率。     

Environmental News in Argentina, Chile, Mexico and the Philippines

From an environmental perspective, the media have raised the level of environmental awareness and, rightly or wrongly, focused the attention of citizens on specific environmental issues. Public reaction to environmental news can filter back into the media and highlight specific policy issues. The importance of the media in this respect has gained strength, particularly in developing countries, where environmental problems have become legitimate concerns, and where access to 'official' information has been historically difficult. In general, newspapers have been found to be one of the most predominant sources of environmental information available to the public, particularly in developing countries. In this paper, we summarise, briefly analyse and compare the newspaper coverage of environmental issues in Argentina, Chile, Mexico and the Philippines. Among numerous other results, it appears that the coverage of environmental issues fell considerably over the period 1990-94 despite an increase in world-wide environmental awareness. Most news reports actions by the environmental agencies (warnings and rewards, etc.). In the Philippines, however, most environmental news reports investments in pollution abatement activities by the private sector. While citizens' complaints represent a small percentage of the coverage of environmental issues, closer examination reveals that such complaints, in the vast majority of cases, trigger governmental actions (warnings) and ultimately an improvement of firms' environmental performance (investment).

验证污染减排成效,创建污染物排放量、浓度与环境质量的相关性,分析污染物减排与环境质量之间复杂的交互关系,研究二者之间的作用响应机制;引入定义减排率与浓度降低率,创建相关性,更能真实反映减排成效。对加强环境管理、削减污染物排放、治理污染、调整产业结构、制定环境保护政策具有现实和重要的指导作用。     

基于环境保护的机动车税优化建议

当前区域性大气污染问题突出,机动车使用造成的污染问题不可忽视。为解决区域性的大气污染问题,机动车税费的污染减排调控功能日益被政府和学者重视。研究围绕"如何使机动车税更好发挥环境保护的效果"的问题,比较了中日机动车税的结构和性质,分析了在购买、保有和使用等不同环节的机动车税的特点以及环保效果,并基于问卷调查分析中国私家车主不同环节机动车税的负担情况。研究表明,在机动车使用环节征收的成品油消费税污染调控效果要优于其他环节的税收;对商业用途的机动车使用征税仅有收入功能没有调控功能,建议将机动车相关税的作用重心从购买环节转移到使用环节上,并对商业用途和私人用途的机动车实施差别税率。

The Environmental Pollution Perception of Residents in Coal Mining Areas: A Case Study in the Hancheng Mine Area, Shaanxi Province, China

The environmental behavior of the residents depends on their perception of environmental pollution. Hence, it is important for scientific and policy experts to research on the impact of the environmental pollution perception of local residents. Owing to the richness of natural resources, Hancheng coal mine areas are abound in heavy industries, and environmental pollution is serious and typical in this area, thus, the residents are anxious about their health. Using questionnaires, this paper surveys the perception of residents living in the coal mine area. The influential factors of environmental perception were analyzed by the Rank Sum Test. The results were: (1) the majority of the residents in the coal mine area are not satisfied with their living environment. The perception order of pollution severity is: air pollution?>?noise pollution?>?sanitation?>?water pollution. The residents think that pollution is mainly caused by coal processing. Hence, coal mining is not the main reason of the pollution in the coal mine area. (2) Age and length of residence have significant positive effects on perceptions of air, water, and noise pollutions; whereas education has a significant negative effect on perceptions of water and noise pollutions, as well as sanitation. This phenomenon can be explained by the various cultural groups having varied perceptions on the environmental pollution. In addition, proximity to mine has significant negative effect on perceptions of water and noise pollution. In conclusion, the paper discusses the effects of demographical and social factors on the perception of environmental pollution and gives suggestions on the planning and management of the environment.     

非典型环境案件法律适用问题初探

实践中一些非典型环境案件的法律适用问题存在争议。对此,必须明确:生态破坏侵权属于一般侵权行为,应当适用《侵权责任法》对一般侵权行为的规定;家庭生活污染和劳动环境污染属于环境污染,受害者在法律适用上有选择权;室内装修污染不属于环境污染,其责任属于产品责任,不适用环境污染侵权规则。
