《海洋环境保护法》第89条第2款规定了海洋环境监管部门代表国家排他性提起损害赔偿的诉讼制度,为海洋环境公益提供了特殊的诉讼保护方式。因该项制度设计的粗疏以及关联政策、立法回应不足,造成对该条款规定的理论解释困惑和制度适用障碍,导致提起海洋环境公益诉讼的主体类型受限、海洋环境公益保护诉讼程序衔接不畅、海洋环境监管部门"两种角色"手段配合不当的突出问题,直接限制了环境公益诉讼制度在海洋环境保护领域的功能发挥。破解这一问题的关键在于阐明海洋环境公益保护背后的诉讼法律关系和应用法理,完善海洋环境公益保护诉讼制度体系,实现海洋环境保护的诉权利益调整和诉讼秩序优化。重点是打破现有研究的思维定式,避免将《海洋环境保护法》第89条第2款规定的诉讼类型推演为海洋环境公益诉讼并作为讨论前提,明确该条款规定为带有维护海洋环境公益特点的"准环境公益诉讼",将其与"私益诉讼""国益诉讼""环境公益诉讼"进行合理界分,为海洋环境公益诉讼的发展提供制度空间,理顺各类型诉讼和保护机制之间的关系。在此之下,完善海洋环境监管部门"两种角色"作用发挥的制度设计,保障环境行政手段与诉讼保护手段之间的衔接配合,理顺海洋环境公益保护各类型诉讼提起的顺位与程序,促进各类诉讼手段各归其位,形成与行政保护机制的合力,最终实现对海洋生态环境的整体性保护。  相似文献

With the emergence of education for sustainable development (ESD), robust literature on ethics and ESD has emerged; however, ecocentric perspective developed within environmental ethics is marginalized in current ESDebate. The questions discussed in this article are as follows: Why is the distinction between anthropocentric and ecocentric view of environment salient to ESD? How can this distinction be operationalized and measured? Until now, little has been done to address complement quantitative studies of environmental attitudes by qualitative studies, exploring the sociocultural context in which ecocentric or anthropocentric attitudes are being formed. Neither of existing scales engaged with the interface between environmental ethics and sustainable development. This article will discuss ESD in the context of environmental ethics and present the results of the case study conducted with the Dutch Bachelor-level students. Results of qualitative evaluation of the scale measuring ecocentric and anthropocentric attitudes will be presented, and the new Ecocentric and Anthropocentric Attitudes toward the Sustainable Development (EAATSD) scale will be proposed.  相似文献

This study proposes and employs a structural model to examine the effects of environmental literacy, environmental awareness, environmental attitudes, and environmental behavior among middle school students in Eski?ehir on their purchase of environmentally friendly products. In the proposed structural model, environmental illiteracy and environmental awareness were the exogenous latent variables, while pro-environmental attitude, pro-environmental behavior, and the purchase of environmentally friendly products were the endogenous latent variables. The latent variable of environmental illiteracy did not have a statistically significant effect on environmental attitudes and purchase of environmentally friendly products, whereas environmental awareness had a positive effect on pro-environmental attitudes and the purchase of environmentally friendly products. These findings indicate that students with environmental awareness also develop positive attitudes toward the environment, and the presence of a positive attitude toward the environment leads them to display pro-environmental behaviors and adopt a positive attitude toward environmentally friendly products.  相似文献

This article provides a short overview of the main themes of ecological economics (EE). It is argued that EE provides a platform that fosters multidisciplinary environmental research by bringing together the core contributing disciplines – economics and ecology. In addition, EE is regarded as a pluralistic approach to environmental research that can be set opposite to, and has indeed developed as a response to, traditional environmental and resource economics. A comparison of the two fields is presented to clarify the essential differences between them. In addition, specific themes are examined in more detail. How to choose among the dozen policy instruments available to environmental management agencies has been a matter of concern and debate among environmental economists for the entire life of the profession – nearly four decades. The ability, or lack of it, to measure the quantities or observe the actions made "enforceable" by particular policy instruments ought clearly to be central to this choice. However, all too often the monitoring problem has been assumed away. When it is reintroduced in realistic forms, we find, not surprisingly, that some favorite policy instruments, such as pollution charges, are not applicable to some important problems, such as runoff pollution from farms; that marginal subsidies, by changing the burden of proof, may no longer be symmetric with charges; and that the apparent freedom from monitoring requirements of the newly fashionable instrument involving the public provision of information about firms or products is "paid for" by our inability to say anything about its performance on other dimensions that are also of interest. 首先按照各省环保财政支出占GDP比重与按主成分分析法计算的地方环境污染物排放综合指数的排名情况把中国30个省份分成两个区域,区域1环保财政支出污染治理效应较强,区域2环保财政支出污染治理效应较弱。区域1包括北京、海南等14个省市,区域2包括天津、上海等16个省市。其次基于2007—2014年中国省级和行业面板数据,分析开放经济、环保财政支出对污染治理的影响。最后借鉴门限回归模型检验开放经济是否存在环保财政支出与污染治理的门槛效应。结果显示:(1)环境污染物排放存在区域差异和行业差异,区域1呈现出开放程度和污染物排放双低的特征,而区域2则表现为双高特征。制造业、电力、煤气及水的生产和供应业污染物排放较高,采掘业污染物排放年均增长速度最快。(2)样本期内省级和行业面板数据均表明开放经济与环境污染物排放显著负相关,对外开放不是助推环境污染的原因。(3)中国环保财政支出与环境污染物排放显著负相关,环保财政支出具有显著的污染治理效应。(4)开放经济对环保财政支出的污染治理效应具有门槛效应,当进口和出口贸易总额高于门槛值-1.221、-1.016时环保财政支出的污染治理效应很难发挥。(5)以进、出口贸易总额为门槛变量时,有107个观测值低于门槛值,占总观测值的44.58%,其中有59个位于区域1,占55.14%。鉴于此应继续加大环境保护财政支出,进一步提升环保财政专项支出在GDP中所占比重,保持适度的对外开放,优化能源消费结构和实现产业结构升级,全面改善环境质量,提升开放经济下环保财政支出的污染治理效应。  相似文献

Industrialization is a common strategy adapted by developing countries in order to stimulate urban development and socio-economic development. Unless guided by a stringent development plan, industrialization-based urban development can lead to negative environmental consequences. This paper examines the environmental conflict that raged into an impasse between the state, society and industry stakeholders at the Map Ta Put industrial zone of the Eastern Seaboard Development Program of Thailand. Using RS–GIS tools, the study conducted a spatial–environmental analysis to elucidate the causes for the conflict and the outcome of the pragmatic approach of the state to resolve it. The study finds expansion of industries and spread of industrial air pollution beyond the buffer zone into the surrounding residential area as the main reasons for the conflict. The policy interventions by the government since 2007 were found to be ineffective to resolve the conflict. Based on the lessons learnt, the study recommends a three-pronged approach to guide similar type of industrial development toward green growth in future.  相似文献

The paper identifies some of the main ethical issues concerning the protection of the environment from radiation and suggests ways in which ethics can aid in developing a system of protection. After a presentation of background on ethical theory and environmental ethics, three main issues related to environmental protection are discussed: First, the question of valuing the environment and implications for the definition of harm and monetary valuation of environmental goods; second, difficulties with scientific uncertainty and applications of the precautionary principle; and third, issues concerned with the distribution of risk and its relevance for participation in decision-making. In summary, the paper argues that there are strong ethical grounds to provide for the protection of the environment and that, all other things being equal, there is no reason to treat ionising radiation differently to other environmental stressors.  相似文献

本文从生产要素投入端将环境污染引至索洛增长模型,理论考察工业经济结构、经济增长对环境污染的非线性影响机制,基于1999—2014年我国30个省份的面板数据,以SO_2排放量作为环境污染水平的代理变量,采用面板平滑迁移回归(PSTR)模型检验全国及分区域工业经济结构、经济增长对环境污染的非线性影响效应及区域差异性。研究结果表明:随着工业化进程的不断加快,工业产出及污染排放均呈现不断上升的趋势,但由于资本边际收益递减规律使得这种增长趋势逐渐减弱,最终导致经济增长和环境污染增长趋于稳态,当污染排放增长率降低为负时,经济增长对环境污染的影响作用由正向转变为负向。实证表明我国工业经济结构、经济增长与SO_2排放具有显著的产出水平门槛效应,随着经济产出水平由低区制平滑的过渡到高区制,经济增长对SO_2排放的影响由正向促进作用转变为负向减排效应,但工业经济结构对SO_2排放呈现逐渐增强正向促进作用,可见工业经济结构、经济增长对SO_2排放具有显著的非线性影响。此外,研究发现工业经济结构、经济增长对SO_2排放的非线性影响存在显著的区域差异性,东部地区经济增长与SO_2排放呈现显著的倒"U"型曲线关系,而在中西部地区表现出逐渐增强的促进作用,中部地区的工业经济结构对SO_2排放的促进作用最大,西部其次,东部最弱,研究还表明,减排技术水平以及环境治理投资增加对SO_2污染排放具有遏制作用,能源投资的增加加速了SO_2的排放。在未来经济发展中,应摒弃传统"高投入、高消耗"的工业化模式,政府应实施创新管理,完善环境保护立法,鼓励企业发展环境污染治理方面的技术,避免以环境容量过渡为代价,追求工业经济高质量、可持续发展模式。  相似文献

由于具有很强的外部效应,区域性是环境问题的主要特征之一。一个大的经济体内部差别化的环境保护政策容易导致环境敏感型产业在地区间的迁移,这一过程将引致地区之间产业结构的变迁。相对发达地区实行更加积极的环境保护措施,在产业的选择上限制污染型产业的发展,这势必将对原有污染型产业产生影响,加大环境保护投资、转行或者外迁是该区域内企业可能的选择。在环境政策不够严厉,产业的选择更为多样的地区,宽松的环境政策甚至是地方政府招商引资的一个优惠条件,则污染型产业是其发展的可能选择。本文通过对2003—2012年中西部19个省份11个污染型制造业工业总产值占全国比例结构的变迁进行实证检验,结果显示环境规制有非常明显的产业结构空间效应,存在对污染型制造业西迁的促进作用。区域差别性的环境政策确实突出了中西部地区的比较优势,使得环境污染密集型产业向西迁徙,实现了污染产业从中国东部向西部的空间替代。从空间的整体上看,也更有助于全面认识中国的产业升级现象。如果为了缩小地区发展差距,通过环保规制差异促进中西部地区的发展,而不是严格按照功能区进行分类环境保护和要素的自由流动,在这一过程中反映出来的产业结构变迁也是不健康的,东部地区的产业升级中的要素替代作用,尤其是技术进步的作用,无疑就会被夸大。看似中西部地区可能重新步入先发展后治理的老路,受到污染损害的仅是国家的另一片地区,但是由于中西部地区属于环境脆弱区和重要的水源上游,最终受伤害的将会是我们整个国家。  相似文献

Reviewing the existing environmental policies in Western China,we find that:in time sequence,the characteristics of China's western environmental policies shift from"development drive governance"to the full implementation of environmental protection and construction;and in spatial sequence,the ecological,social,and economic development of Western China reach to coordination through the nature reserve setting,ecological migrants,fiscal transfer payment and differentiated ecological environmental policies.Due to the implementation of the policies and projects,environmental degradation trends in the western ecological environment were alleviated significantly,the living conditions of farmers and herdsmen were improved,and many successful experiences were explored.However,future ecological environmental construction in Western China requires further improvement in integrated planning,eco-compensation mechanism,and policy assessment.This paper concludes with specific recommendations such as drawing up ecological environment construction planning,strengthening environmental law enforcement and incentive mechanisms,improving policy assessment and scientific support,enhancing environmental protection capacity,improving eco-compensation mechanism,and refining the environmental policies for key areas.  相似文献

Environmental management, for which environmental and human health risk assessment is the first stage, is a requirement for industries both before construction and during operation in order to sustain improved quality of life in the ecosystem. Therefore, the aim of this study is to propose an approach that integrates environmental and human health risk assessment for industries using hazardous materials in order to support environmental decision makers with quantitative and directive results. Analytic hierarchy process and fuzzy logic are used as tools to handle problems caused by complexity of environment and uncertain data. When the proposed approach is implemented to a scenario, it was concluded that it is possible to define risk sources with their risk classes and related membership degrees in that classes which enable the decision maker to decide which risk source has priority. In addition, they can easily point out and rank the factors contributing those risk sources owing to priority weights of them. As a result, environmental decision makers can use this approach while they are developing management alternatives for unfounded and on-going industrial plants using hazardous materials.  相似文献

中国开始实施环境保护税法的时间位于从高速增长向高质量发展过渡的时期。环境保护税法规定了大气和水污染物的税率区间,因此实际执行的税率存在优化的空间。虽然征收环境保护税是为了达成环境目标,但是该项税收同样可以服务于经济和社会目标。本文拟对环境保护税这一市场化的环境政策价格工具进行优化,从这一崭新研究视角切入,探讨协调经济与环境关系的原则,以期为实现高质量发展提供理论依据。本文的研究方法基于一个包括企业、政府和消费者的世代交替模型,各经济主体进行分散化决策。企业在生产过程中排放污染,政府向企业征收环境保护税并且治理污染,消费者的内生寿命受到污染存量和人均产出的共同影响。根据市场均衡条件,本文得到描述物质资本和污染存量动态变化的非线性差分方程,在此基础上进行解析证明和数据模拟。研究得到以下三点结论:第一,同一个环境保护税率无法同时实现经济产出最大化和社会福利最大化的目标,这意味着在高质量发展阶段政府需要抛弃以经济增长为中心的政策思路,转而以社会福利最大化为目标确定最优的环境保护税率。政府提高环境保护税率,可以实现由经济产出最大化向社会福利最大化的转变。第二,相较于最大化经济产出的税率,最大化社会福利的环境保护税率在转移路径上会造成各主要变量较小的波动,并用一定的经济产出换取更多的物质资本、更优的环境质量、更长的人均寿命、以及更高的社会福利水平,因此支持了前述政府需要以社会福利最大化为目标确定最优环境保护税率的结论。第三,最大化社会福利的环境保护税率在基准模型中的数值为1.96,但污染物的异质性会影响最优税率的数值。污染物较低的自然扩散速度、较严重的健康损害程度、较高的治理技术水平都会提高最优的环境保护税率。本文提出三点政策建议:第一,通过征收环境保护税最大化社会福利水平。第二,通过提高环境保护税率体现发展理念的转变。第三,促进医疗卫生和污染治理技术进步。  相似文献

Environmental problems are becoming increasingly severe in China with industrial discharges and household sewages being the main sources of water pollution in the country. For example, in the case of Taihu Lake, more than half of the total phosphorus in the lake comes from household sewage. While industrial pollution can be treated through technology innovation and controlled by environmental regulations and laws, decreasing household sewage relies entirely on residents. Raising public environmental awareness therefore is essential for ensuring effective environmental improvement and protection. A quantitative assessment of public awareness can inform policy and decision makers; however, not many such studies have been conducted. Changes in the awareness levels in response to a major environmental pollution incident are of particular interest because of the people’s first-hand experience of the triggered consequences. The present paper establishes a system of indicators for the assessment of public environmental awareness. Combined with a fuzzy matter-element analysis method, a model is set-up to quantitatively assess the public environmental awareness. The model is then applied to assess the environmental awareness of the residents of Wuxi City after its major lake Taihu suffered a severe algae bloom in 2007. This study examines whether this serious environmental incident affected people’s environmental awareness and to what degree. The findings show that the matter-element model is capable to resolve well the fuzziness of the ranking affiliation and classification of subjective perceptions, such as public environmental awareness. They show that this environmental incident has had significant positive impacts on the environmental awareness of Wuxi residents. The paper concludes with recommendations related to raising public environmental awareness.  相似文献

Whether information and communication technology (ICT) constitutes a threat or a cure to environment??s deterioration is controversially discussed. Empirical evidence on the impacts of ICT is rare, so that generalizable lessons can hardly be drawn. This study provides empirical results on the role of ICT in research for environmental sustainability, but instead of ascertaining the impact of ICT on environmental protection, we conduct an analysis of the use of ICT in sustainability research. We assess the preferences of experts in different thematic sustainability fields for applying ICT tools, and we investigate ways to improve the application of these tools in order to augment their returns with respect to environmental protection research. This analysis is based on a set of surveys that were administered to international experts to evaluate the importance of ICT in environmental sustainability research and the research demands in key environmental sectors, such as climate change, natural resources, energy and biodiversity. The methodological framework is built on the analysis of users?? preferences for future developments in ICT tools using stated preferences techniques. Overall results suggest that ICT tools need to be developed in specific contexts, taking into account users?? needs and expectations. Our analysis shows that the use of ICT in environmental research is of great importance in the scientific community, but it can also play a crucial role in the policy context.  相似文献

Data from the International Social Survey Programme 2000 and 2010 environment modules were analyzed to explore the relationships between attitudes, behavior, and sociodemographic variables to citizens’ preferences to aspects of environmental discourse in the Philippines. Overall, significantly more people agree to multilateralism, equity, and the link between the environment and economic progress in 2010 as compared to 2000. A series of multinomial logistic regressions were conducted to determine significant predictors to peoples’ disposition to variables related to three overarching environmental discourses. After controlling for other covariates, the study found that the more the Filipinos adhere to statements toward science and nature that are negatively connoted: the more likely they are to agree to international multilateral commitments and ascribe to equity for poorer countries in environmental efforts; and less likely to disagree to the aspects of multilateralism, equity, and the link between the environment and economic progress. Furthermore, the results showed that demographics and civic participations generally did not have a statistically significant impact on Filipino’s agreement or disagreement to environmental discourses. The paper then discusses the implications of the findings and conclusions of the study.  相似文献

新常态下,我国环境承载力已经达到或接近上限,农村水环境也存在着"边治理、边污染"和地方政府监管乏力问题,究其根源是缺乏农村水环境治理的内生机制,在中央政府投入大量精力、财力的同时,其他利益相关主体却存在不同利益诉求和行为导向冲突,因而厘清农村水环境治理行动中的主体博弈关系有助于突破此现实困境,形成良好的行动机制。本文利用演化博弈模型,分析了地方政府、企业和农户三方博弈主体在农村水环境治理行动中的演化过程。研究结果表明,系统演化具有多重复杂情景,在良好的演化情景下,只要农户参与治理的意愿高,地方政府最终将趋向于引导行动,企业也相应选择净化策略,三方实现共同治理,农村水环境质量将得到显著改善;相反地,在不良演化情景下,即使农户愿意参与治理、或企业愿意采取净化策略,都无法得到地方政府的支持和系统中其他主体的响应,系统将锁定于不良状态,最终造成农村水环境治理的"公地悲剧";在一般情景下,通过调节各方策略的参数值,发现只要地方政府和企业联合起来致力于通过一系列引导和扶持策略保障农户从参与农村水环境治理中获得切实利益,可使系统跳出不良状态,形成三方共同治理的良好局面。实例分析结果进一步验证了只要政府和企业联合行动以切实保障农户的利益,就有利于促进农村水环境质量提升。据此提出促进三方共同参与、保障农户利益的农村水环境治理行动对策建议。  相似文献
