This paper examines the role of environmental impact assessment (EIA) in project authorization decision making and the way in which the courts have interpreted its role. The purpose of the paper is to establish whether or not that role has changed over the period between the introduction of EIA in 1988 and 2001. From the evidence reported here, it is argued that while the procedural stages of EIA have been very much strengthened over that period, the importance of EIA as a tool to aid planning authorization decision making remains largely peripheral.  相似文献

As an aid to decision making Environmental Impact Assessment (EIA) is seen as a rational and systematic process which is often held to be holistic and proactive in its approach to environmental protection (Glasson et al., 1999). The roots of EIA are firmly located within the 1960s' demand for a more systematic and objective approach to environmental decision making and hence within the rationalist model of decision making theory. This paper examines the key stages of the EIA process to assess how far EIA conforms to the rationalist model today. Most research in EIA decision making has focused on the project authorization process and not the crucial decisions made at the earlier stages of screening and scoping. This study examines those early stages within the context of UK EIA practice. From this examination the paper attempts to locate EIA within decision-making theory.  相似文献

ABSTRACT: Advances in the science of weather modification have provided an opportunity for significant progress in the area of precipitation management. Coordination of efforts and intensification of both laboratory and field research could lead to major advances within the decade. In view of the important decision-making role played by society, however, it is necessary that our scientific efforts be coordinated with a public relations program designed to inform and educate the public on the role and potential of artificial precipitation augmentation. In addition, careful consideration must be given to those social and legal issues related to weather modification. Environmental impact, land use, economic potential and damage liability are aU factors of importance in any comprehensive analysis. Rational solutions to questions in each of these areas is dependent upon the establishment of a sound scientific basis for operational weather modification, which should be the first priority.  相似文献

Environmental Impact Assessment (EIA) was developed and introduced in the 1960s during a time that was dominated by three key societal influences. These were the growth of modern environmental concern, the drive for more rational, scientific and objective environmental decision making and a desire for more public involvement in environmental decision making. The legitimacy of EIA, as a tool to aid decision making, lies in its ability to meet the requirements of all three demands, the chief among these being its ability to be a systematic scientific and rational approach to decision making. Yet today we live in a society that no longer accepts the rationalist model as either possible or desirable. The deference to ‘the expert’ and our trust in science and technology has steadily declined during the period of EIAs development and widespread use. Today, EIA still depends for its legitimacy on its claim to provide a systematic and scientific approach to assessments, while society has moved on. This paper examines this growing divergence and argues that it is time for a major re‐evaluation of the role of EIA in environmental decision making.  相似文献

This paper discusses the treatment of social and economic impacts within UK environmental impact assessment (EIA). Socio-economic effects have an uncertain status in EIA, guidance on their assessment is limited and their treatment is often partial and of poor quality. This has led some commentators to view socio-economic impacts as the 'poor relations' in EIA. The paper presents the results of a recent review of the socio-economic component of UK environmental statements (ESs), which provides information on the extent, scope, balance and quality of socio-economic impact treatment. The review reveals that, although most ESs include some information on socio-economic issues, coverage tends to be narrowly focused on a small number of--primarily beneficial economic--impact types. Quantification of socio-economic impacts is also rarely attempted. The review findings are compared with those of similar studies undertaken in the mid-1990s, and the paper concludes with some recommendations for EIA practitioners relating to the treatment of socio-economic impacts.  相似文献

Environmental impact assessment (EIA) procedures have been in existence in the People's Republic of China over the last decade. The impetus for China's introduction of EIA was provided by the Environmental Protection Law of the People's Republic of China, which was adopted by the Fifth National People's Congress in 1979. The EIA process, which is administrative and not statutorily mandated, has been applied primarily to construction projects. Four stages are typically involved in an EIA investigation: design of the investigation, evaluation of background environmental quality, prediction of environmental impacts, and an assessment and analysis of the environmental impacts. A variety of approaches is used for predicting and analyzing environmental impacts, ranging from ad hoc methods to fairly sophisticated mathematical models. The results of the EIA investigation are compiled in an environmental impact statement, which is used as the basis for decision making by personnel in environmental protection departments. The EIA process does not include provisions for citizen notification or involvement. Views differ concerning the effectiveness of the EIA program in protecting China's natural, social, and cultural environments. Some hold that the EIA program has brought about improvement in environmental protection, while critics contend that the program has had little effect in the prevention of pollution. However, most, if not all, observers seem to feel that the program should be continued and improved. A major avenue for improvement is to place the evaluation of a particular project in a regional context. Management of air quality by local government in the United Kingdom (England, Scotland, Wales and Northern Ireland) requires a process of local decision-making, involving collaboration between local politicians, authority officers and interest-groups. Since the establishment of the first National Air Quality Strategy for the UK in 1997, local authority environmental health professionals have undertaken a scientific review and assessment process to identify locations where predicted future pollutant concentrations may exceed national air quality objectives. Air quality management areas (AQMAs) are declared where such exceedences are predicted. Over recent years, significant changes in local authority decision-making structures in England, Scotland and Wales have occurred, resulting in changes to the structure and governance in many local authorities. Results are presented from local authority surveys undertaken to examine the occurrence of any conflicts between the science involved in predicting exceedences and the local political decision-making processes in declaring AQMAs. Data are presented for a sample set of local authorities in Great Britain from which it is concluded that decision-making structures in local government are having a demonstrable impact on the designation of AQMAs.  相似文献

China's EIA Law came into effect in 2003 and formally requires road transport infrastructure development actions to be subject to Environmental Impact Assessment (EIA). EIAs (including project EIA and plan EIA, or strategic environmental impact assessment, SEA) have been being widely applied in the expressway infrastructure planning field. Among those applications, SEA is applied to provincial level expressway network (PLEI) plans, and project EIA is applied to expressway infrastructure development 'projects' under PLEI plans. Three case studies (one expressway project EIA and two PLEI plan SEAs) were examined to understand currently how EIAs are applied to expressway infrastructure development planning. Through the studies, a number of problems that significantly influence the quality of EIA application in the field were identified. The reasons causing those problems are analyzed and possible solutions are suggested aimed at enhancing EIA practice, helping deliver better decision-making and ultimately improving the environmental performance of expressway infrastructure.  相似文献

Environmental impact assessment (EIA) has been promoted as an instrument for preventive environmental management in construction projects, but its performance in safeguarding the environment through influencing project decision-making is questioned. This paper probes the underlying reasons from a governance perspective as an important supplement to the regulatory and technical perspectives. A framework, with process integration, professional governance, and public engagement being its key components, is proposed to analyze the governance arrangements that enable or inhibit the effective functioning of EIA, based on which a comparative study of three infrastructure projects in China, the United States and Finland was conducted. The results reveal that, while the level of process integration and public engagement of EIA determines the degree to which EIA influences project decisions, it is the professional governance that controls the accountability of EIA. The paper has implications on institutionally where efforts should be directed to improve the performance of EIA.  相似文献

This paper reports on the participation of the International Council for Local Initiatives (ICLEI) in EIA training in sub-Saharan Africa. It draws from the experiences of an EIA training project in which 365 participants from 17 African cities in six sub-Saharan African countries participated. A total of 27 resource persons from six African countries were hired and gained experience as EIA trainers for local authorities. A number of participating local authorities are already implementing and competently evaluating EIAs as a result of the training workshops. The successful implementation of EIA at the local level greatly depends on the awareness and understanding, by all the stakeholders, of the relevant legislative framework in which the EIA programme is applied. The participants were asked to identify impacts of specific projects, determine mitigation measures and recommend a suitable monitoring programme. The field exercises proved extremely valuable in that they provided a practical opportunity for workshop participants to build essential EIA skills while at the same time providing input into the actual development process in some cases. After the training workshop, participants opined that they were able to understand the value of EIA and the need for its incorporation into the decision-making process.  相似文献

Despite widespread recognition that post-development auditing has the potential to provide feedback which could improve future Environmental Impact Assessment (EIA), there remains a paucity of research which relates specifically to the evaluation of EIA predictive techniques, with even less progress in the development of audit methodologies. This paper describes a spatial analytical approach to post-development auditing that focuses upon the identification and analysis of the residual errors between the impacts predicted at a site using a particular predictive method and the actual impacts found to occur through monitoring. For three case studies, relevant impact predictions are tested (to determine the residual errors) and statistical models of the errors are developed in order to explore factors which may explain the performance of the predictive technique. The paper then considers the broader lessons and limitations that can be drawn out from the research both for auditing and EIA practice, including feedback on predictive techniques, the potential role of scoping decisions in generating errors in impact prediction, and the implications of uncertainty over future baseline conditions for auditing and impact prediction/interpretation.  相似文献

Experiences with environmental impact assessment (EIA) in a number of countries are discussed in the light of both explicit and implicit goals and objectives. Adequate environmental information is not always available to decision makers because of failure to apply EIA to all relevant decisions, the continuing inadequacies of prediction and evaluation techniques, the failure to consider alternatives adequately, and the bias of some EISs. EIA frequently results in changes to proposals and may result in stricter environmental management conditions in some cases, but some people regard it as a failure because it has not stopped development. Generally, EIA leads to better integration of environmental factors into project planning. Open procedures and freedom of information encourage responsiveness to EIA procedures, which can be weakened by discretionary powers and lack of access to the courts by public interest groups. However, legal standing may have side effects that offset its advantages. EIA can encourage cooperation and coordination between agencies but does not ensure them. Similarly, it can have a limited role in coordinating interstate and international policies. In the long term, the success of EIA depends on adequate monitoring, reassessment, and enforcement over the life of the project. EIA has generally opened up new opportunities for public participation, and may help to reduce conflict. EIA procedures need to be integrated with other environmental protection and development control programs, and various means exist for reducing its cost to developers and the public.  相似文献

As environmental and conservation efforts increasingly turn towards agricultural landscapes, it is important to understand how land management decisions are made by agricultural producers. While previous studies have explored producer decision-making, many fail to recognize the importance of external structural influences. This paper uses a case study to explore how consolidated markets and increasing corporate power in the food system can constrain producer choice and create ethical dilemmas over land management. Crop growers in the Central Coast region of California face conflicting demands regarding environmental quality and industry imposed food safety standards. A mail survey and personal interviews were used to explore growers’ perceptions and actions regarding these demands. Results indicate that in many cases growers face serious ethical dilemmas and feel pressured by large processing and retail firms to adopt measures they find environmentally destructive and unethical. Future strategies to address environmental issues on agricultural landscapes should consider the economic constraints producers face and the role of large firms in creating production standards.  相似文献

Environmental impact assessment (EIA) is based on the results of effect prediction. In general, there is much diversity in the expertise in the field of environmental prediction between the different categories of actors involved in EIA. In practice it became obvious in The Netherlands that the accessibility and comprehensibility of existing relevant information was insufficient. For improvement, a series of systematic handbooks on effect prediction, useful for all categories of actors, has been developed in The Netherlands. In this way, the selection of effect prediction methods to be used in concrete circumstances is improved and speeded up for all parties involved in environmental prediction. After a discussion of the purpose of the handbook, the realization and structure of the series are presented. Finally, the use and (potential) benefits of the handbooks for environmental management are indicated.  相似文献

Summary The Commission of the European Communities' directive on environmental impact assessment (EIA) finally came into force in July 1988. The main provisions of the Directive are described, together with the objectives it is intended to achieve and the key areas where member state legislation will need to be effective if the principal requirements of the Directive are to be properly implemented. These include adequate coverage of projects, sufficient information in EIA studies, and effective consultation and public participation. Most European countries have some experience with EIA but, as illustrated by the UK Channel Fixed Link reports, the quality of the studies undertaken is very variable. Recommendations are made for improvements in practice through more effective diffusion of best practice, better provision and use of EIA guidance, more focused EIA research, more effective consultation and closer collaboration between the different parties involved in the EIA process, and both quantitative and qualitative improvements in EIA training. The results of a recent survey of European EIA training activity indicate growing interest, but further progress in improving the provision of EIA training is needed before the Directive can be effectively implemented.Drs Christopher Wood and Norman Lee have both been involved on various Environmental Impact Assessment (EIA) studies for the European Commission and have written widely on EIA and related topics. Both are Senior Lecturers at the University of Manchester and they are co-Directors of its EIA Centre.
