This article reviews the application of environmental impact assessment (EIA) procedures and practices to three watershed modification projects situaled in western Canada. These ventures were justified for accelerating regional economic development, and cover the period during which public concerns for protecting the environment rapidly made their way into the national political agenda. An historical account and analysis of the situation, therefore, seems desirable in order to understand the development of EIA processes, practices, and methodologies since the start of construction of the first project in 1961. This study concludes that there has been good progress in predicting and evaluating environmental and related social impacts of watershed modification proposals. However, a number of obstacles need to be overcome before EIA can firmly establish itself as an effective planning tool. These difficulties include jurisdictional confusions and conflicts, division of authority and responsibility in designing and implementing appropriate mitigative and monitoring measures, lack of tested EIA methodologies, and limited availability of qualified human resources. A number of conclusions and suggestions are offered so that future watershed modification proposals may be planned and implemented in a more environmentally sustainable fashion. These include: (1) EIA processes must be completed before irrevocable decisions are made. (2) Any major intrusion into a watershed is likely to impact on some major components of the ecosystem(s). (3) Mitigation costs must form part of the benefit-cost analysis of any project proposal. (4) Interjurisdictional cooperation is imperative where watersheds cross political boundaries. (5) The EIA process is a public process, hence public concerns must be dealt with fairly. (6) The role of science in the EIA process must be at arms length from project proponents and regulators, and allowed to function in the interest of the protection of the environment and public health and safety. Impact scoping is the process of identifying important issues of a proposal and focusing the environmental impact assessment (EIA) on the high-priority issues. Although impact scoping in one form or another has been inherent to EIA for some time, documentation of its development and discussion of refinements to impact scoping processes have not been forthcoming. This article traces the development of impact scoping through time and highlights the need for such processes in EIA. A focused environmental assessment (FEA) approach to impact scoping that is suitable for implementation in an EIA is presented here and advantages of its use are delineated. FEA is a three-staged process that encourages impact scoping through progressive steps including impact identification, assessment and management planning. FEA combines a suite of EIA methods including: issues matrices, impact hypotheses, valued ecosystem components, and stakeholder participation sessions to effectively integrate impact scoping with EIA.  相似文献

The Resource Management Act 1991 (RMA) has introduced environmental impact assessment (EIA) into the operations of territorial authorities at the regional and district level in New Zealand. The system established by the RMA is not only devolved in administrative terms, it is also comprehensive in its application. This paper reports the findings of an interview-based survey of key personnel in selected regional and district councils, along with others from government departments, planning consultancies and law firms. The purpose is to assess the success of the councils in developing appropriate and workable procedures, and to identify the main problems likely to inhibit the development of an effective EIA system in New Zealand. Overall, the task of implementing the EIA requirements has been tackled positively by councils, but there are signs of major differences emerging in the EIA procedures they are developing. Key issues that need to be considered by councils include: the need for explanatory documentation for, and verbal advice to, resource consents applicants at the earliest stage possible; the lack of public involvement in the EIA activities and the need for council staff to encourage and facilitate such participation; and problems with ensuring the adequacy of EIA information in such a devolved and comprehensive EIA system.  相似文献

根据我国环境影响评价公众参与现状和海洋油气开发工程公众参与实践,对海洋油气开发工程环评中公众参与进行初步探讨。目前海洋油气开发工程公众参与存在的问题主要有:相关公众界定较难、公众主要是在环评机构主导下的被动参与、信息不对称使公众难以正确表达意见、相关公众中个人的环境素养和法制意识不高。根据存在的问题,建议通过以下方法提高海洋油气开发工程环评公众参与水平:研究制定海洋工程公众参与技术方法规范;掌握好公众参与时机,尽早启动,调动公众主动参与;科学确定公众范围,选择好公众参与对象;结合实际选择公众参与方式。  相似文献

A large body of literature addresses the role of science in environmental impact assessment (EIA) but less attention has been given to the views of practitioners themselves. In this research a survey of 31 EIA practitioners in Western Australia was undertaken to determine their perceptions of the quality and importance of science in EIA. The survey results are compared with previous theoretical, empirical, and survey studies of the role of science in EIA. Interview questions addressed the role of science in impact prediction, monitoring activities, mitigation and management, and EIA decision-making. It was clear from the interviews that many practitioners are satisfied with the quality of science currently used in EIA, but do not believe that it is given sufficient importance in the process. The quality and importance of science in the predecision stages of EIA was rated higher than in the postdecision stages. While science was perceived to provide the basis for baseline data collection, impact prediction, and mitigation design, it was seen to be less important during decision-making and ongoing project management. Science was seen to be just one input to decision-makers along with other factors such as sociopolitical and economic considerations. While time and budget constraints were seen to limit the scientific integrity of EIA activities, pressure from the public and regulatory authorities increased it. Improving the scientific component of EIA will require consideration of all these factors, not just the technical issues.  相似文献

Environmental impact assessment (EIA) has been promoted as an instrument for preventive environmental management in construction projects, but its performance in safeguarding the environment through influencing project decision-making is questioned. This paper probes the underlying reasons from a governance perspective as an important supplement to the regulatory and technical perspectives. A framework, with process integration, professional governance, and public engagement being its key components, is proposed to analyze the governance arrangements that enable or inhibit the effective functioning of EIA, based on which a comparative study of three infrastructure projects in China, the United States and Finland was conducted. The results reveal that, while the level of process integration and public engagement of EIA determines the degree to which EIA influences project decisions, it is the professional governance that controls the accountability of EIA. The paper has implications on institutionally where efforts should be directed to improve the performance of EIA.  相似文献

In this paper the existing body of theory is reviewed to highlight the need for further attention to be paid to the EIA/management relationship. In particular it is shown that the majority of the literature to date has concentrated on the influence of EIA leading up to and including the decision to proceed or not with the proposed action. Less attention has been paid to the extension of the influence of EIA beyond this point to inform the process of ongoing environmental management. This relationship is then explored by reference to the Western Australian EIA system. One of the strengths of this system is its focus upon the implementation and management of proposed developments. The outcome of EIA is generally an approval to proceed with the development subject to meeting a suite of environmental design and management objectives.  相似文献

Since environmental impact assessment (EIA) is concerned primarily withsignificant environmental impacts, the concept of impact significance deserves to be defined and applied rigorously. In this article use of the term over the past 15 years in EIA documentation is reviewed. Some recent attempts at elucidating the concept are summarized. Four perspectives on impact significance that emerged from a series of workshops on the ecological basis for EIA are presented. These perspectives include (a) statistical (related to problems of isolating project-induced changes from natural variation), (b) ecological (related to the importance of project-induced changes from a purely ecological perspective), (c) social (related to the acceptability of project-induced changes in important environmental attributes), and (d) project (related to whether project-induced changes will indeed influence project decision making). The following synthesis is proposed: Any exercise in judging the significance of an environmental impact should thoroughly consider (a) the importance of the environmental attribute in question to project decision makers, (2) the distribution of change in time and space, (c) the magnitude of change, and (d) the reliability with which change has been predicted or measured. The implications of considering these factors are discussed.  相似文献

Urban transportation projects are essential in increasing the efficiency of moving people and goods within a city, and between cities. Environmental impacts from such projects must be evaluated and mitigated, as applicable. Spatial modeling is a valuable tool for quantifying the potential level of environmental consequences within the context of an environmental impact assessment (EIA) study. This paper presents a GIS-based tool for the assessment of airborne-noise and ground-borne vibration from public transit systems, and its application to an actual project. The tool is based on the US Federal Transit Administration's (FTA) approach, and incorporates spatial information, satellite imaging, geostatistical modeling, and software programming. The tool is applied on a case study of initial environmental evaluation of a light rail transit project in an urban city in the Middle East, to evaluate alternative layouts. The tool readily allowed the alternative evaluation and the results were used as input to a multi-criteria analytic framework.  相似文献

Environmental impact assessment (EIA) procedures have been in existence in the People's Republic of China over the last decade. The impetus for China's introduction of EIA was provided by the Environmental Protection Law of the People's Republic of China, which was adopted by the Fifth National People's Congress in 1979. The EIA process, which is administrative and not statutorily mandated, has been applied primarily to construction projects. Four stages are typically involved in an EIA investigation: design of the investigation, evaluation of background environmental quality, prediction of environmental impacts, and an assessment and analysis of the environmental impacts. A variety of approaches is used for predicting and analyzing environmental impacts, ranging from ad hoc methods to fairly sophisticated mathematical models. The results of the EIA investigation are compiled in an environmental impact statement, which is used as the basis for decision making by personnel in environmental protection departments. The EIA process does not include provisions for citizen notification or involvement. Views differ concerning the effectiveness of the EIA program in protecting China's natural, social, and cultural environments. Some hold that the EIA program has brought about improvement in environmental protection, while critics contend that the program has had little effect in the prevention of pollution. However, most, if not all, observers seem to feel that the program should be continued and improved. A major avenue for improvement is to place the evaluation of a particular project in a regional context. / The Itapiranga Sustainable Logging Plan provides an example of how Brazil's licensing system functions for logging companies in the state of Amazonas. Two questions need to be dealt with: "How sustainable can logging in the Amazon be?" and "What and how effective are existing legal mechanisms to deal with logging projects?" The environmental impact assessment (EIA) and environmental impact statement (EIS, known as the RIMA in Brazil), present relatively detailed accounts of biodiversity and the need to adopt conservation strategies to protect it. However, social and health impacts are only superficially addressed. The economic sustainability of the operation over multiple cycles is not demonstrated. The multidisciplinary teams responsible for the EIA and EIS (RIMA) reports are hired by the project proponent, an arrangement inherently carrying the risk of biasing the result. Logging reduces biodiversity, releases greenhouse gases and inflicts social and health costs. These impacts reduce the ability of Amazonian forests to provide environmental services and to supply food and livelihood security to local populations. The reports inflate positive effects such as employment: the estimated number of jobs was cut by more than half in a revision made after the EIA and EIS (RIMA) had been approved. Not only do the reports need to be more realistic in assessing both positive and negative consequences of proposed projects, but better means are needed to ensure that promised mitigatory measures are enforced in practice. Many of the lessons that can be drawn from the Itapiranga Plan are not unique to logging projects and apply to licensing of development activites generally in Brazil and elsewhere.  相似文献

Environmental assessment of alternative development plans, programs, and policies may bring conflict among decision-makers, particularly when some quantitative measures for decision-making are needed and where cumulative impacts are neglected. Environmental impact assessment (EIA) and environmental economics theories, despite their usefulness, are not capable of addressing those issues and problems alone. In recent years, the decision support system (DSS) has provided some solutions, but mathematical analysis of the system to show the internal structure of the problem is not always possible. To addres the above shortcomings and ongoing problems of decision-making in Iran, a degradation model (DM) was introduced as an instrument of EIA, to act as a DSS for managers. The model is a compromise between knowledge-based decision support systems, detailed models, digested information models, and the basic theorem of environmental economics. In the present study (1996–2000), the model was applied in three provinces of Iran, representing three of four biogeographical regions of Iran. The study area was divided into a set of grids (100 km2). The degradation coefficient (H) was computed for all grids (1333), representing the degree of degradation in the grid. It is obvious that the higher the coefficient the more area is degraded and less prone to further development, and vice versa. In order to provide decision-makers with a set of quantitative measures to observe impacted areas (critical and noncritical) for resource allocation and further development, the degradation coefficients of all grids were classified into categories and criteria, using a fuzzy set theoretic approach. Accordingly, only 24% of study areas are prone to further development. The degradation model as a knowledge-based decision support system has its strengths and weaknesses, but it has solved managers' ongoing problems in Iran and it could be used elsewhere.  相似文献

诉前程序与诉讼程序既相互独立,又紧密衔接,在公益诉讼案件中起着督促和过滤的作用。但是目前我国公益诉讼还处在发展初期,行政公益诉讼诉前程序在实践运用中的诸多弊端也逐渐暴露出来:案件线索来源太过单一、行政机关履职标准不明确、检察建议的相关规定不完善等。以行政公益诉讼制度中的诉前程序为研究对象,通过梳理相关法律规定,并结合其实践情况,探讨诉前程序在环境行政公益诉讼中存在的问题,从而针对性地提出完善建议。面对环境行政公益诉讼诉前程序逐渐显露出来的不足之处,我们需要进一步完善检察建议的相关规定、鼓励公众参与、设立弹性的履职期限以及明确行政机关的履职标准,最大限度地发挥诉前程序在环境生态保护方面的作用。  相似文献

How does knowledge management (KM) by a government agency responsible for environmental impact assessment (EIA) potentially contribute to better environmental assessment and management practice? Staff members at government agencies in charge of the EIA process are knowledge workers who perform judgement-oriented tasks highly reliant on individual expertise, but also grounded on the agency’s knowledge accumulated over the years. Part of an agency’s knowledge can be codified and stored in an organizational memory, but is subject to decay or loss if not properly managed. The EIA agency operating in Western Australia was used as a case study. Its KM initiatives were reviewed, knowledge repositories were identified and staff surveyed to gauge the utilisation and effectiveness of such repositories in enabling them to perform EIA tasks.  相似文献

Large-scale public infrastructure projects have featured in China’s modernization course since the early 1980s. During the early stages of China’s rapid economic development, public attention focused on the economic and social impact of high-profile construction projects. In recent years, however, we have seen a shift in public concern toward the environmental and ecological effects of such projects, and today governments are required to provide valid environmental impact assessments prior to allowing large-scale construction. The official requirement for the monitoring of environmental conditions has led to an increased number of debates in recent years regarding the effectiveness of Environmental Impact Assessments (EIAs) and Governmental Environmental Audits (GEAs) as environmental safeguards in instances of large-scale construction. Although EIA and GEA are conducted by different institutions and have different goals and enforcement potential, these two practices can be closely related in terms of methodology. This article cites the construction of the Qinghai–Tibet Railway as an instance in which EIA and GEA offer complementary approaches to environmental impact management. This study concludes that the GEA approach can serve as an effective follow-up to the EIA and establishes that the EIA lays a base for conducting future GEAs. The relationship that emerges through a study of the Railway’s construction calls for more deliberate institutional arrangements and cooperation if the two practices are to be used in concert to optimal effect.  相似文献

Virtually every environmental planner at some time deals with environmental impact assessment (EIA). Public participation is required in most environmental impact assessment programmesaround the world. However, citizen involvement is often reduced to a procedural exercise instead of a substantive process to include the public in environmental decision making. This paper examines public participation in EIA and provides ways to improve its effectiveness. We first examine the rationales for public involvement and its institutionalization through EIA. Next, we analyse the shortcomings and strengths of common approaches to public involvement. Our analysis, supported by two case studies, suggests that going beyond the minimum requirements can benefit the public, the project proponent and the final plan. We conclude with practical steps to improve public participation programmes in environmental planning and decision making.  相似文献
