ABSTRACT

Learning among actors within the United Nations Framework Convention on Climate Change (UNFCCC) negotiations helped transferring climate policies across countries and changed negotiation positions. Together with group pressure and leadership by key governments and non-national actors, experience, knowledge and belief-based learning types altered the UNFCCC negotiation dynamics and facilitated the Paris Agreement. Governments, the UNFCCC secretariat and NGOs created opportunities for government representatives to explore policy options and learn from each other’ successes of designing and implementing low carbon policies. These experience exchanges during and beyond the UNFCCC meetings were established to help countries share their experiences with low carbon economic development plans to address climate change while decoupling economic growth. Based on elite interviews, participant observation and document analysis, this contribution examines how learning facilitated breakthroughs in international climate negotiations. It finds that structured experience exchange of and reflection on other countries’ and non-national actors’ successful policy experiences can modify national interests as policymakers increasingly understand that climate action can support economic growth. This resulted in a higher willingness to take on more ambitious climate action commitments. Sharing experiences with climate policies can facilitate other actor’s learning how they can adapt successful policies to their specific framework conditions.  相似文献

This study explores the potential for societies to create more green jobs for the disadvantaged. The research questions are related to how policy instruments can support green jobs and how green jobs can support the disadvantaged. These questions are asked in the context of the province of British Columbia in Canada, with implications for the global economy. Findings indicate that green jobs policies have direct and indirect effects on the growth of sustainable industries at a municipal level. Furthermore, in BC policy, green jobs are unmistakably connected to the government perception of green growth. Finally, the preferred pathway for policy implementation appears to involve local municipalities that apply for funding for projects that can potentially connect local actors and include the disadvantaged. Several policies accomplish the inclusion of the disadvantaged. The first section of this paper provides the BC provincial context on green jobs. The second section describes and analyzes a sample of thirteen BC policy instruments, as well as concurrent labor market policy activities for their inclusion of the disadvantaged. The third section posits a provisional policy framework for training and hiring more inclusively for green jobs. The fourth section offers six recommendations to bolster green jobs for all at a national and international level.  相似文献

Environmental problems are often transboundary in nature. International cooperation to solve them has resulted in a growing number of environmental agreements. Supreme Audit Institutions, which are the highest national audit institutions in a country and are responsible for auditing the regularity of governmental expenditure and receipts, can contribute to the success of international cooperation by auditing government compliance with international environmental obligations and commitments. This is a new challenge for supreme audit institutions. To encourage and support this work a Workgroup on Environmental Auditing of the International Organisation of Supreme Audit Institutions has developed guidelines, which are presented in this article. The possible practical role of audit institutions is illustrated by the audit on the Convention on the Prevention of Marine Pollution by Ships, in which eight European audit institutions cooperated. Public health and human rights are complementary approaches to promoting and protecting human dignity and well-being. The aim of this paper is to examine international provisions and national policies on health and human rights that regulate the health system in Nigeria, along with the institutional arrangements created for the design and implementation of health services. The paper reviews the framework for policy formulation and planning on health matters and emphasizes the responsibilities of the state to implement Millennium Development Goals and international obligations of human rights. It highlights the importance and impact of gender and reproductive rights on health system performance and concludes by proposing legal strategies to improve health outcomes in the country.  相似文献

We have investigated why conflicts linked to the distribution of power between governments and actors at the national and local levels concerning environmental management of mountain areas in Norway persist despite political intentions to strengthen local powers. We seek to explain this by analysing changes in policies, institutional frameworks, and regional contexts, and the local perceptions of these changes. Paradoxically, the national government's power has apparently been strengthened by new sectoral regulations and more stringent enforcement of the existing ones, increases in the number and extent of protected areas, and failures to act on intentions to devolve power. An additional factor spurring conflicts is the increased importance of tourism to mountain communities. To become more relevant to policies and development in mountain areas, future studies on multilevel governance must address multilevel politics, entire mountain areas, and the context of their development, rather than focusing on minor projects and protected areas.  相似文献

Implementation of policy involves multiple agencies operating at multiple levels in facilitating processes and actions to accomplish desired results. The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) was developed and implemented to regulate and control international wildlife trade, but violations of the agreement are widespread and growing worldwide, including in Nepal. This study attempts to understand how domestic CITES policies are translated into action and what effect actions and processes have on compliance. In doing so, this study provides insights into the implementation and enforcement pitfalls of national legislation that explain CITES violations in Nepal. Primarily, we used 26 key informants interviews to learn opinions of experts, and the grounded theory approach for further qualitative data analysis. In addition, we used Najman's (1995) policy implementation analysis framework to explain gaps. Many interrelated variables in the content of the policy, commitment and capacity of the agencies, the roles of clients and coalitions and contextual issues were observed. Variables that emerged suggest pitfalls in the regulatory policy represented by low probability of detection, arrest and punishment. Moreover, redistributive policies in buffer zones of protected areas are needed into perpetuity to benefit locals. Also, conservation organizations' support for building public and political salience is imperative.  相似文献

Increased development pressures on the marine environment and the potential for multiple use conflicts, arising as a result of the current expansion of offshore wind energy, fishing and aquaculture, dredging, mineral extraction, shipping, and the need to meet international and national commitments to biodiversity conservation, have led to increased interest in sea use planning with particular emphasis on marine spatial planning. Several European countries, on their own initiative or driven by the European Union's Marine Strategy and Maritime Policy, the Bergen Declaration of the North Sea Conference, and the EU Recommendation on Integrated Coastal Zone Management, have taken global leadership in implementing marine spatial planning. Belgium, The Netherlands, and Germany in the North Sea, and the United Kingdom in the Irish Sea, have already completed preliminary sea use plans and zoning proposals for marine areas within their national jurisdictions. This paper discusses the nature and context of marine spatial planning, the international legal and policy framework, and the increasing need for marine spatial planning in Europe. In addition, the authors review briefly three marine spatial planning initiatives in the North Sea and conclude with some initial lessons learned from these experiences.  相似文献

Colonial processes including the dispossession of indigenous lands and resources and the development of Western management institutions to govern the use of culturally important fish resources have served in many ways to marginalize indigenous interests within the United States fisheries. In recent years, several US fishery institutions have begun to develop policies that can confront this colonial legacy by better accommodating indigenous perspectives and rights in fishery management practices. This paper analyzes two such policies: the 2005 community quota entity program in Alaska which permits rural communities (predominantly Alaska Native villages) to purchase and lease commercial halibut fishing privileges and the 1994 State of Hawai?i community-based subsistence fishing area (CBSFA) legislation through which Native Hawaiian communities can designate marine space near their community as CBSFAs and collaborate with the state of Hawai?i to manage those areas according to traditional Hawaiian practices. The analysis reveals a striking similarity between the trajectories of these two policies. While they both offered significant potential for incorporating indigenous rights and environmental justice into state or federal fishery management, they have so far largely failed to do so. Environmental managers can gain insights from the challenges and potentials of these two policies. In order to introduce meaningful change, environmental policies that incorporate indigenous rights and environmental justice require a commitment of financial and institutional support from natural resource agencies, a commitment from indigenous groups and communities to organize and develop capacity, and careful consideration of contextual and cultural factors in the design of the policy framework.  相似文献

This paper seeks to understand the effect of social, economic and political conditions on the selection and effectiveness of voluntary policy in Japan. Borrowing from two sets of literature, the paper develops a two-dimensional framework for analysis of voluntary policy that helps clarify the contextual factors that determine voluntary policy choice and effectiveness. The establishment of voluntary agreements in Japan are then investigated and the specific experiences of one Japanese city's experience, Kita Kyushu. Findings show that insufficient national and local statutory regulations, local citizen pressure resulting from significant pollution problems, city-controlled non-regulatory resources, and local level regulatory power determined Kita Kyushu's policy choice and the resulting effectiveness of voluntary environmental agreements. Findings then indicate where the Japanese experience falls within the framework. The usefulness of the framework for analysis and practice is then reinforced, and challenges for some of the basic assumptions of current theory are suggested.  相似文献

This paper examines the institutional framework of artisanal mining in the forests of the Sangha Tri-National Landscape (TNS) in the Congo Basin. Artisanal miners in Cameroon and the Central African Republic (CAR) commonly make sacrifices to their god of diamonds, to improve fortunes. This study looks into ‘the other forces’; institutions that play a role in shaping the sector and its outcomes. These institutions comprise formal and informal institutions at a local, national, regional and international level. Although artisanal miners in TNS benefit by gaining cash income, this activity also carries risks as income is highly disparate and environmental impacts in this priority forest conservation area are expected to increase due to the growing competition over land use. It was concluded from a literature review, interviews and site visits that informal arrangements dominate the sector, especially in Cameroon, leading to poor relations between officials and miners and meaning that miners have few rights and no voice. The current institutional setup is inadequate to deal with current and anticipated social and environmental issues. Future interventions need to take into account the existing (local) types of organization, vulnerable groups, the interests of multiple actors and the fact that most miners are experienced but combine mining with other activities, such as agriculture, fishing and harvesting forest products. African initiatives concerning ASM offer opportunities to Cameroon and CAR to collaborate with other countries to combat similar issues. A regional integrated approach of both the forest and mining sector would be especially relevant for trans-boundary agreements, such as concerning the TNS, to reinforce positive outcomes for the landscape and the area's population.  相似文献

ABSTRACT: This paper reports the use of a water negotiation model, the Legal‐Institutional Analysis Model (LIAM), in the bi‐national setting of the U.S. and Mexico in the Paso del Norte region. The following study discusses the results of developing baseline data where interstate, international, and cultural factors, as well as a long history of conflict, impact on negotiations and the extent to which the LIAM is a valuable tool for analyzing behavior among institutional actors in such a setting. The findings suggest that most water policy actors in the region prefer brokered solutions as defined within the LIAM framework.  相似文献

This article presents new concepts for the organization of increasingly complex environmental research activities on the institutional, the national, or the international level. An environmental research cycle with four phases, similar to the industrial product cycle, is described, and its implications in managing the interface between research, policy making, and enforcement are depicted. Furthermore, five main themes of future environmental research are proposed, including advanced analytical methods, environmental monitoring, an environmental management information system (EMIS), and the development of ecological targets at a national and a global level. The specific tasks of universities, private organizations, and governmental institutions in the total environmental research area are defined and a structure is proposed to develop collaborative networks.  相似文献

This paper reports the findings of a preliminary analysis of 15 case studies of inshore marine protected areas in the UK. It draws on the common-pool resource (CPR) literature and is premised on the thesis that building partnership capacity amongst relevant authorities and resource users provides a critical basis for overcoming collective action problems (CAPs), through the development of incentive structures and social capital, in order to achieve strategic objectives. Particular attention is paid to the influence of statutory marine biodiversity conservation obligations to the European Commission for marine special areas of conservation (MSACs), as these are an important external contextual factor. The risks of imposition and parochialism are outlined and the challenges of taking a balanced approach are discussed. The challenges posed by the attributes of the marine environment are considered, as are those posed by the policy framework for MSACs. The findings are discussed in relation to three questions: (i) which partnership models appear to have the potential to overcome the CAPs posed by inshore MSACs? (ii) what CAPs had to be addressed during the early phase of development of the MSAC co-management regimes? (iii) what are the likely future CAPs for the collaborative management of MSACs that each partnership will need to address? These preliminary findings will form the basis for future studies to analyse the outcomes of these 15 initiatives, in order to assess the strengths, in various contexts, of different approaches for building resilient and balanced, thereby effective, institutions for the co-management of MSACs in the UK.  相似文献

From a state-centric view, sub-national level of participation at the international level can be only feasible if it is an active part of national policy. In the case of Shiga prefectural government's initiative for international lake-environmental cooperation, however, sub-national actors came to see themselves as direct players in the absence of national policy. This study examines under what conditions and in what ways such sub-national level of participation takes place by conducting a case study of Shiga's collaboration with the United Nations Environmental Programme (UNEP) over lake-environment risk reduction. The article finds that the process of Shiga's participation in transnational governance will have less chance of being duplicated effectively in other Japanese sub-national governments. Shiga's cooperation with the UNEP was primarily driven by the ad hoc bottom-up political mobilisation of the sub-national actors. In general, without institutionalised channels for sub-national governments to participate in the regional/international level, sub-national governments need to mobilise resources on such an ad hoc basis and only pioneering sub-national actors are capable of effectively engaged on unfamiliar territory with the formation process of transnational governance.  相似文献

In Norway, traditional nature conservation by government declaration is still the dominant way of protecting nature areas of national and international interest. This article presents some results from a case study of one exceptional case of private-public partnership in nature conservation. Strong opposition among local actors resulted in conservation by legal contracts between public and private actors. Discussing some possible explanations, the authors argue that a rather special network among the local community and central government and a rather creative combination of environmental and agricultural policy instruments were essential for this particular outcome.  相似文献

Governments fulfil important roles in increasing the adaptive capacity of local communities to respond to climate change impacts, particularly in developing countries. Existing studies on how governments enable and constrain the ways in which local level communities learn and build their adaptive capacity, however, generally adopt network or market-oriented types of governance. However, the most vulnerable regions to climate change impact in the world are generally governed through hierarchical policy systems. This research aims to understand how the hierarchical policy system in Vietnam creates enables and/or constrains the policy capacity of policy actors to contribute to effective climate change adaptation. We conducted interviews (n?=?26) with key actors at multiple levels of government. Our findings show the importance of clear legal institutions, available financing for implementing policies, and the training of governmental staff, particularly at district and commune levels where the policy capacities are generally too low to deal with climate change impacts. We conclude that any efforts to support local actors (i.e. smallholder farmers) should include investments in policy capacity to ensure uptake and upscaling of adaptation actions more broadly.  相似文献

环境、社会和治理(ESG)是一种由资本市场发展形成的融合多利益相关方诉求的新理念,目的是推动企业提升社会责任和实现可持续发展。推进ESG理念在中国发展,对国家扩大对外开放、增强企业国际竞争力以及实现“双碳”目标具有重大意义。本研究通过综述2019年3月—2022年3月以来国内外以ESG为主题的文献,分析ESG实践特点和发展新动向。研究发现,ESG三要素在金融投资、企业或银行财务表现、企业价值、企业社会责任绩效以及可持续发展能力方面会产生多样化影响。本文建立了一个包含ESG多利益相关方、第三方机构以及ESG代表性指南政策法规的运行体系框架,形象化地凝练了ESG的内涵和实践重点;结合理论研究,运用驱动力、压力、状态影响及响应(DPSIR)分析框架揭示了ESG理念在我国“双碳”目标下的发展方向。最后,建议从三方面推进ESG理念:以工业园区为载体推动企业整体性开展ESG实践创新;推进A股企业扩大ESG实践示范试点,引领中小企业整体提升;引导投资者积极参与ESG投资,推进企业提升现代化环境治理能力。  相似文献

Case studies of two Swedish municipalities indicate that the general energy area was divided into three independent policy areas: one dealing with supply, one with conservation and one with environmental questions related to the Agenda 21 vision of an ecologically sustainable energy system. However, the dominant energy policy area in the municipalities was supply policy. This article discusses why supply policy is dominant and the consequences of this for energy system development. Analysis of this pattern reveals that powerful actors, such as local energy companies, were able to mobilize support for supply policies, not least because they owned the energy plants and distribution networks.
