矿业环境相邻关系的界定是相应环境产权私人化的途径。由矿业环境相邻权与矿业成员环境权双向对接组成的环境相邻关系,通过法律来约束矿山企业的环境相邻权和激励相邻对方的成员环境权而共同保护矿业环境。矿山企业一方给相邻对方合理施加容忍义务,相邻对方应当容忍非实质性的或当地通行的影响。成员环境权的保护,是基于物权而行使消除危险、排除妨害和恢复原状的请求权,基于债权而行使侵害赔偿请求权。 相似文献

矿区权益是指企业取得的已探明可采矿区的开采权利和未探明矿区的可开采权利.如果站在整个矿区的角度看,它是指开采矿区内各个利益主体所享有的权益.我国矿山企业在长期开采矿产资源的过程中,出现了地面塌陷、废矸石占地、污水排放、掠夺式开采、矿难事故等不良现象,其中许多问题都甩给了社会.在开采矿区建立绿色会计,有利于维护各种权益,遏制不良现象的发生,并为绿色GDP提供直接依据. 相似文献

With the fast development of Chinese economy in recent years, China has become the largest coal production and consumption country in the world. Correspondingly, it has produced large quantities of mining waste including coal gangue, coal sludge, fly-ash, coal mine drainage and coal-bed methane (CBM) that are hazardous to the soil, air, and water. Based on the theory and practice of sustainable development and recycling economy, the paper will discuss and analyze the mining waste management in Jincheng Anthracite Mining Group, Shanxi Province, where they have found the paths to realize the mining waste reusing and recycling in colliery. They had established many green industrial chains in the mining waste treatment: the gangue piles turned into man-made eco-park, gangue used for power generation, fly-ash used in the building material, the coal mining water reused and recycled in closed pipelines, the CBM extracted for home-burning and electricity generation, etc. The coal mining waste has been converted into wealth and played more and more important roles in many fields. Mining often brings certain irreversible changes to the surrounding environment. Different types of natural resources mostly surround the mines. Degradation of natural resources around the active mining zone may adversely affect the local economy. After cessation of mining operations local people may no longer be able to sustain their livelihood from the surrounding degraded natural resource; there are chances that the economy of the region will be shattered. The paper deals with this problem of local level sustainability of iron ore mining in eastern India. This problem is examined in the light of different theories of sustainability and national policies. By using household survey data, sustainability of iron ore mining in this region is tested. Substitution of depleting natural capital with other forms of capital can promote long-term sustainability of the local economy. This necessitates certain policy interventions to induce the mine operators to reinvest some part of their resource rent in the natural capital of the region. 相似文献

This study examined the environmental and social effects of large‐scale mining in Chingola, Zambia. Data was collected through semi‐structured interviews with 164 residents living close to Zambia's largest open pit mine, key informants and desk analysis of secondary data. Quantitative data was analysed using the chi‐square test, one sample T‐test and two sample Z‐proportions test, while qualitative data was analysed using content analysis. Results show that the residents reported being most affected by sulphur dioxide air emissions and noise pollution due to the proximity of the copper smelter and heavy moving machinery to their residences. The residents received domestic water containing rust and copper ore particles from the water utility company which draws raw water from the mine. Although the mine was a source of employment for locals, over 4,000 jobs (representing a 33% decrease) have been lost over a period of 4 years, negatively affecting the local economy. Mine management attributed the job losses to high production costs and mechanization of mining processes. The residents perceived the job losses to have led to crime, alcohol abuse and prostitution among youths as well as a general increase in poverty levels. Analysis of air emissions data from the mine found elevated levels of dust, cadmium, copper and lead pollutants. Key informants from Nchanga Mine reported implementing bioremediation to reduce soil contamination by the heavy metals and recycling SO2 to produce sulphuric acid. The study recommends an increase in social corporate responsibility from the mine management to ensure residents derive more substantive benefits from their proximity to the mine. 相似文献

This paper applies the resilience lens to a social–ecological system characterized by the presence of large-scale mineral extraction operations. The system in question is the Brazilian community of Itabira, Minas Gerais, host to an iron ore operation of Vale, the world’s second largest mining corporation. Utilizing a resilience assessment framework, this study describes the various components of the Itabira social–ecological system revealing the challenges brought about by mining’s dominance. Data collection included literature reviews and semi-structured interviews with 29 individuals representing different stakeholder groups. Findings revealed that, despite recent efforts by government to regulate the industry, the mine continues to generate press and pulse disturbances that impact the resilience of the community. Operating from the standpoint that resilience depends largely upon the management capacity of stakeholders, the research identifies three ways to improve mining governance in Itabira. First, there is a need for local government to have more power in dealings with the corporation. Concurrent with this power, however, the municipality must demonstrate ownership over its fate, ideally through the creation of a sustainability plan. Finally, all key parties must demonstrate commitment to cooperating to resolve outstanding disturbances, even when these fall outside the regulatory approval process. While Itabira will remain a mining town for the foreseeable future, actions taken now to address challenges will only strengthen community well-being and sustainability moving forward. 相似文献

当前,我国矿山环境问题突出。重点分析了矿山开采环境问题的特殊性,这些特殊性包括矿业对地域区位的依赖性、破坏的大量不确定性以及不可逆性。根据特殊性,讨论了环境经济学的适用性。不确定问题转化为确定性问题或者风险问题依赖于技术层面学科(如矿山环境影响评价和矿山环境地质学等)的支撑。最后指出随着这些技术学科的发展,矿山环境问题就会更精确地纳入成本——效益分析框架,从而发挥更大的作用。 相似文献
